Yes. She did the interview. I wrote about the experiences in this forum. Also, we received her EAD /Parole combo card. Interestingly, the Combo card is valid only for one year.

My wife had her RD as the PD. When I pointed this out to the attorney, they said this must be a USCIS error and we should talk to them to fix it. However, my wife didn’t talk to a L2 officer yet. I have. Noticed few others who has a similar PD like this. One of them is going for an interview and I hope they will be able to ask about this anomaly.

You definitely should take an infopass or talk to a L2 Officer

It would be a good idea to go unless you have other reasons, chances are both will be allowed. It maybe helpful. Also, even if both are allowed inside, both may not be asked to take the oath, you can ask to take the oath, so your answers will qualify.

Decide based on your circumstances.

325 a is required from what I know, and our attorney had us put it in. It talks about employment and residence history, and includes last address out of the US over an year. Hence, its important. I don't know about this updated 485 you are referring to.

I will try to answer that.

1. Attorney told us to expect a) Only for spouse to be called in; b) Only for spouse to answer all questions, c) spouse to answer questions even about my employment. He did say, it may sound odd, but since this is EB case, it will be off my 140.

2. Since I was also in the room, the officer directed my employment questions to me. So, I guess that was because I was present. Otherwise, she may have asked my spouse. Officer directed questions about my spouse's employment, visa etc., to her directly.

3. I am not sure if my spouse would have been asked questions about my employment before marriage, had I not been there.

1. Yes. I also saw couples where the partner asked to go. It is the officers discretion I believe. They may choose to interview both, just one or both separately. Any scenario can happen. It’s a bit hazy.
2. They were for my spouse. She had her own work visa and as such is responsible for her information
3. It was not necessary, but I don’t think it would have been an issue. Both were under oath. If there is some confusion or spouse doesn’t remember something, I think it’s ok to ask for permission to verify details and answer. Reg travel history I printed off the CBP website. We already enclosed copies of her 797 so she didn’t ask for them.
Having said this, they have access to all the information so probably it’s just for convenience they ask us to carry. I don’t know though!

I don’t think it will be a problem. I’m guessing you will get an RFE, or, if an interview is scheduled, you maybe asked to take those documents along.

As a primary, it’s based on your income and willingness to support, not her income capability. I-134 is needed for EB derivatives

Not sure why you were hoping not to get approved early. If you think it would impact your spouse's case, I don't think so.

Also, I don't know why your attorney filed just those documents. Below is list for my spouse:

G325A
Copy of I-140 Approval
Copy of Visa Bulletin
Copy of Marriage Cert (with english translation if applicable)
Copy of birth cert with translation (with english translation if applicable)
Copy of latest I-94
Complete copies of current and expired passports
Copies of all I-797s evidencing lawful status
Sealed Medical Exam results
Copy of paystubs, both primary and derivative
Copies of Principal's Tax returns and W2 as evidence of not becoming a public charge

I-765 with photographs
I-131

For I-765 and 131 they also enclosed principals 140 approval, copy of marriage cert, biographic page of passport I-94

Mobile Devices:
We did not take our mobile phones inside since the attorney advised use we are not supposed to carry anything that emits a flash, vibrates or emit the sound of an alarm. I read contradictory experiences where folks took their phones, and were even asked to show pictures on their phone. I decided we would not carry our phones into the building. That was a tough phone free couple of hours

Security Screening:
We went through a TSA type security check. So, keep in mind about liquids etc., and allow sufficient time.

Documents Taken:
We took everything on the interview notice and some. You won’t be taking the affidavit of supportI-864 since this is EB case, and you probably have provided I-134 already. Organize your documents in order and index them so you can take out quickly. Separate originals and copies. Copies are important as are originals.

Attorney:
I asked my attorney if an attorney would be required. He said my case is a straightforward and no complications. Moreover, an attorney will not answer your answers. You are liable for your actions, answers and facts. What an attorney will do is, if the officer doesn’t know some law, or crosses the line on questioning, he may intervene appropriately or make a statement etc., but not sure if that happens. I read somewhere on a forum that the officer didn’t know something, and the attorney helped the officer understand or find the rule. That same person also wrote ‘the officer seemed to know the attorney already, so it was good’ I wouldn’t buy that. Officers make independent reviews and decisions based on law/ rules. Not because they have seen an attorney a few times.

I know one may feel comfortable and confident if we have an attorney and are well prepared. However, before you spend that 2 grand on an attorney, find out what exact value they would be contributing, and if it would be necessary. Almost all desi couples I saw had their attorneys. Make an independent evaluation and decision based on your circumstances and case. We chose not to take any attorney.

Do not get upset if they don’t call you in your assigned time. They have a heavy caseload and after waiting so many years, a couple hours more wait isn’t a big deal. I saw one guy walk upto an officer to ask when he would be called. He was very impatient, and I felt he was a bit brash in the manner he asked, an officer is not an assisstant. You should ask the check in clerk if you have not been called even after 1 hour after your appointment.

As long as the truths and facts are as stated, nothing to worry.

Hope this helps. Please post your experiences.

Again: In your interview, make a note to ask the officer about the RD shown as the PD for spouse instead of the primary’s PD. I would like to know what they say as we are worried on this.

Dress Code:
No formal dress code, but we chose business casual for spouse, tie and suit for me. Its your individual choice. The officers were all in business casual.

I missed asking the officer on the anomaly about the PD. If any of you go, please make a point to ask the officer about the RD shown as the PD for spouse and why it is so. On the flip side, I realized this ended up being an interview for me as well Not that I’m complaining, but the whole process is elongated. The officer had both mine, and my spouse’s 485 files with her and she asked questions off both.

Before we were called, while we were waiting, we saw a few people go in and come out very happy and excited. They probably got their approval on the spot, or were told so. Few others, were hard to judge. I would say, do not look at others and stress yourself out. Each person’s case and experience are different. Ours was a straightforward case, so didn’t know what the review was.
