Topic: Can I buy Home in H1B now

I didnt know they give 6 months to close a deal for a house. I was under the impression that the deal goes through within 4 weeks of making the offer.

Anyways, before everything we do, particularly if involves lot of money, we analysis the risk vs benefit analysis. Once done, if the risks are higher, we find out if there are suitable mitigation we can do for the risks. If the venture remains still pretty much a risk, we back out.

The current client is not that favorable for us. Risk here is to leave the country haphazardly vs benefit is getting our own home. This government does things without a care for consequences and we are already seeing the impact with increased number of RFEs as well as rejections for H1 Extn. There is no assurance that these will settle down; chances are the RFEs/Rejections might go up.

I do not see a good mitigation plan for this risk as well. If it is safe to do so, I'd refrain from buying. You get involved in a house, you pay 20% of the value as your part payment while the remaining 80% comes up as loan. With the immigration climate this bad, the peace of mind you get when buying a home would just not be there.

Personal opinion, I'd not. Then again, house is your own decision. Think hard, talk to your spouse/family and do the best for your family

Topic: 485 for Kids (Aging out and H4 to F1)

I don't have a solution for you mate, except the F1 route. I do know several personal friends who are going through the same situation and they are opting for F1 as well.

Only 2 friends are doing it differently but that's not actually a solution for staying in US. They are trying to see if the kids can settle down some place else by having them attend college in Europe. One is doing college in Germany and other will start college in Netherlands next year. If the kids find the place interesting and like it there, plan is for them to settle down there instead of coming to US.

LOL .... we Indians can never have a decent discussion without personal attacks.

I have no personal hate against IV. All I know is their agenda is not going anywhere in the current form, in my opinion. All I have said is that we all need to be rational and keep our eyes/ears open and not preach because IV or AB or XY said so.

Don't take it personal mate. it is the IV thing. I have always seen these guys break into personal insults and name calling if they can't find a way to argue their point intelligently. This is not the 1st time. :-)

I guess H1 is more prominently spoken but the restriction would touch everyone at some point. Every visa would get impacted. If any visa holders feels comfortable that their visa is not the talking point now, don't be :-)

However, I am kinda frustrated with this kind of thought process by our Indian friends. This is what got us here to this position, in-fighting and jealously against others. As soon as H1 is being taken up for further analysis, you are immediately pointing finger on L1/L2, basically asking they be persecuted as well. Doesn't it sound petty and childish to you?

We did not come to this country on our own. American organizations sponsored our visas and filed for our green cards.



Yep. They sponsored the visa and then put a gun to your head and asked you to board the flight. Why are you leaving out those details? :-)

While filing for GC, they did in their own volition and didn't even consult with you. What a bad guys they are...you poor poor soul who got cheated by organizations for their own needs and ends...

If H1 is capped at 6 years - then yes!!



It is more about vote politics than skin politics. GC are potential voters and Citizens are current vote bank. No political party would touch that knowing fully well that they would get impacted by votes leaving them. Thats one reason DACA has support as well. DACA means lot of votes to your party.

Indians are not that united. If H1Bs are kicked out, GCs/Citizens will not oppose that.

Well. They are fixated on education because that's one way to give out lot more RFEs or even rejection. If they make it a mandate that education should in related field, lot of our folks would get impacted. A vast majority of our folks have different education background than their current field of work. So, they are going to focus more on education than work I am afraid.

Agreed. I only wanted to differentiate between genuine american companies vs body-shopping consultants/Indian services providers.

Your 2nd query about stock and bonus is related to 1st question actually. I am not sure anyone working in body-shopper or Indian service provider gets a stock option in US. Bonus might be there but not stock. However, to your question, they'd take entire W2 as wage for the year rather than LCA amount. Again, just my assumption. I don't have any means to back up why I think that way. I am afraid my mind is taking a position that could be advantageous for me :-)

Ahh no mate. You might want to read up. H1B extn is being taken up for some kind of action as well. We know this was one of the mantra's the current president used during his campaign and to an extent, H1B program is hugely unpopular with US population as well. It would be pretty easy win for them.

Thanks!! How do you define a genuine case? I think everyone here might think they are genuine but what’s your interpretation of genuine? Also how much salary is safe? Based on history do you think uscis will make salaries based on region or it will be flat for entire country?



Just my opinion and this could be a huge faulty one as well. I would think USCIS will take into consideration the following and create priorities based on that:

H1B sponsor is a reputable american company; the likes of american product companies that ranges in several categories like hitech (Google, Apple), life sciences (Astra Zeneca, J&J), finance, banking, etc

Direct employee or engaged in a EVC model

Salary level (lvl 1, 2, 3 or 4)

Years with the organization that would indicate the expertise developed within the org

On the other hand, they might simply not care and send X RFE for every Y apps. Who knows?

If we assume such rule do come in future, so every extension is going to be denied or there will be few allowed? If they will allow few what could be the criteria? And how soon this rule can come?



your 1st question, none here can answer that. If anything, we can only guess what might happen.

2nd question - The H1B extension itself is a rule. If this administration wants to revoke it, then they have to go through the rule making process which would take some time. Anywhere between 6 months to 2 years depending on how fast they want to move forward. However, what they are targeting is "interpreting the term differently". It states that the H1B extension "may be" given for a period of 1 year or 3 years. So, this "may be" is what they want to take and see how they can use it to their advantage which is to refuse the extension. So, going forward, we can see lot more RFEs and rejections. Most genuine cases and at higher salary levels might feel safe while marginal cases would feel susceptible.

3rd question - As mentioned earlier, interpretation they can start pretty early. Might have already started behind the scenes going by increase in RFEs. Rule making, if they take that route, would take some time.

I don't think you addressed this to me but I am not saying it is bad for US. Few H1Bs leaving to India will not affect US in any manner. Some jobs may take more time to get filled but those are not the top of the chain jobs that requires creativity or anything.

Agreed but thinking about folks who are getting back, most would be experienced folks. They may not get senior positions because that's one role that's getting eliminated now in India. Our job market is driven based on experience. If you cross x years, you automatically get into managerial position. Lot of folks would struggle once they are there.

However, this is India. We dont have to be restricted to visa or anything to do what we want. New ventures, new line of business or even farming...everything is under our control as long as we will it.
