Absolutely true. Immigration attorneys have an interest to keep the backlogs very long, so that they could be in the business. The increasingly more people in the backlog the more their top line growth.

I believe 140k first breaks using 40k for each EB1/2/3. A further 7% country cap is applied after that, so in other words,
0.07*40,000 = 2.8k in the new way it will be 0.07*50k = 3.5k i.e. for EB2 the increase is from 2800 to 3500.

EB4 and EB5 spills over into EB1. The EB1 backlog per inventory is roughly 50,000 (yes, i couldn't believe myself). So there is hardly going to be any spill over from there.

The only thing is horizontal spillover from EB2ROW to EB2I that will get a bit better.

that's what the bi-partisan lawmakers meeting with Trump yesterday concluded with. That is a possibility this could happen. However, from legal immigration GC backlog perspective, we need to figure out, if in case these visa numbers are unused, would they spill over to the EB categories.

For #2) My understanding because of the I140EAD regulation in place now, I140 cannot be withdrawn (barring any criminal cases against you, etc.). This means you can move back to your old employer anytime, that employer will need to redo the H1 again (cap excempt).

what I have heard is if you are out of country for 1 year, you will need to face H1B Cap. (even though your I140 is approved) Please verify.

BTW, this is very informative thread, I have been thinking on those lines as well, but got shot down due the this H1B Cap issue.

Thank you so much for your response. As you have gone through this, you might help me share your insights. I have I140 approved with 2 employers now (over the course of years i moved on). The first employer is a consulting firm (Non-Desi) and second is a full-time job in an asset management firm.

I could take up an international role with this asset management firm like I posted initially, however, please consider scenario where I take a new job outside (say in India/Singapore). When my priority date becomes current, could I come back and join back the 1st employer (consulting firm).

I am just looking at options to make career progression, as you know, we all get stuck with doing the same job over for years w/o any progression, I am just tired of it.

Please share your insights, I would really appreciate it.

Hi-
My I-140 is approved (PD March 2010 EB2I) via my employer. My firm wants me to take an overseas position in Asia for over a year (potentially extended). The location move has a great career progression, however, I don't want to loose my priority date. My current H1B expires in May 2018.

My question is, I know I could get unlimited H1B extensions based on I140 case. However, is it still true when I move out of the country and come back after say 2 years or would I have to start all over again (facing H1B cap and starting GC process all over again with existing PD).

She did get the visa in about a month or so in wait. No additional questions asked after the interview. She got an email, one fine day, that the visa has been approved and the passport could be collected.

Hi Experts:

I wanted to discuss my wife's case.
My wife was working for a US consulting company on H1B, she went to India on 2013 for vacation, during visa stamping she was given 221g and got a later refusal letter stating that the employer doesn't seem to provide employment by US laws and regulations, apparently, she was not paid during her maternal leave that had ticked the officer.
After getting 221g, she got H4 visa stamped as I have an H1B and travelled to US.

Now, she is a full-time employee of another US based company on H1B. She went to India last week for a vacation and faced H1B visa stamping. She was again given 221g. This time because of our oversight as we did not check "have you ever been refused a US Visa" check-box in DS160. When the Officer asked her during the interview about previous refusal, she told him what had happened.

I understand it is her fault to miss that in DS160 and have to face all the dire consequences, but personally, she has been a law abiding person working hard every single day. Moreover, she is a mother of a US citizen kid who needs to join back school.

Any insights on what would happen next? Please advice on if there could be anything that could be done, besides waiting for 221g.
