Topic: PERM pending H1B max out by February 20 2018 end

PERM and I-140 Pending and H1B expiring Feb 2018. Is it good idea to convert to H4 as my spouse is working on H4 or go back to india and get stamping? If converting to H4 here, will it be considered as overstay for the period until my H4 is processed/approved?

Thanks Arjun for your response , i have below questions and it is confusing when i read online posts and response

1) Will i still come under quote if i keep 1 or 2 weeks in my H1 Max out time and will it be possible to come back on H1 after PERM and I-140 is approved , my confusion is once i use all H1B i will have to apply new H1 is this correct assumption?

2) What if i come Move on H4 and come back to H1 once PERM and I-140 approved ? will i still come under quote?

I will be scheduling appointment with My attorney to discuss this , before i do i need to know the rules so he can guide me . Thanks

I will be maxing out my 6 years on Feb 20 2018 and my PERM is filed on Sep 19 2017 , I'm hoping my perm will be certified withing time frame i have I-140 after that. i need your advise and guidance on this as, My spouse is currently holding H1B

Will it be helpful to move on H4 and come back to H1B once the PERM and I-140 are certified, will i still be in quota exempt
im really confused, my current employer is suggesting to work till the last day of my current H1B validity. before i talk to any attorney i need to get an idea and then take next step further. basically i want to retain my status and when quote exempt and need to know what are my best options. Thanks

I will be max out my 6 years on H1B Feb 20 2018 and my PERM is filed on Sep 19 2017 , I'm hoping my perm will be certified within this time frame i have and I-140 after that. i need your advise and guidance on this

My spouse is currently holding H1B, and will it be helpful to move on H4 and come back to H1B once the PERM and I-140 are certified, will i still be in quota? can i come back on H1B once my perm and I-140 approve and H1B Extenstion approved?

Just an advise you cannot be working remote (out of US) and getting paid in USD , lot of of Tax implications. not sure how is your employer billing to your client and what Tax jurisdiction you will taxed.
one of my fried had same issue and later he faced some difficulty , this might cause anything for your future VISA. This is my personal advise and i'm not an expert on this matter .
I'm also on the same situation and will be leaving the country by this month and my PERM is filed in the month of Sept 2017.

Hello Friends,

I have below situation and need expert advise . Thanks

I will exhausted full 6 years on my H1B on Feb 20 2018 and my employer has filed PERM in Nov 2017 and awaiting the response and not sure how long will it take for PERM and I-40 (premium). My spouse is holding H1B with company A, however it is in the process of transferring to another employer B and received RFE and RFE response is not yet submitted yet, might be they will submit in the mid Feb 2018.My question is through which employer (either A or B) we need to start processing my H1 to H4?

Hello friends,

Need quick clarification , Last month my attorney sent me an e-mail with case number number starting A-17237- *** and he said my case is submitted on Sep 19 and this is my case number and when i was looking at the case numebrs from the yesterday list on the iCERT portal some of them show the case numbers which start with A-171 , what does this mean is my case is submitted earlier? i'm confused , Please help me with your experience and knowledge on this, resposes will be highly appreciated , Thanks in advance.
