Dear Congressman xxx,
I am writing this letter to request your help in the timely adjudication of the inordinately delayed I-485 petition for adjustment of status to permanent resident. My I-485 petition has been pending with the U.S. Citizenship and Immigration Services since date.
My husband, his name, started working for his company after graduating with an degree in major. He applied for Employment based Green Card Petition (I-485) second preference (EB2 Category) in date for himself and for me simultaneously at USCIS, xxx Service Center. His I-485 was approved on date; however, my case of I-485 still has been pending with a current priority date since and well outside the normal processing time as of date.
During this time I have made several attempts to contact USCIS to get an update on my case status. So far I have opened four service requests within the last 12 months. I also have requested USCIS Ombudsman (Form DHS 7001) office to follow up on my case. I have written to both State Senators names. Yet I have not received any response to any of my inquiries. I also made a USCIS InfoPass appointment to talk with an immigration officer, but I couldn't get any useful update on my case other than that the FBI name check was still pending.
I was called for a 2nd fingerprinting on date after my 1st fingerprint passed the 15-month duration. Until today, I have not received any update from USCIS. I called the Service Center last week and was told my case was still pending due to the FBI name check. The case of I-485 has been pending for more than two years and everything is cleared and prepared except for the FBI name check. Last April, USCIS issued a memorandum on its policy change regarding name checks. As per the Revised Guidance (Revised National Security Adjudication and Reporting Requirements), where the application is otherwise approvable and the FBI name check request has been pending for more than 180 days, the adjudicator shall approve the I-485 petition and proceed with card issuance.
I am a citizen of country and have been living in the United States since date. I obtained an an degree in major from school in date and have been working full time on H1b work visa and paying taxes honestly for over xx years. I am eagerly waiting for the green card so that we can firmly establish our family here in the US. This delay in I-485 petition is making our life very unstable and restless. Again, I and my family ask you to provide any help to expedite the processing of my I-485 petition under the new adjudication requirements or at least determine the status of my green card. The only hope we have is your help.

After reading this thread, I contacted the congressman in my district last Thursday. Got a letter yesterday saying they received my request and waiting for feedback from USCIS at TSC. I received a phone call from the congressman's office this morning. The lady needed my husband's I-140 and I-485 receipt numbers to prove I am a dependent. I emailed her immediately with my husband receipt numbers. She said I might get a feedback in 1 week. My husband got his Green Card almost two years ago and we applied at the same time; my I-485 case however is still pending without any LUDs since last July. I know I can't sit around and do nothing any more. The waiting is driving me nuts. Got my second FP done last month. Hopefully the news of USCIS and FBI Name check backlog clearance today would expedite the I-485 approvals. | |  |  |

Unfortunately, my case is not yet approved. I had 2nd FP done on 2/17 and so far no soft and/or hard LUD. Called FBI last week and confirmed that they sent back the FP result the same day. Called TSC, IO refused to check the FBI screen. | |  |  |

There is NO LUD after my 2nd FP on 2/17, too. Just called Texas Service Center this morning, the IO didn't give me any useful answer. She said she can't go to the FBI screen to check if FBI sent back the result. I am worried it'd be lost in the black hole.
Just called FBI at 304-625-5590. They received the FP on the same day and sent back to USCIS the next day! It confirms my anxiousness even more!! | |  |  |

Topic: Will your spouse get the GC at the same time?
I'd like to say so but it is not always the case. My husband, the primary applicant, got his GC last June, but mine is still pending. Same thing happens to another friend of ours. Yet I have seen many cases whose spouses got GC almost the same time. Don't lose your faith and good luck! | |  |  |

My hubby's case (primary) has been approved last June, but mine is still pending. Went to Infopsss last month, IO told me I was stuck in NC. I believe I pass all criteria for the memo, hopefully TSC will soon approve my case. | |  |  |

Topic: I am expecting GC soon list
I believe I pass each and every single condition.
1- You have passed your LC. You have to be sure. (My husband is the primary applicant, who received GC in June, 2007. It meant he's passed LC, I-140.)
2- You have to have got your I-140. Again no guess or if and but. (Same as above)
3- You have successfully finished your medical test. (Yes, in Dec. 2006)
4- You have done your FP. If it is expired, that is OK (Yes, in March 2007, called FBI last month, an officer confirmed my FP was approved on the same day I did.)
5- Your PD is definitley current based on March VB. Not even a day less. (Yes, USCIS received my application on 3/1/2007 and no LUD ever since.)
6- You have a written document or you are 100% sure that your NC is done. (If your neighbor or your friend says so, it is not acceptable!!). (Yes, my NC is DEFINITELY pending after an appointment with InfoPass this morning. However the IO in Newark had no clue about the new rule for FBI name check pending for 180 days. She sent an request to TSC anyway.)

I called USCIS yesterday and asked again if my name check is clear. The lady said she can't see my case. I specifically asked her if she is in Texas Service Center, she said no, and told me to wait for another 45 days since I called late December and a request had been sent to the service center.
How did you know your phone call got transferred? It seems some IOs are more helpful than others. I called twice by following the 1-800 calling steps and the answers I got were the same. | |  |  |

I believed I was directed to TSC because I followed exactly the option 4-3-my status. I asked the IO about my name check and she didn't know if it was cleared. Since my application filed in March 2006, I only got one soft LUD in May. It's been such a long wait! | |  |  |

How did you know you spoke to an IO at TSC? Is it because you enter your receipt number? If so, I've been transferred to TSC but the IO didn't tell me anything. I asked her if my name check got cleared and she had no idea about it. She only said she would send an request for my case and if I didn't get any updates after 60 days, call them again. My wife's case is still pending. She called USCIS in Dec. and didn't get any updates so far. Both of us are from Taiwan and she works full-time after receiving her MBA in the US. Maybe I am wrong, it seems to me that the spouses who work full-time takes longer to get their cards than those who are unemployed. One of my friend's wife is going through the same situation as my wife. The husband got his card in mid 2006 and yet the wife's (wife works full-time in a Big 4 CPA firm) case is still pending. They've contacted the USCIS and no help!!
Does anyone have the same situation? How long for the spouse to get his/her card after the primary applicant's case has been approved? | |  |  |

Topic: Approved I140 without LUD
My situation is even weirder. I already got both emailed and mailed approval for my I-485 and received the Green Card late last month, but my I-140 still shows received and pending (no email, letters whatsoever). My lawyer and all people I asked told me not to worry since USCIS approves I-485 after I-140 gets approved.
