Topic: EAD for i140

No!
With the Ds and most Rs worried about the dreamers, and with the rest of the Rs not being fans of "color" you cannot expect any relief unless it is part of the larger immigration package. Why do you think an administration that has recently made H-1b extensions harder, increased RFEs exponentially (ok, the exponent is 1) do anything to help us?

Raise Act is anti immigration act designed to curb Hispanic immigration.

You claim to have deep connections, but his name is Orrin Hatch, and the word is "revoked".

@OP : Let's hope there is some movement on that front - this administration is going after immigrants at all levels, that at some point, it will win, and hurt some/lot of us.

No, HR 392 is about fairness, treating two people in the same situation the same without regard to their country of birth. Your rant is based on jealously.

Do you know the spirit of the law? Do you know exactly what Congress intended in 1990? Regulations are created by the executive branch, in this case USCIS and DHS to enforce the spirit of the law. Your opposition is simply due to jealousy and it is getting old.

Before we sink into insults - the fact that ROW EB2 and EB3 are current ensures that the number of Indian visas will be > 2804. Because any unused visa from ROW EB2/3 goes to Retrogressed EB2/3.

Few reasons :
1. It does not help our cause by feeding the narrative that immigrants are fraudsters.
2. EB1C is not a scam - USCIS has repeatedly evaluated what being a manager means, and what function, role in the
company/department etc mean.

While the rule may sound ridiculous, that a team lead with a title of manager working for TCS can transfer to the US on a L1A and have a green card in 6 months, it is not their fault that the law and the rules have not kept pace with 20th century corporate structure (yes i said 20th century). When they wrote the bill, they must have imagined Narayan Murthy getting a Green Card through EB1C - but laws are applied as written - if you supervise people or lead a function in a foreign country and are transferred to the US, you are an international manager.
I wish i was eligible for this - but, we need to stop complaining about this. It's like complaining about the rain, you can complain all you want, it's not gonna help you.
Move on!! May be marry an American, or transfer to India for a year and go the EB1c route

While it may appear that the government functions on twitter, thanks to the man atop - twitter isn't going help us. Our only hope is change of policy/reform etc.

Topic: DACA/HR 392 are DOA, what comes next is ...

You guys are so dense.
EB1C is not a scam - USCIS has repeatedly ruled in AAO how it interprets international managers, what functions mean etc.
It is a stupid interpretation that can lead to someone leading a team of 5 developers in Mumbai to transfer to US and get a green card almost instantly - however, those are the rules - we gain nothing by being envious of their good fortune.

Topic: H.R. 392, Fairness for High Skilled Immigrants Act

Yes they might be credit hungry, and i know they misrepresent facts to improve their standing among us :
1. Intervention in Save Jobs USA case is one example.
2. The recent I140 based extension fiasco is another.

But the fact is, they have smartly realized a few things :
1. HR 392 solves a lot of problems the community faces.
2. The only way to pass it would be for it to be part of another legislation as they have rightly figured out that the congress does
not have the stomach for real immigration reform. Even if the GOP were to get to 60 seats in the senate, the GOP is a
complex party of a varied set of ideologies - all the way from free market moderates to KKK sympathizers. It may not be
possible to build consensus on a bill. Plus they will rather use their political capital to work on issues they have consensus
on - entitlement reform, increased military spending etc.
3. DACA is popular among Americans, and it is the most logical vehicle to the passage of this bill. But, there has to be a reason to include this to DACA (hence the suggestion for the $1000 fee - it may not work, but it sure doesn't hurt the cause)- nobody, i repeat nobody really cares about fairness towards us - remember, previous immigration legislation specifically excluded Indians and other Asians. We were described as "The most undesirable of the Asiatics". You know the original purpose of the Diversity Lottery was to engineer a way to ensure that there was a pathway for Irish and other Northern Europeans to immigrate to the US. I doubt anyone would do that for us.
4. Their work to sign up cosponsors (or cosponserers as Aman calls them) ensures that they bill is viewed as a non controversial piece of legislation when included into any other piece of legislation.

Now we all hate how arrogant they sound on their FB/Twitter pages etc, i do think of all the groups working on this, theirs is the best strategy - sending letters/tweeting at people will not move the needle.

You've hit the nail on the head brother - i'm just a keyboard warrior here, but i can't for the life of me figure out the hate IV gets - their members seem serious about the cause and are working hard. They may fail, and we can do a postmortem to decide why. The thing is the odds are so long that there may be no good options. It's like we just lost the 9th wicket, need 12 runs in 3 balls and IV is the last batsman. If we win it's fine, but if we don't we can't blame IV.

Topic: Feedback on IV call

The Ds would clear HR392 if it comes to the floor - on the House Committee where this bill is languishing, almost every D has supported this bill. Infact when there was a hearing on HR170, Zoe Lofgren (D) tried to push this bill through.
The problem is if you are not from India, Mexico, Philippines, or China - the immigration system is working perfectly. The only flaw is illegal immigration and therefore all the focus will be on fixing that aspect of it. We become an after thought.

Topic: Feedback on IV call

I don't understand why hating in IV is such a big part of this forum - while they are far from perfect, they are just a group of people. Far stronger lobbies have failed to achieve anything. I don't think IV's work has hurt immigrants, it may not have helped, but they are trying. I think they tend to oversimplify, over exaggerate, and engage in fear mongering - but i believe it is necessary to make sure the community stays focused.
Now HR392 may never see the light of the day, but their efforts ensure it is a topic, and it is a consideration when negotiations happen. And this may result in some other form of relief - it could be temp gcs, or eads/aps, or whatever.

I hope they post it.
I don't think HR392 gets done outside of a DACA deal, and that too to fund some aspect of the overall bill - neither Ds nor Rs have any motivation to fiddle with EB. IV realizes that, and their whole $1000 gambit is smart
