I’m glad things are working out for you and you have a solid backup plan as well. Canada is also a great country for highly skilled engineers like you. But unfortunately there may not be as many job opportunities as there are in the US, and not everyone might be able to move out of the states after graduation.

Actually I think NSC has been more predictable in terms of approval. I wouldn't necessarily panic over a few denials, which are most probably due to the confusion of a single officer regarding the pre-dhanasar cases. TSC has been more tough about NIW cases and has issued more RFE and denials especially for pre-dhanasar cases.

So, let's all be cool about this. To those who have been affected by these unfortunate decisions of a single officer, please let us know here if you need any help from us, seriously! I personally would be more than happy to help, instead of just nagging about something that has been done and cannot be undone. Let's all be positive and try to fix the issue.

If you use your EAD, your non-immigrant status is automatically terminated once I-485 is denied and you'll be out of status. If you don't use EAD, you can remain in your non-immigrant status until it's valid, but you almost do not have any chance for extending it.

If I remember correctly, you mentioned that you have also applied for I-485 AOS. If that's the case, I doubt you would be able to extend OPT.

I think it will, but I’m not entirely sure. Your lawyer should know that. I think since you can do premium processing for EB1B, this would be your best option.

It could be! At least this is what this particular officer thinks! Looks like both cases that we’ve seen getting denied by this officer are pre-Dhanaser cases that got RFE.

With these credentials, just go ahead and re-submit through EB1B. This is most probably because you already have a full-time job (which btw doesn't make sense at all).

You seem to have very good credentials. What is happening these days does not make any sense to me. Maybe they are sensitive to those having an employer now and may qualify for regular EB2 through labor certificate?!! Still very strange...

3) Is your current job related to your PhD research? (I guess it should be since you're in academia now)

They may send email and/or text notification if you have it set up through your USCIS account. I did receive notifications for my I-765 applications. But some others didn't. So, it is not really that reliable.

How is the "national interest" related to the degree??!! When the scope is limited to the company, I agree that the endeavor is not "necessarily" in the national interest. But depending on what the company does, it may very well be! Such as cyber security companies, or renewable energy industries!

It totally depends on the subject of research activity. The thing that you mentioned about the endeavor not being in national interest can also happen for someone who holds a PhD, but works in a company with limited scope! So, it is irrelevant to the "degree".
