Dude...Money/Savings is not everything. Don't spoil your health by working all night for 6 months. Your manager trusts you, don't take advantage of it. Do not hide anything from your employer. They may approve short term remote work from India if you open to them and they may accept to work from India day time. When you open your own company, do you like your employees do same?

All Indians stuck in GC backlog, the only shot is hr392, or removal of per country caps.

1) it doesn't increase the number of gcs
2) it helps reduce exploitation under the hands of some shady consulting companies.
3) allows free movement of labor and reduces wage depression.
4) it is fair, first come first served. Americans like that.
5) has 90+ cosponsors within a month, bi partisan support.
6)removal of country caps is a part of at least 2 more bills. So, there is momentum.

In a lot of ways it helps the country. There are many who don't want this to happen and will try to discourage you, by saying it won't happen, give some past examples of failure to show it won't happen in the future. As we all know, things take time and with more support we can get this done.

IV (whether you like them or not), has a very good handle on this and really need your support. Please help them, help ourselves.




Yes sir....we all need to work on this "for our green cards". Spread the word please.

Agreed. I also believe IV(or some other org) worked with Rep.Jason to introduce this bill, which is to bring Fairness to the system.

I don't care IV has good boys or bad boys, but I have a respect on them as they are working for my cause.

We should do our part by contacting our congressmen to support the bill (Yeah...we don't need to represent IV when we contact).




Several years only IV as a group is trying to eliminate per country cap and a handful Indians or Chinese supported them either showing up in demonstrations or donating for the cause. This group never gave up. Their earlier 2 attempt failed and again they started with same enthusiasm.
If per country cap is removed that is only for the people in IV group and there will be many lechers who would take the advantage happily.
Again Rep. Jason Chaffetz was approached by IV group and he submitted HR392 and those IV volunteers secured 52 support till now. I am hopeful and I support them. If you don’t support IV start opposing this bill.

Yes. I am saying FY 16 will not be as bad as FY 16 in terms of SO. USCIS/DoS did have better than before idea while setting up filing date of July 2009. In terms of date movements, it will be June - Aug 2009. EB2I demand did spike though. There could be 6 to 8K SO from all category to EB2 I.

Are you saying this year will not be as bad as last year? Howmuch spillover you are expecting and will the dates touch July?


I want to make a slight correction to my previous post about SO from EB2 ROW. My earlier calculation in Aug 2015 was 8.6 K total for EB2 I which means it could be approximately 5 to 6 K SO from EB2 ROW.

That said we can not compare situation in FY 15 with FY 16. The dynamics changed. FY 15 had lot of EB2 ROW PERM backlog created in FY 14. That is not the case in FY 16. The ROW demand is steady , it is not going spike as it did in FY 15. Besides EB3 ROW is almost current whoever needs to change job to upgrade to EB2 ROW would think more than once.

Urgent help needed.

Hi all,
Apologies for posting it here as it has high visibility and the issue is pressing.
One of my friends was employed at an non everfied company and had to quit them when she didn't get H1 this year. In desperate situation, to get OPT extension, she joined a desi consultancy firm. They made her sign a contract that if she leaves within some months she's liable to pay $9000 for the cost incurred by them for her training. Now he has gotten her extension and she resigned. They are threatening her with lawsuit saying if she doesn't pay up then they will make sure her H1B application has problems next year. My questions are, the money they are demanding, is that even legal? It's not like they paid her joining bonus and taking it back. Also, can they really screw her H1B application by another employer next year?

I am not sure about what is legal and illegal. When signing contract, your friend know she has to pay 9K if she break contract, which she did. Now she don't want to pay? where is trust? I think title of this post (Urgent help needed. Desi consultancy harassing friend) is incorrect as other party is not harassing, but asking what your friend agreed to.

It may be legal, if not why would companies come out with these kind of agreements. Suggest your friend to review with attorney if she don't want to stand on what she agreed to.

Well said. All dreams come true if we have the courage to pursue them. We need to work together for us.

I really enjoy good conversations by people like Matt, Zzzzz, iamtired..etc. These people has good knowledge on system. I also like gclaya, not because of his lawyer predictions, but because of his good humor, he always bring smile on my face with his responses.

That is perfect. In current case, education evaluation has to show your 3+2 is equivalent to US Bachelors in Business Administration.

Zzzzz pointed they may see your experience from 2011. This is something I am not very sure about. Attorney office can confirm.
