You'll be most likely fine. Rule of thumb is 90 days, some people say less. 4-5 months should be completely fine. Enjoy freedom.

Topic: Case Transferred to NBC - November/December 2017

Checked status by phone because none of the physical notices have arrived, and it says it was transferred to Mesquite TX... which I guess is the TSC? So it was sent from TSC to somewhere (I assume NBC) and then sent back? I hope it's just a mistake or something, would be a pain in the ass if it was just shuffled around for no reason, adding waiting time.

Vermont is further ahead in processing dates, by like 3 months. Most likely they are just balancing the load between service centers. I don't know why they have to send them to NBC first, but that seems to be what's happening here.

Did you get a second text for another transfer? From what I've seen here, TSC -> NBC -> VSC is happenig a lot because they are more than 3 months ahead.

2nd Case transferred notice (email, new office has jurisdiction blah blah blah) 12/01

No physical notices yet. My guess is that it was TSC -> NBC -> VSC, but who knows. Will confirm when the physical notices arrive.

Topic: Surprise visit by USCIS officers

That's ridiculous and you know it. It was envisioned for executives, not for "managing" a project without direct reports or without any strategic capacity. That's why it doesn't require a PERM. Project Manager isn't that... "managing each other" isn't that either. It's a very cynical and abusive interpretation of the rules as written, and I wish the EB-2/3 folks challenging it the best of lucks.

I feel so bad for all the Indian folks doomed to years of waiting because of EB1-C fraud. Hope they keep these visits and make them more common.

I also hope the local offices keep an eye during the new required in person interviews... Imagine when they get multiple "managers" all working in the same project... hopefully they will get the tools to stop this blatant fraud.

Topic: August 2017 I-485 filers

I also got the transfer notice. However, no updates on I-140, AP or EAD. My guess is that I-140 is being transferred to NBC along with I-485 (because concurrent filing) and TX Center will do the EAD/AP.

NBC will then do RFEs / Interview scheduling / blah blah blah and eventually transfer to local office for interview.

Let's see... it looks like things going through NBC is helping move things along, we'll see.

I guess I am in the November batch... as soon as I got my notice I posted a thread, and now I see all these thread bumps and new threads popping up. So this is now the standard procedure, at least for now.

Topic: I-485 case transferred, but no news on I-140, 131 or 675

Hi all!

So, today I got a text update. I checked online and my I-485 case has been transferred to another office. I haven't got the physical notice, so I don't know where. However, my lawyers say the I-140 is still pending, and I haven't received any updates regarding AP+EAD.

So, question is... are these transfers common? Could they be moving on the I-485 before the I-140 is approved? Seems weird.

Service center is Texas and it is an EB-3 concurrent filing.

Thanks for any insight you may have.

Corrects. That's what USCIS announced... Cases will go to the NBC for interview scheduling and then to field office for actual interview. It's supposed to change once they come up with a process to remove the NBC hop.

You are greatly underestimating the dems' hand. They can absolutely refuse it... in the end the president caused the crisis himself. DACA recipients and their families will be squarely on their side because of the removal of family categories for immigrant visas.

The RAISE act is not gonna pass in its current form. Simply no chance.

It should absolutely stay. You want a diverse immigrant population regardless of whether it was employment or family based. You don't want most permanent settlers from a single country, or from a couple of countries. American needs to remain a melting pot, not a neo-colony.

Democrats will have none of it. Dropping DACA was entirely unnecessary and no one will see its death as their fault, they have 0 reason to compromise to get DACA in legislation... they would rather have any compromise fail and run on legislating DACA themselves in 2018 and 2020.

Yeah, I'm sure there is TONS of vetting to do for a person that has been multiple times before an embassy/consulate for a visa and has filed tons of cases with USCIS. Must be next to impossible to vet someone you ask about their whole damn lives for every tiny little thing so they can keep working. Can't imagine the burden, really.
