Can you give more info on your I-140 application (like filed date/s; regular/premium etc)? I know few friends who got RFE in recent times (requesting any of the following info : Educational Qualification/Experience letter related; Recent Paystub/W2; anything related to Cognizant which GIT would handle on their own). If it is anything related to employee, you will be contacted by GIT within 2-3 weeks mostly.

#1 - I don't think that law states round trip booking is required before arriving to USA. But, I am sure that return ticket will be asked at POE.
#2 - Mostly, Yes.
#3 - Not advisable, just because you wouldn't know what challenges they may face when being asked to show return tickets.

You can expect the notification anytime between 3-4 weeks, after you see your approval on icert perm check status site. This notification will ask you to submit/upload any additional documents that you may need for I140 processing. You can expect your I140 to be filed approximately 1 month before your PERM expiration (~ around 5 months after PERM approval). This is the normal timeline followed for all requests.

GIT can file anytime between June end or July beginning. Process for premium approvals?? If you are asking about Premium filing for I-140, then you need D+ approval (as you would have been emailed).

CTS will get original PERM approval in mail, after which they will communicate that your PERM is approved. This is the reason for their delay (2 - 4 weeks). Once this is done, they will send one required page from your original PERM approval to you for original sign. But do not worry about those steps, as they take their own time.

You can expect a max of 1 month. Average timeline is anywhere from 2 - 4 weeks.

From my knowledge, GMT can inform you anytime around/after 4 weeks of PERM approval that they have received Hard copy. I-140 prep works normally begin only after 8 weeks of your PERM approval and I-140 filing will be done only by 5th month end or 6th month beginning (which will take approximately 3-4 months for I-140 approval, if all goes well)... Hope this might give you an idea.

Guys, A quick qn - Does anyone had their I-140 filed recently (since last week) and have you got any updates about your I-140 filing from GM Team? I just logged into the myVisa system and notice that the steps that were listed earlier in the case has been considerably reduced?
Example : Earlier there were steps listed till I-140 completion; but now I see that the steps are listed only till PERM filing (nothing mentioned about I-140).

Hi All,

I just wanted to share some feedback or my experience on PERM. Hopefully this might help some of the colleagues.

I joined Cognizant some 2+ years back as a SA (with 4+ years completed on H1). As usual, I was informed that GC will be initiated after 12 months of joining Cognizant (during Interview). Yes, they were correct - The Internal Application let me initiate my GC request after 12 months of joining date. But, then comes the point - My GC request gets into the internal GC queue for processing. Cognizant Immigration Team have their guidelines defined - Urgent Max-Outs are first priority; Order of Document submission is next priority. They are very clear on this; no matter how high you reach to get your's done first. You can reach out to D+ level; escalate; resign; raise GSDs or do anything you want.. Nothing would work - When it is your turn, yours will get done. Coming back to mine - I raised many GSDs; escalated to GSD management; reached out to my management. Nothing worked - received the standard response. Since my max-out is Dec 2017, my case was picked up; processed and filed during Nov 2016. One thing that I have seen and very confident is the PERM will be definitely filed 365 days prior to your max-out or even earlier (provided you are waiting in the internal GC queue for quite sometime). If you are some one who joined recently and in a state of urgent max-out, probably they will work it out as an exceptional case. But other than that, you will get filed say like approximately 13-15 months prior to your max-out.

Also, you will have no clue if your file has got into the pre-perm steps (like PWD; Advertising etc). To be honest, at one point, I stopped reaching out and started looking at other options that I can proceed with after December 2016. But all of a sudden got an email saying that PERM has been filed and this is my PD.

I completely understand the pressure that will be within us to get our PERM filed and GC done (based on some political changes/personal reasons etc), but no matter what they are - Immigration Team work on their defined guidelines and will get your request filed based on the order they follow. So, all I can say is submit the request and wait patiently till it is done. Maybe, for a self satisfaction, reach out to the Immigration Team every 3 months, so that you can be sure that your request is in their list (which would not even be necessary, as they have their own alerting mechanism, which alerts them periodically based on your processing dates in myVisa).

Hi, A quick qn - My Employer's Immigration Team takes care of filing the GC (PERM; I140 etc) for all it's employees. I am sure that they have not filed my PERM request; but not sure if they are currently working on pre-processing steps towards filing the PERM request (like PWD; Advertising etc). Is there any way for me to check on icert or any other websites whether there are any PWD/Adv done by my employer? Atleast that could let me know whether they are working towards filing my PERM. I understand that you need to have reference# to track down; but just trying getting an assumption based on other pointers (like Job Description/Responsibilities; State; Employer; Job Position etc).

I hope after switching to CTS, your PERM approval with current employer would not matter. You will need to start the same PERM process over again with CTS, when you start your GC process here. Below response is purely my opinion/suggestion, based on my experience.

1) With still 2.5 years left in my H1 B, should I take up the direct hire opportunity with CTS ? I would suggest no, as you will have PERM approved with current employer and you can proceed with I-140 which would take another 3 months for it's approval. Switching post I140 approval sounds to me a more better option. Below is also a reason.
2) And If I do so, when will they start the PERM process ? For SA, the policy states you can start after 365 days of your employment date. This means you can initiate a request in CTS System. When they file your PERM depends on your position in the queue and your Max-Out date. In my case, I joined CTS with almost 3 years left to Max-Out and initiated GC request after 1 year of my join date. Request has been pending with CTS GC Team for a year. I still have 1 year left to Max-out and CTS has not yet filed my PERM. They state that I am in queue and will be processed as per the queue (though they don't give you even tentative date when that would happen). I am forced to patiently wait, as I have no other option at this point - with 1 year left to max-out. There is nothing that my managers could do about this. If I max-out before my PERM/I140 approval, CTS GC Team has no response/options on this.
3) What are the bench policies for lateral hires ? It is case by case dependent on your Manager and the stream you are in. I have seen guys in bench for 1 month and 3-4 months. I would take it as maximum 1 month is safe.

Friends, I am working in an MNC and my Employer's Immigration Team is taking care of processing the GC request for it's eligible employees. They haven't filed my PERM request yet. But they are communicating like they are in the process of completing the requirements as per DOL regulations for the upcoming PERM cycle. I believe that to be the preparation stages (like PWD or Recruitment stages); though not sure. Is there any way/possibility for me to check and confirm if they have initiated any of those prep works in my case? Like checking in the USDOL website if any request has been filed by my employer recently and it's statuses. I understand that it is not possible to identify the request exactly as they will not have name and other employee specific information. Just trying to see if there are any options that would help me to figure it out roughly (based on state; position; roles/responsibilities; description etc). Any other suggestions are also welcome.
