I mean once a year. 10 times in 10 years. I should have been more clear. in fact, the first one who replied understand that.

They will welcome one time a year even it takes a year to process it as there is a lot of money involved in it.

End of the day, they can make our lives as hard as it can be.

I am not sure you understand the situation. They won't deny mass applications, everything is case by case and they give only 1-year extension(which already they are doing from last 2-3 years). How many times anyone file 1-year extension, In the worst case they have to file 10 times every year.

The system is so messed up that they knew each and every loophole. Don't underestimate.

Hello,

I am in a tough situation.

My wife was on H1 and doing consulting roles till now. This week I applied for H4-EAD.

Now, My wife got a full time job offer which we want to join and they do H1 and don't want to hire H4-EAD as full time.

They want to file H1 now and will do it premium. H4-EAD typically takes 90 days.

Now, lets say If they file it in premium and H1 approved in next 2 weeks and H4-EAD approved after 1 month.

Which status I will be on after H4-EAD appoved after H1 ? Is there anyway, that I cancel H4-EAD ?

Its a common audit. But it will take some time to get approved after you replied, mostly around 1 year.

No, She already have valid H4 visa stamped until March 2017. So, She can come on that Visa.

What I heard is, until her new H1 is approved with new company, She cannot work.

She is coming back on H4. She got Full Time job with other company.

After she came here on H4, New client is willing to file COS(Change of Status) and then transfer H1.

How long will COS takes? Can we apply COS and H1 at the same time ?

Audited means RFE. No need to do anything. Don't know your situation but if you still have 1-2 years of H1, I think you are worrying too much as of now.

If it is audited, you will get email little late. I think it would be in between July processing.

But IMO, your application is not too late. Wait for 2 more weeks, I think you will get it.

If you won't listen for 2 more weeks, that means you will be audited

I understand your pain. I was on same boat last year. My 1st PERM was rejected after RFE(1 year later) and my 2nd PERM was under processing Now.

Sorry to say this. What I observed is, if any case is not approved along with the others and in the time frame, that means it will be audited. This is just my observation. I wish I would be wrong.

Hello All,

My wife(who is on H4), H1 got approved in Septemeber. She left to India in November on family emergency.

Based on current scenario, she can come back in Feb or March.

Now, My questions are
1) Does she come back on H4( she has H4 stamped until May 2017) ?

2) Her employer is saying, Go to stamping with Oct and Nov paystubs, get stamped and comeback whenever you want. In this case, What about pay stubs for Dec - March ?

3) If she don't get stamped, can she come back on H4 with the current stamping now or Does she go for H4 stamping again ?

4) Another option her employer is saying is, Come back on H4 and after coming here, file Change of Status. Does this work ?

My H1 got picked in lottery. I got RFE last month related to education evaluation.

We are answering that RFE in next 2 weeks. I am not interested in doing Premium processing.

If my H1 got approved in November, what would be my H1 start date ?

Is it still Oct 1st or will it be a different date ?

I got the same reason for denial. My attorney answered that saying the we indicate it correctly. I got acceptance in 2 weeks.
