Hello,

I need info from your experience.

Question - Will I get a 1 year or 3 year H1B extension?

Situation described below:

OCT 2013 - H1B issued by company 1 valid till MAY 2015
MAY 2015 - H1B extension by company 1 valid till SEP 2018
OCT 2015 - H1B transferred to company (validity till sEP 2018)
JUN 2017 - PERM approved
NOV 2017 - I-140 approved
APR 2018 - (Future) H1B Extension to be applied (6 months before H1B expires)
SEP 2018 - (Future) Validity of current H1B (5 years complete)

Question - Will I get a 1 year or 3 year H1B extension?
Is there any rule that I140 has to be approved for 1 year in order to get a 3 year extension?
(assuming 'cancellation of H1B extension beyond 3 years' is not applied by then)

Thanks. I am following the tracker and have listed my case as well.
However, it doesnot specify nor distinguishes the concurrent fillings i.e. 539 and 765 concurrent filling and the respective wait time till EAD is received, in hand.

Its EAC for both 539 and 765, so Vermont.
3 months !!!

I think I will NOT make the '30' points to be considered for this inspite of having US Masters degree.
I did a rough estimation and used my age now and a year or 2 years from now, used my current pay and used 2017 median household income of the state I work in, and used various level of English test scores.
I think even if this is enacted in the current form, then it will be very difficult for a large % of people

November 17, 2017 :
There was a new request to extend the deadline, but court has denied the extension and has asked to continue and proceed and file their motions by January 2nd, 2018.

September 27, 2017 :
DHS ( Trump administration) filed a motion and requested the appeals court to hold the current H4 EAD case again in abeyance( which basically means hold on temporarily in suspension ), until December
31,2017.
The whole reason DHS have asked for this extension is to ensure that DHS and administration align their entire approach to implement Trump Executive Order 13788 on Buy American Hire American and consider how to handle the H4 EAD rule as part of overall view.

September 20, 2017 :
SAVE Jobs USA has filed its motion stating that DHS has not taken any action and no publication of rule has been done in Federal register related to the H4 EAD rule and they requested for oral argument to conclude the case.
They continue to tell that the delay would hurt american workers and new litigation would begin again.

June 23, 2017 :
The appeals court granted a stay on Jun 23rd, 2017 and asked both the parties, SAVE Jobs USA and DHS to file further motions on how they would like to proceed with the case by Sep 27, 2017.

April 3, 2017 :
The administration asked ( filed a new motion) for additional 180 day abeyance(state of temporary inactivity ) before they can provide their opinion.
The Trump administration will update court every 60 days on the issue and update court before elapse of 180 days.


February 2, 2017 :
The Trump administration requested ( filed a motion) a 60 day abeyance (state of temporary inactivity ) to consider the issue and submit their brief ( response to consider the case).

The author wrote a similar article few months back.
There is an uptick in online discussions for "merit-based" and "RAISE act" (my observation).

Hello users,

Just wanted to get some idea about approval timelines for H4 and EAD from you.
I am all set to file H4 and EAD for my wife (just waiting for the I140 approval notice).
She is in H1 and we want to request for a H4 start date of Jan 1, 2018.
If we file this (H4 and EAD) lets say, next weekm first week of December 2017, by when can we expect to get the EAD.
Can you share your experiences with the timelines.
