I know man, I should have given them notice more than 2 days, but there is a reason for that. I was just sick and tired of the bullshit... oh we are working on your visa we need X document, we need Y document and that too not in one email just scattered all over the place. They were just dragging their feet to get things done and it's not that they just had me for 2 weeks, the conversations were going on for 3 weeks prior to me joining their Client.

And I didn't feel bad at all resigning with 2 days notice because when they fire anybody they don't even give 2 hours notice to the employee who has a family and kids and will need that job to pay the bills. In all the fair judgement in my eyes I was like screw you guys I am moving on and won't be a part of this bullshit organization. I am fair to those who are fair in their dealings, I got no issues doing the rite thing but it should be fair all across the board. :)

Thanks a lot guys: Following is the actual email received from the representative of Company B

Good Morning! By now, I’m sure you know that XXXXXX has resigned from both Company B & our project in XXXX. As you can imagine, this has put Company B in a bad position as he just started, delayed traveling onsite, etc. etc. What makes things even worse is my HR Team and Legal Team had begun the process to transfer his VISA as he was to become a Full-Time employee as soon as it went through. So, I wanted to make Company A aware that we will be withholding 30 days of payroll per our contract as XXXXXX did not provide a notice as we cannot charge the client, given how he handled it and need to recoup those immigration costs.

Since this guy from Company B just says it loud in the email that he needs to recoup money for immigration costs, would this be enough to have a case against them?

As you all are aware that I didn't want to join Company B but was still doing to until I hear from Company C. Now here is the scenario: I get a call from Company C, I accept their offer and also resign from Company B. Also Company B is a multi national consulting firm and had made an agreement with my Company A to provide services to the client in an EVC model.

Company B is not all happy about me leaving and they have started to threaten me by saying we will tell your Company A that you were planning to leave already and you won't get paid for this time, we will send you a bill to re-coupe all the immigration costs incurred so far. Now I know what ever the representative of the Company B said in an email and over a text is illegal. I am planning to sue these sick bastards of Company B so that they don't do this to any other immigrant in this country.

Please suggest any good attorneys and some suggestions of what should be a total case that should be made against the Company B. The company is based out of Philadelphia.

Thanks everybody for the suggestions: I wasn't aware myself that we cannot join on LCA. I will bring this up with them and try to stall as much as I can to wait for Company C.

Well company is an MNC with offices in Europe, India and US and I am pretty sure my contact person doesn't quite understand immigration, so might have been just forcing it without proper knowledge.

Hello All,

I have been working for a company A for last 6 years and finally decided to switch to a new role and I am in dilemma of what should I do, here is my situation

Got offer from Company B (which I would join if that was the last thing left) and they want to start the H1b process ASAP and want me to join the company just on LCA (don't know if it's safe to join on LCA or not?)
AND
I am awaiting for an offer from Company C (which I really want to join), expected to happen in the next week.

What should I do in this situation:

a) Go ahead and accept Company B's offer and initiate the H1b transfer today and not wait for Company C's offer.
b) Wait for Company C to respond? If I wait and Company C doesn't reply at all, then there is a high chance that Company B would not wait for me and move on to the next candidate
c) Initiate the H1b transfer with Company B anyhow, if and when Company C's offer shows up then accept their offer and also initiate h1b transfer with them.

What are the risks involved in Option C and has anybody been in this situation earlier?

I did sign up for notifications and got them only the first time on Feb 22nd when they had received the H4 EAD application, since then absolutely no update neither online nor on the email/text. I was surprised myself to see the approval notice and the EAD card in the mail on April 15.

Hope whom so ever is getting the validation error, gets their cases resolved soon. Good luck.

Surprisingly received the EAD card in mail yesterday. It was approved on 04/11. Online it still says Validation Error. Good Luck to the rest!!!

You don't need a lawyer to apply for H4 EAD, just do it by yourself with the new forms and filling fees. I did it for my wife in the first and got the EAD card within 3 weeks. Recently filled for a renewal as well and have received the Receipt notice.

You can go to a lawyer if you want to spend extra money so that they can fill out forms for you. I have seen attorneys charge anywhere between $400 to $1000. Your call in the end
