Topic: Will H1B fall under its own weight?

H4-EADs are replacing H1B at this time. I work for a large Healthcare related company with less than 5% H1B. For obvious reasons if a questions comes between H4EAD or H1B, we go with H4EAD as no H1B or GC fees to pay.

h4 ead replacing h1b means, you hire a h4 ead to fire h1b. If h4 ead is preferred over h1b , its not replacement

Topic: Parents of future Greencard holder or Citizens

How come there is no discussion or concerns that future green card holders or citizens will be unable to bring their parents in states because Trump administration is trying to limiting family sponsorships to spouses and minor children only. I am completely fine if extended family member like siblings, cousin are not allowed but blocking parents should be protested by us.

Please send email to your senators regarding this.

Thanks!

Because almost all citizens and gc holders have already brought their parents n siblings into the country and they do not want anyone else to bring.

Topic: Travel abroad after applying H4 EAD

Can the beneficiary travel abroad while H4 EAD application is pending?
if yes, Can the applicant travel once applied H4 EAD or need to wait until get the receipt #?

You need to be in H4-status to be eligible for employment authorization, meaning you need to be physically present in the USA. You may leave the country anytime when the application is in progress but if the USCIS officer verifies your application when you are not in the country, your application may get denied as you will not be in H4-status.

There are cases where people exited after applying, reentered while the petition was still under progress and got their petitions approved.

https://www.uscis.gov/working-united-states/temp...

3. Do I need to be in the United States to apply for employment authorization based on my H-4 status?
Yes, you must be in the United States to apply for employment authorization. You must be in H-4 status to be eligible for employment authorization, and an individual outside of the United States cannot be in H-4 status.

Topic: H4-H1b

Thanks. My husband joined new company and his h1 transfer rejected while I was working on H4 EAD and waiting for my employer to complete my H1 formalities. I have RFE on my H1 transfer I have h1 from another employer

Hi,
Your spouse started working for Employer A with H1 receipt notice. His lawful presence depends on the status of the transfer petition to the employer A.
Your H4 status fully dependent on his H1 status. If his H1B transfer is denied, he does not have H1B from the day of denial and I am afraid you do not have H4 status as well.

Now regarding your H1 transfer, You had H1 from employer ABC. Then joined ABB with H4 EAD and ABB is trying to user your old H1B to hire you on H1B. ABB is petitioning for changing your status from H4 to H1. He is using your old H1B from ABC to exempt you from annual H1 quota. But your case is H4 to H1 change of status and not an H1 transfer.
You may leave the USA during a petition is pending with USCIS and inform address change with USCIS. You will need to wait for a decision to be made and go for visa interview once your H1 petition is approved to reenter USA.
If it is a regular H1 transfer, you could work with the transfer receipt notice and stay in the USA until decision is made on the H1 transfer.

Please consult an immigration attorney to explore your options

Topic: H4-H1b

Hello I was working on H4 EAD and my employer filed for my transfer...as my husband transfer went to rfe we were waiting for decision.he is out of US for now and his h1 transfer today was rejected..not sure my options are.. I am working with my layers on it early they mention I can stay till my h1 decision is pending but I can’t work

Hi,
One can wait & work in the USA legally until a decision is made on H1B transfer, the person is just changing the Employer from A to B while he is on H1B status.
But I believe your case is H4 to H1B change of status [ and it is not a H1 transfer as you are on H4, just you will not be counted on yearly cap]. You can stay in the USA as long as your spouse H1 status is valid/active.

Now when you say his H1 transfer is denied, If he is still working for the old employer with whom you/him have a future i94 expiry date, then you are good to stay and work with your EAD. He can travel back to the USA with the previous valid visa.

If he had started working for the new employer with the H1 transfer receipt notice and the previous employer terminated his H1B , then I believe your options to stay are less or none. If this is your case , please consult an immigration attorney.

hello i have one question

my husband's H1 transfer denied and he left country. I was working H4EAD while my H1 transfer is pending with RFE reply pending.

Can I stay in country? can I still countinue to work with employer?

Are you doing H4 to H1 B change of status?
I am not understanding the part, where your husband H1 transfer denied and he left the country but you are still continuing to work on H4 EAD. H4 is tied to H1 B, how can you still maintain H4 status if your spouse H1 is denied?

Docs like this can sometimes be submitted if signed by a Notary Public.

Normally it’s for letters though, so just get the email redone as a letter and then Notarized.

who the hell are you man? you are talking bullshit in each and every thread...
How can you say something even before knowing what email OP is talking about?
and in which part of the world Notary public sign an email copy?

Topic: Infosys GC 2017

Why would H4 EAD need GC application? If Infosys is doing that, they should stop it IMO so that other visa holders better chance.
As far the latest information I received, Infy is not going to hire H4 EAD for now. I think they will wait for the final word on that from DHS.

Why do you think H4 EAD does not need a GC application? In your opinion which visa holders deserver GC?
If you are from India and having priority date > 2009 , you should know by now that GC applications are just to keep extending H1 Visa and not to get permanent status.

Topic: Should I report this?

I am in a non-IT field and not aware of the inner workings of the IT industry as it pertains to recruitment with fake resumes. Just out of curiousity if somone gets hired with faking their expereince and skills on a resume, how does that person perform their job ? Wouldn't they be exposed in a matter of days ? How do they continue to survive and thrive?

It depends on how critical the project is and how tolerant the people in the project are. 99 % of the cases, the project members and manager can easily identify the fake candidates. But whether they want to keep him/her depends on the performance of the candidate in the project.
Some may be smart to learn quick and sustain. Some may be be stupid to get kicked out in couple of months. But again it depends on how the person entered the project. If he/she was referred by someone having influence in the Organization/Project, he/she may stay longer then you expect... :)

Topic: Role changed in Visa extension, will it impact I140

I'm a Project Manager with big 4, when it was time for my visa extension, my management offered me to assign me to Tech Arch role to fix my salary (another story, had a drop earlier). I took it despite feeling this could impact elsewhere in the visa, GC process. Now I have an approved I140, and I just stumbled upon another thread like this saying we have to redo perm and I140 process if there is a change in role. I'm just terrified of the thought of redoing anything visa or GC related with all the challenges recently. Can anyone confirm, have I caused myself damage by filing a Tech Arch role in the extension instead of the Project Manager which I have been using for all Visa purposes in last 5 years and also my Perm and I140.

Thanks for your time.

If you are working for Deloitte and having a role >= PM, Deloitte will do GC in EB2 and if you have to take any role < PM while working with them, Deloitte will redo GC in EB3 even if your previous EB2 I 140 is approved. This is Deloitte Policy.

In general regarding redoing the PERM, if your new position holds all responsibilities of the previous role + additional responsibilities for the new role, you may not need to redo the PERM. If the new role is entirely different role from your previous role, then you need to redo the process

Trump wants skilled ppl .... ppl from African countries are generally not skilled due to lower development in those countries

really? that's interesting.... you don't smell racism here ? then Trump should create Skill level visas under refugees and Temporary Protections and allow only high skilled. I can assume all Trump supporters in this forum are either selfish pigs or stupids.
You talk all BullSh*T to support that you have every right to get a green card and no one else in this country.

May be but I like his merit based immigration push to move toward a system similar to system used by Canada and Australia.if Trump does even HR392 then given a chance I will forever vote for GOP without question.

:) No worries, you will never get a chance to vote as we all will die before our priority dates become current.

Topic: Should I report this?

Someone that was recently hired by a team that I know closely and work with has deceived his/her way in the team by doctoring his/her resume. This person has never directly worked for the prestigious US companies which are listed on his/her resume. In the resume, the person has deceitfully worded working for these US companies in such a way that it is hard to find out that they were actually the clients of the body shopping company(2 of which are from WITHCES) that he/she worked for. The deception is so obvious if you look at his/her resume carefully.

The hiring manager(also an Indian) who knew this person from a previous work setting conveniently decided to ignore all of this and brought him/her on board(obviously).

I have access to the actual resume and the email that this person sent to the hiring manager. In the email this person summarized his/her top competencies which included false statements about working directly for the US companies..this time without even playing with the words..just simply lied.

I am planning to report this to :
1) Company's internal ethics and compliance(anonymously so that I don't get in trouble).
2) Possibly to USCIS

What do you guys think?? please let me know..

If I understood your comment correctly, the person have listed the client names he has worked for in his resume. But you may need check if he had listed the clients under projects or under employers. If he had just listed them under projects then I do not see any foul play.
Again, you do not select a candidate based on whom he worked for instead you pick him based on what he worked. Assuming the candidates project experiences are genuine, I don't understand why you think he is not a deserving candidate.

Topic: H.R. 392, Fairness for High Skilled Immigrants Act

There is nothing absurd about the country quota. The queue is proving that it is needed. Otherwise nobody but India/ China would every get a green card. And the queue will not decrease because of this law. Maybe temporaly but there will be new line in a few Years. And what's next? Only allowing India/ China to get a GreenCard?
We would need really strict H1B Rules only allowing the best of the best to join and than this Problem with the long line will be gone for ever.

Really? there is nothing absurd about the country quota on employment based green card? Why not USCIS stop accepting the green card petitions for EB2 / EB3 from India and China, knowing that they are not going to issue a visa in next 40 years for the new applicants? probably most of them will die before filling I 485

And how do you define the best of the best? who are the best according to you?

Add her as an authorized user to your credit card and Use 10% of the credit limit on the authorized user card.

Register in creditkarma.com to check your score [ lets say after 6 months]

Apply for capital one quick silver once you build a history....the credit limit might be lower but you may be qualified for an un secured credit card.

Note : Do not open a secured credit card as it will be difficult to get the annual credit fee waived later once you build your history and you may end up paying it every year. Cancelling the card also impact your score as it being your first credit card.

add your case to the profile
you would see "submit a case query" at the bottom of your case status.
use it to raise an SR, not sure if it will help in expediting the case but at least you will know where your petition stands

Topic: Is it legal to stay in USA after completing of 6 years H1b

Hello- My I 140 was upgraded to premium processing on Aug 18,2017. I got receipt number on August 21, 2017. My H1b is expiring on Sep 5, 2017 and my priority date is Dec 18, 2016. So there is no question of 1 year extension@(365 days rule). Below are my question.

1) I am expecting a update on my case in 2 weeks. I can stay until Sep 05, 2017(7 days more). Can I stay beyond that in USA like one week more which is Sep 10,2017.

2) If I stay in USA until Sep 10,2017 and my I 140 is approved after H1b expires. Can I applied for H1b in consular processing and work in USA?

I know I asked same question many times . I am bit confused please do reply me if you have any update brothers.

Appreciated your advice. Thanks.

1. No, You cannot stay beyond September 5th as your current I - 94 expires on that day. You need to leave the USA on or before September 5th

2. There is no legal option for you to stay on H1 B in the USA beyond 5th of September as you have maxed out your H1 days. Staying longer could cause more trouble legally.

Good to know that you are interviewed for multiple positions.. do you say the recruiter that you would join only after the H1B is approved or you are ready to join with just receipt notice?

Do you mind sharing the employers information, who are interested in H1B, it would be helpful to fellow mates in this group?

To add a note about the number of H1b s approved from India in the chart released, remember it number of approved cases, extensions, fresh h1s, transfers etc. Considering the H1B crowd in the USA, this seems to be a normal number
