Let me bet my bottom dollar on this (not sure which universe you guys reside on).

HR392 will never see light. it has no chance at all. Just ask yourselves...What's incentive congress has to dole out so many green cards. Don't they already have enough Indians here.

And if they are concerned about talented ones leaving, they know they are easily porting to EB1 (data does not lie).

So absolutely zero incentive for congress to vote on HR392. Kevin Yoder has his own agenda and don't get fooled/hopes high on how many co-sponsors this bill has.



you mean only EB1 folks are talented?? rest all are garbage? may be you have ported to EB1 so now you think others are useless!! you are such a selfish guy. now you wish, HR392 should die. Keep your bottom dollar with you. It will be helpful when you become beggar after getting GC from EB1..

Agree with lisaanderson. you can came back to USA anytime as you have I140 approved. You won't need to go through lottery process. You just need to find an employer who can sponsor your H1b.

as per my experience, H4 stamping is straight forward. not many questions. My wife and kid got it last week. I did not travel with them. VO generally ask 2-3 questions about h1b candidate. but nothing to worry. I have seen many cases where H4 stamping was smooth. make sure to send all your docs with them.. mainly employment letter, your 797 copy, your passport copy where you have h1b stamped.

I am planning to visit India after 2 weeks. My family went to India few days ago and they are done with H4 visa stamping. When I go for H1b stamping and if I get RFE/admin process, can my family travel back to usa while my H1b stamping is still pending?

I got my H1b amendment approval today. Receipt date Oct 14, 2016. Approved date March 07, 2017. Vermont center. No change in dates. validity is until Aug 2019. same like original H1b approval.

First a caveat: I am not eb1c, I am not eb2, I am not even in IT. I'm a medical researcher . I already have my green card. So what I am writing here is my neutral non biased observation.

If you think Sessions cannot do the things that are mentioned in the Politico article, and if you think he cannot cancel your visas, all H1B visas if it suits his fancy, you just wait and see. He can ABSOLUTELY do these things. All of you going all outrage on eb1c abuse etc etc, mark my words that ALL visa holders are in imminent danger. Those of you who are writing emails messages tweets to Sessions Trimp etc., when they start on what they want to do, they will come for ALL of you. Those who think the nice company FT employees are safe, and only eb1cs will be eliminated, well you guys are NOT safe. By highlighting whatever is it the eb1c abuse you think is happening, they are gonna shut down ALL of it. They are going to vastly reduce the number of green cards they give out. So mark my words today.



dude, if you have GC then why the hell you are spending time on trackitt?? enjoy holidays and live the life.. and nobody is interested in your 'non biased observation'. Just keep it with you. your observation is like, let Trump/Sessions kick out others because I already got my GC??

I live in NJ so there won't be relocation but agree that i will need to spend more money on commute. and may be tax also differ based on NY location. at present I am more concerned about GC process. I understand it is all about taking risk for good but it is hell confusing while taking decisions.. specifically after family responsibility etc..

12 to 18 months to initiate GC process is long time!! and it may take 1+ yr to get I140 approved after they initiate GC. At present, HR is saying they will consider me as exception and start my GC in 3 months. Not sure how much we can trust. taking full time is always confusion due to this messed up immigration system..

Friends, I got an offer from CapGemini for NYC location. I am on H1b. My Priority date is Jan-2011. I am very confused whether I should take it or not. Salary difference is around 15k. 110k vs 125k.

Anyone has experience how they handle H1b cases? mainly GC process. After waiting these many years, now it is tough to take decision. Please share your experience/suggestion.

Dont get excited guys. This federal register stuff that we are having in forum is for I140 EAD with the infamous CC (Compelling Circumstances) clause.
Even if USCIS passes this rule it will be WITH CC clause. So no point in discussing. Please read that Federal Register link carefully.



But that is originally published rule right?? USCIS is still reviewing 27k comments and may make some changes

I know, we could have crossed 50-60K comments. I circulated mailers to group of friends.. with samples comments, steps... 90% of them were like.. in lost world, don't know what the rule is... that is different thing that whenever they meet they cry about backlog... but... they were too busy that didn't comment at all.... upon follow-up with some of the guys.. few m**f***s are like "Yaar wo tumhara rule waala comment pending hai..."... I am like "saale m***ch*d... mera rule".... ye to wahi baat ho gai... ki unka baap baitha hai USCIS main aur to sofarish ka letter likh rahe hain mere liye... height hai yaar!
Baad main samjhate hain... "yaar ye comment/vomment kerne se kuch nahin hota... 10 saal hain hum yahan, sab dekh rahe hain.. aaj bhi backlog hai"... I am like.. "In 10 saal kuch ker liya hota to backlog nahin hota guru..".

Anyways.. I tried my best to put ass many as varied comments (by all defaulter's names.. you know who)...



I couldn't agree more with you!! I also have same feeling like you for many of my friends. They all talk about backlog and problems. But none of them put a single comment. I was regularly searching for their comments. I gave them ready templates and everything. They don't have time to write comment.. forget about donating to IV or visiting congressman or sending letters..
I also realized that they do nothing because they know folks like us are working hard.. so they are like, you contribute money, put your efforts and once rule will be approved, we are ready to reap benefits..

Comments received till now are only 17,026.

Please start with "I reject this proposal".Please do not write lengthy explanation,People do not have time to read every thing Just be very brief and request all friends/groups/FB/Whatspp etc... all social Media friends...

1) avoid refilling of PERM/I140 if we change the employers.
2) provide advance parole option.


The pathetic thing is I could not even convince my highly intelligent colleagues/classmates to put comments,I know they will be first in queue to utilize the 140-ead if any faour done by US govt) .
Please please Please put comments....Hope you guys understand...



I am 100% agree with you.. I am keep telling my friends who are stuck badly.. but they are not willing to put comments.. It is not like they do not care.. they do care about this fix but they just do not want to write comment..

I realized that many of them are not getting time to do it.. they are not setting priority for this task.. These group of people are feeling relaxed because they know few of their friends are working day and night to write comments and also contributing money to IV, sending mails/emails/tweet etc.. so they are ready to reap the benefits and doing nothing..

few of them may be worried putting their name on regulation site..

few of them are pessimistic and thinking nothing will happen..

and few of them are just selfish.. thinking my dates will be anyway current soon.. and my wife got H4 EAD so why to encourage such fix..

and agree with you that they will be the first to utilize the benefit.. i have seen it during H4 EAD regulation as well..

I have observed that it takes 2-3 business days. It will certainly appear as long as it is not copy/pasted completely..

I agree with you.. there are so many H1b candidates not even aware about this rule. I know there are few aware about published rule but do not know what it contains. they are feeling happy that something is done.. now we will get EAD if we have approved I-140!! Seriously!! There are few candidates know everything.. suffering.. but do not do anything.. they just watch others efforts and feel relaxed.. They think some people are working hard so it will happen.. and we all will get benefits!!

I sent lots of emails to my friends explaining everything. I request you all to spread words. this is our last chance. lets flood the comments.. lets do whatever we can.. like calling/meeting congressman, following IV's actions, donating to IV for lobbying, sending letters..

I was reading few comments posted on regulations.gov for 1615-AC05. I saw many comments opposing this rule. few comments from 'We the people' group and few others from some individual. All negative comments are with American names.. I think we all need to step up our game. I know proposed rule is very disappointing.. Many of us lost hope.. but this is last chance.. lets spread the word and write comments in big number..
