Interview Status:clearedInterview Experience:my Interview at the local Boston immigration office went well it lasted about one hour started a bit late about 8.25 am in place of 8.00 am both me and my wife were called in together.we took our son ( US citizen) along with us, our ISO officer was polite and friendly and was ok with the fact that we brought our son.she first asked us to sworn in then asked for ID we gave in our driver license. she could not find the form that we were to sign that we did not got the lawyers with us.so she said never mind just write in piece of blank paper that our lawyers are not here and we are ok to fact that she is interviewing us.she asked all the questions on form I -485 for whihc we said no....then was looking for the approved I-140 in the file that she had for us.she could not find that in the paperwork i then offered to give her my copy so I gave her my copy of approved I-140 and then she pulled the record from the computer after taking my copy.then she took a printout of my I-140 status from the computer and put in the file along with the photoopy that I had given to her. She took the EVL from me and my wife . she did not asked us to show anything else.not even our passports all the time she was in the mood to give us the green card .She went to her supervisor to check if she can issue visa She came back and said the your PD is not current so she is sorry she cannot issue us the green card.I then asked her if our paperwork is in order and if our background checks are all cleared etc She said its all clear for both of you you are fine.and she does not need anything from us .she said just keeping filling for EAD and APÃ.and keep a eye on the visa bulletin.she said USSICS may call for another finger printing if the dates are not current and 15 months pass waybut she reminded us to renew our EAD / AP and hold on there then she escorted us back and told she is very sorry she could not issue us green card.she also said when we see that the dates are current for we should take a info pass appointment to keep a check on the progress.in all the documents she took was EVL for me and my wife, my I-140 copy.USCIS memorandum on July 2007 visa fiasco to show to her super wiser Bottom line is that she did not asked for any new documentation, did not issue any RFE and verbally told us that USCIS will hold my application in abeyance until a visa number becomes available. they took the original appointment letter.I assume that is the standard process.

Topic: Form N-400 part 12 Question 23 and part 8 section help needed

q1. do i need to check box yes for part 12 question no 23 if i was given a written police citation with warning box checked for not able to stop fully on a stop sign this happened this year ( with in 5 years )

q2 do i need to check box yes for part 12 question no 23 if i was given a written citation for driving at 45 on 30 miles speed limit posted roa, in case on the citation the civil infractions box was checked with no amount listed (this did not happen in last 5 year ) it was dismissed by DMV as there was no amount to be paid when i called DMV to pay the fine.

q3. what should i write as address when I was working for employer A as a contract employee at their client location ( employer B) then joined client( Employer B) later on as full time for employer B . since the work location address was same for both employer A and B ( ie my work location ) should I mention the same address of work location when i have to mention all employers in last five year for both employer A and than B .....please note that my pay stubs from Employer A just list their po box no of their Head office that is based in different state than where i have been working. so not sure how to best represent this situation on a form

Topic: Dismissed Charges and filling for N-400 question.

Background:

in 2004 I was issued summons to appear in District Court regarding a larceny charge and shoplifting charge, The charges were dismissed upon my paying $100 in court cost and $200 in civil relief to the store. In summary I was neither arrested nor convicted of any offence and all the charges were dismissed.


In 2007, On my I-485, this above incident was mentioned with yes to the question “have you ever been arrested , cited, charged, indicted, fined or imprisoned for breaking law and all the proof were provided

and Green Card was issued without any issues.

Questions now that I need your advise.


Q1. on Form N-400 part 12 , questions 22 to 28 which questions should I be marking yes to reflect the charges that were dismissed in 2004 ?


Q2 . should I be saying yes to only the following questions and mark No to the other questions like 22, 25 , 26, 27 , 28.




23. Have you ever been arrested, cited or detained by any law enforcement officer for any reason ?​




24. Have you ever been charged with committing, attempting to commit, or assisting in committing a crime or offence ?​



Q3. What information I need fill in section 29 where I need to provide details if I said yes to any from 22 to 28.



Q4 do I need to send the same proof that I had provided when i-485 was filled along with n-400 application as well ?


Q5. Will this pose any issues to obtain citizenship ? there are no other office since than except this.


Q 6 Do I need a lawyer to file n-400 and represent me ? or can I file this application on my own keeping in mind the charges that were dismissed ?

N-400 Question


Background: working for the same company who sponsored GC, GC sponsoring company was acquired after I got the GC …..some years ago….. new company still continues to provide w2 and paystubs with old company name ….after 4 years of acquiring my original company


Q1. on Form N-400 part 8, where I need to provide where I am been working for the last 5 years should I write new company name or I can just write old company name as the w2 and paystubs still says old name ? or do I need to write the new name ? please suggest what is the best way to fill up this section in my situation.

I think you should get it today, since they are sent via USPS priority mail which is normally 2-day delivery. Please update when you get it.

as promised to all regarding updating my status....U were right my friend ! I got the actual cards today ....Just came back from Work and saw and Cards were in mail !!!

so it takes only two days after the last status update. I hope this helps others who are waiting good Luck to all of you

All:

I am also only getting SMS no emails for any status updates even though I selected both SMS and email...but it I guess really does not matter as long as the stauts says card mailed to address on file and then finally receiving it....

10/19 - First SMS for CPO, later in night another SMS of Registration as LPR
10/22- Another SMS for CPO again
10/23 - SMS for Card mailed to address on file.

Have not yet seen it in mail...will update as and when we get it....

FYI....Received CPO status on Oct 19 2012. Ported from Eb3 to Eb2 PD is 16 sept 2003, new i-140 under Eb2 was approved on 1 Oct 2012. My lawyers or me did not had a chance to even do any thing formal for interfilling as pending I-485 got approved without any push from my side or from my lawyers. it seems that there is some automatic internal USCIS process that links pending I-485 to new I-140 with old PD etc....

received actual card today June 4 th 2010. its a one year ead not sure how they decide how many years to give my last one was 2 year EAD may be they think my PD will be current by next year...or they only issue a two year when dates are Unavaliable....as 2 years agao when i had applied for EAD they were U for my PD.....or this could be as simple as we need more money next year....so we will not miss a chance to collect it from you next year as well.....

For those who are intrested to know how to renew the EAD after the interview.

I have got email today that my EAD application has been approved and Card producation has been ordered.....

so the conclusion is......you just need to apply for EAD as per the most recent instructions....it does not matter if you were interviewed at local office etc and your I -485 case is actaully now pending at the local USCIS office ....etc for the visa numbers to be made avaliable...etc....

bottom line is you apply for EAD as per the rules that USCIS has set.......it does not matter if your pending I -485 was at one service center and was then moved to national benifit center and then finally to a local office were you were interviewed etc....

Good luck to all who will some day apply for the EAD.....after the interview is over and they are now waiting for the visa numbers to be made avaliable....etc....

I have filled to the Dallas lockbox as per the most recent papaer based EAD filling instructions. ...it in other word I filled to the lockbox center as per my state of living....as per some lawyers...the filling of EAD location does not change....just because one is interviewed at a local USCIS center.... if they need to cross check with the local center about my pending I 485 .in case to determine if they acn issue me a EAD...they will ..l do it internally....I do not have to change my filling of EAD just because I was interviewed at a local center...

so this is the approach I took.....

I am waiting for the EAD now....I have receipt number and my check has been cashed......I had applied last month ....

today on May 7 2010 I got the email and SMS msg on my phone with receipt number for my paper renewal EAD application to uscis (Courier)
