Attorney confirmed I-140 is Approved - EB2/NIW-non concurrent, No RFE received.
USCIS Rcv Date: 11/14/2016
Approved Date: 11/6/2017, it has been 1 year!!!!
Status is still showing as 'Case Received' on the USCIS website.

question?, I am preparing renewal for my H1b, shall I have to include the I-140 approval notice in the H1b renewal package?

I applied for I-140 /NIW , Texas, on 11/14/2016, non concurrent,
I raised SR on 8/2/2017, today I received this answer " We have received your service request and researched the status of your case. Our system indicates that the required background investigation for your pending application is still open. We cannot move forward with your case until the background investigation is completed.
These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete.
What You Can Do
Please see the "Online Services" below to check the status of your case in the future.
We hope this information is helpful to you"

my questions are.
is that ok for the USCIS to do background check for the I-140??, I think they do for the application of I-485.
why it takes 10 months for them to do background check?? and this meaning they even did not look to my file until now?
and if they get my back ground check, my file will be suspect to regular processing time that might be 8-10 months?

Hi all
i filled my I-140/NIW at TSC on 11-14-2016, and still pending
do you think it is good idea filling the I-485 now using the I-140 receipt notice? since i want to visit home asap,
also my project fund will be ending on this December? so if I get the EAD , can I work at any place other than academia?
