One of the prominent Immigration Law firm conducted a QA session with ITserve members (majority are H1 dependent employers) couple of days back, topics that were discussed on are H1B Immigration related Bills introduced this year, Leaked EO on H1b etc and they were also discussing the proactive ways to counter the above said topics.

It seems removal of country cap bill is a major concern for them and their goal is to create lot of negative comment about this bill. You can see large number of people started opposing the bill in Trackitt forums and else where. All these IDs are created with in couple of days and their negative PR has already been started. I dont know what is their complete strategy but thought of sharing my views

You are right, they are spreading confusion and demonizing IV & SIIA. There are sudden spike in number of negative messages about IV (I am not trying to defend IV, but why now and with in last couple of days).

If you are good at communicating in business English, then try Remote call center jobs. Its pretty easy to get one, they do provide paid training and flexible schedules. Usually the holiday seasons are the good time to get one. Pay would be around $10 - $11/hr, need to have laptop and high speed internet connection. Search Indeed.com

I don't think he is eligible for Eb1C which requires the person to be working outside US for 1 yrs within last 3 years of application date. If he was in US for last 5 yrs then he will not get EB1C

Yes, H4 Extn and H4 EAD Extn applied along with my H1 extn in premium, all three got approved within 10 days. Good that premium fee paid towards H1 is benefited for H4 EAD too

There are genuine shortage on Teachers, Nursing and other professions where employers can't afford 110K for H1Bs. Enforcing the $ amount will derail the true purpose of H1B

I see most of the comments being stereo type on House wives and QA skill. I have seen lot of people who call themselves as Software Architects are just merely programmers (with extra few years of experience so they get the title). No skill can be claimed superior in ADM environments and no one should feel superior having fancy titles. Getting paid more doesn't make one skilled, there are lot of High school teachers in Atlanta who are in H1B and they are not paid well like IT, doesn't mean their skill are inferior to IT people.

You can also try looking for openings in the company websites directly in the career section....there are lot of companies headquartered in Chicago area like Sears, Kraft foods etc and also every big corporate's might have some operational centers in Chicago.

When applying for Non IT job, have your resume updated to reflect the skills in par with job posting. I am not asking to cook up with fake experience but can highlight other thing we usually do in IT company like being Party admin or Training coordinator or team newsletter editor etc

It depends on what area you live in and how good the IT opportunities are. There are lot of jobs in the market which are categorized as non IT like data analyst, Customer Support Agent (not call center but other supporting jobs), my advice is to go for them for initial few months...demonstrate your IT skills there and switch over to the developer position slowly. I know quite a few people in my company who joined in non IT role and over the period of time learned the skill and switched over to Business Analyst, Report development etc. In most of the companies, people within team are considered for the positions instead of recruiting a new one. If you are looking for entry level job then mention that clearly in your resume.

Even my employer said the same today....i am not sure how reliable is his attorney. His attorney friend told him that any one with I-140 approved by Jan 2015 will be eligible for 485 filing which will be implemented by Nov 1st 2015. I am not going to bet on that till USCIS release it officially.

During July 2015, White House published Visa Modernization Report which has four recommendations for Employment based immigration (https://www.whitehouse.gov/sites/default/files/d...)

Recommendation 1: Update the monthly Visa Bulletin
Recommendation 2: Refine monthly allocation of visas
Recommendation 3: Improve numerically controlled immigrant visa appointments
Recommendation 4: Clarify and expand protections for employment-based immigrants and non immigrants

October Visa Bulletin reform might be targeted for Recommendation 1 and partly 2.

I140 EAD/AOS AP is what we all are asking for, but as per the current law AOS can not be done until the visa numbers are available (that's why DOS provided an acceptance date that they think can be potential current date for each category by end of next FY which they can easily defend if any lawsuits filed). Not sure if the Acceptance date will move during each month's bulletin or once in year (Oct bulletin)

Recommendation # 4 is the only option they can provide for people outside the Acceptance date (greater than Jul 2011). It might be EAD or potentially "The ownership of I-140" to the employee after 1 year of I-140 approval date (Recommendation # 4 stated in the report clearly says 1 year).

I-140 Ownership - Employee can take promotion/switch job without applying PERM/I140 again (might have same or similar job clause in it), we might have to maintain H1b and go thru all stamping formalities. It might not have all the benefits of EAD like taking multiple jobs or starting a business etc.

As per USCIS/DOS what we WANT is I140 EAD and what we NEED is I140 Ownership. Now its up to each individual to believe in what USCIS/DOS might come up with for recommendation # 4.

Based on my assumption, current visa bulletin format might be an initial framework setup for accommodating RIN 1615-AC05. Once the rule is implemented the acceptance date might move significantly. As of now DOS is claiming that the new format is to better estimate immigrant visa availabilty.

Still the intention of RIN 1615-AC05 (allow certain approved Immigrant Petition for Alien Worker (Form I-140) beneficiaries to obtain work authorization, clarify the meaning of portable work authorization, and remove unnecessary restrictions on the ability to change jobs or progress in careers, as well as provide relief to workers facing lengthy adjustment delays.) is not implemented / addressed completely but process was setup in place.

We still have to wait for RIN 1615-AC05 draft from DHS which is not proposed yet.
