Hi Everyone,
My PD is 02/21/2007 @ TSC, I submitted my 485 during the 2006/2007 window I got an RFE late Nov'17 and responded back mid Dec 17. RFER date: 1/3/2018. Current status say :"Name Updated" since i had a change of attorney. My wife has her own GC process which started prior to our marriage. Her priority date is 04/2006 but she couldn't submit the 485 during that window. She became current last year and she filed her 485 in Sept 2017. Her lawyers added my information to her application at the time. Her case was transferred to NBC in Jan 2018. In response to my RFE, I updated my status to married and added her information. My question: Do I need to do something when I get current (April), so we don't have to go through the interview process (if it is avoidable). I will be checking with my lawyers as well but thought I'd ask the experts here. I may have misused some terminology(so apologies in advance for my ignorance). Good luck to those who are current!

1. "She became current last year and she filed her 485 in Sept 2017. Her lawyers added my information to her application at the time" Did they file for your AOS as her dependent then? I'm not sure if that is the process since you already have your AoS pending.

2. It appears her 485 will be processed earlier than yours since she is current. If so, since her filing was done Aug 2017, she comes under 'Mandatory interviews will be implemented for all employment based applicants who’s I-485 Adjustment of Status to Permanent Resident (i.e. green card) applications were filed on or after March 6, 2017 under EB1,2,3' I'm guessing interview is mandatory

3. As a spouse, you may be interviewed, but it is possible since your AoS was filed in 2006/2007 window, you may not be called.

This has been discussed before. Most of us have received a similar notification after primary's approval. This is probably because the primary's file is transferred to local office for the Field office to evaluate and basis the derivative's petition. Not to worry.

Thank you; I wish you the best. For spouses, especially with primary approved, it should be a simple straightforward case. However, I don’t know why they held my wife’s for review as did they hold back others.

Did your wife get her EAD?

Thank you. What was the PD printed on your wife’s interview letter. Was it your PD or her RD?



My wife had her interview today. Waiting time was more but interview was only about 5-7 mins. I was also allowed with her. The officer had her entire file in front of him.
Since we did not have an attorney to attend, asked her to sign a waiver. Then asked her about last date of entry, date of birth, our sons name, where she works, reviewed her passports. Lastly made her sign on a paper that was the oath. Thats it. No other documents asked.
He mentioned since my primary 485 was already approved she should get her GC in 30 to 45 days. I am hoping it would be sooner.

Yes. She did the interview. I wrote about the experiences in this forum. Also, we received her EAD /Parole combo card. Interestingly, the Combo card is valid only for one year.

My wife had her RD as the PD. When I pointed this out to the attorney, they said this must be a USCIS error and we should talk to them to fix it. However, my wife didn’t talk to a L2 officer yet. I have. Noticed few others who has a similar PD like this. One of them is going for an interview and I hope they will be able to ask about this anomaly.

You definitely should take an infopass or talk to a L2 Officer

It would be a good idea to go unless you have other reasons, chances are both will be allowed. It maybe helpful. Also, even if both are allowed inside, both may not be asked to take the oath, you can ask to take the oath, so your answers will qualify.

Decide based on your circumstances.

325 a is required from what I know, and our attorney had us put it in. It talks about employment and residence history, and includes last address out of the US over an year. Hence, its important. I don't know about this updated 485 you are referring to.

I will try to answer that.

1. Attorney told us to expect a) Only for spouse to be called in; b) Only for spouse to answer all questions, c) spouse to answer questions even about my employment. He did say, it may sound odd, but since this is EB case, it will be off my 140.

2. Since I was also in the room, the officer directed my employment questions to me. So, I guess that was because I was present. Otherwise, she may have asked my spouse. Officer directed questions about my spouse's employment, visa etc., to her directly.

3. I am not sure if my spouse would have been asked questions about my employment before marriage, had I not been there.

1. Yes. I also saw couples where the partner asked to go. It is the officers discretion I believe. They may choose to interview both, just one or both separately. Any scenario can happen. It’s a bit hazy.
2. They were for my spouse. She had her own work visa and as such is responsible for her information
3. It was not necessary, but I don’t think it would have been an issue. Both were under oath. If there is some confusion or spouse doesn’t remember something, I think it’s ok to ask for permission to verify details and answer. Reg travel history I printed off the CBP website. We already enclosed copies of her 797 so she didn’t ask for them.
Having said this, they have access to all the information so probably it’s just for convenience they ask us to carry. I don’t know though!
