Topic: EB3 - Unskilled Worker - I-485 Pending

Thanks for educating me on this. Seems like "High-skilled H-1B" apply for this "Unskilled category" too

Topic: New H1B rules applicable to Full timers ?

Common Bro, where does the EO says 130K. Indian public needs to stop believing all the rumors, and consult the official websites only. Having a fix wage for all locations and roles doesn't make sense anyways.

Topic: Does Amazon Software Manager role let you work remotely ?

Yes, it does. But ask your manager to confirm in your specific case. I have worked in similar role and they did allow to work remotely, if you are on H-1B, you have to file LCA for home location or whatever location you work from, and probably amend H-1B.

Topic: have you rated snapchat

Wow, go tell the Indian public who are bashing snapdeal instead of snapchat and trolling Sonu Sood in place of Sonu Nigham.

Topic: Employer removed my friend on H1b visa now she isout of status

She should either file COS to H4 asap, or go out of country and get the H4 stamped.

Topic: H1B Premium processing

If your H-1B renewal was filed after expiration of original petition, then you were out of status for that period. But as soon as your renewal was filed, you are ok after that. I am not sure about the gap period though, if your employment continued, it can be an un-authorized one and can cause issues in I-485 as well. USCIS may ignore a couple of days gap though.

Topic: How risky is this?

I got your point. What I meant was: For example, a company has only 1 person on H-1B, USCIS doesn't doubt it much, since they are not likely abusing the visa program. It doesn't, off course, mean that they don't have to go through all the paperwork. But, the context was of chances of risk like site visits etc.

It is not on you, H-1B amendment is upon employer, if needed. Your attorney is saying the right thing, again, why take chances, Man?

Topic: H1B Premium processing

By ROW, I meant Rest Of World category which is not oversubscribed like India/China...

Since your date is current, I don't think USCIS will give you 3 years extension on H-1B after Max-out. I might be wrong.

You have to have the physical card in hand in order to start working on EAD. But, for H-1B, it is not the case. H-1B remains good, even if expired and applied for renewal, you are fine.

Topic: H1B Premium processing

There is no relation between your I-485 and H-1B.

But, If it is your H-1B after Maxout and your dates are current, you might not be eligible for H-1B extension, since you are from ROW.

You are fine since you have EAD, you can use any of these.

Topic: H1B Premium processing

Sorry to hear about your case. But, it is weird that the whole package was rejected and not just the Premium processing. Normally, if USCIS doesn't accept the PP, it will just reject the PP, not the petition itself. The petition would be processed under regular processing anyways.

I am sure that your lawyer might have messed up somewhere, for example, wrong filing fees, or missing signature on any form from the employer side. In such scenarios, lawyer might be giving this excuse to save their face. Anyways, yours is a very unique and one-off case, believe me. Good luck!

Its funny because your attorney is suggesting to post a new LCA, and still you went to another attorney.

FYI, LCA posting is free of cost, why take chances?

Topic: Lot of EB1c started now

Can you please elaborate "3 months delay", sorry I couldn't understand it. Is it like your employer used to pay with a 3 months lag in dates of paychecks? I think that's not even allowed. Normal gap may be 1-2 weeks due to the payment processing through various channels.
