It appears this time we are hearing from horse mouth about the increase in EB based visa as part of DACA deal, so it's going to be interesting to see the final bill how it might help for legal immigration community with or without PCC elimination.

We are not asking the agencies/Congress for additional GC visas or to pass a bill in order to clear the current GC backlog or eliminate per country quota's limits in EB-GC category because though these seem to be the correct fix however it's likely to be a long-term effort/solution to get this done.

We are asking a relief for the EB backlogged community. If USCIS understands our plight, then they might consider revisiting the current CSPA rule and amend it through a rule-making process since from the outlook it appears that there is not much dependency on the Congress to enact some law to help H4 Dreamers.

Also, unlike H4 EAD for spouse specific negative perceptions, we might get enough support from the agencies, AILA, and employers as well in this regard.

@Guru's - Assuming that there will not be any GC relief in coming years, what are our options to mitigate our children from facing aging-out challenges and to bring them under Child Status Protection Act (CSPA) rule.

USCIS can add certain verbiage in the current interpretation of CSPA rule by including H4 based children provided if their parents have already approved I-140 which allows them to be covered under this clause.

We must explore channels/resources to see whether agencies through the rulemaking process can provide H4 EAD for children which can be used for college admissions and other purposes while ensuring that they still remain in the GC queue beyond 21 years.

If we can represent/request this issue (alone) to the respective agencies, then they might provide solutions by addressing the aging-out criteria taking into consideration of backlogged group.

IMHO, there is no point on comparing H4 Dreamers Vs DACA because these type of discussions among ourselves may not fix the real issue that many of us are likely to face in coming years. We have to find out the right solution by engaging the appropriate legal counsel experts who can represent our case with lawmakers to pass a bill (or make changes to the current Ageing policy through the rulemaking process by the admin) in order to fix this issue before it becomes too late.

Those who are based out of Texas, please review the below details and let me know if you have any suggestions.

I have recently moved to Dallas TX, and my H1 extension has been filed recently. Considering the constraints involved in transferring/renewing my DL with TX DMV, I have tried to make a SAVE request today but unfortunately it appears the program is not available for applicants coming from out-of-state.

Since my current DL is expiring in next couple of weeks, I would like to know If there are any options available to transfer/renew my Driving License with Texas DPS asap.

I can see the views about the quality of education in "US Vs India" to raise the children are discussed well here, we may have to admit that both the systems have merits and demerits and we can add more arguments to that.

But how these points will help someone who is on H1 undergoing challenges w.r.t. lack of FTE job opp., project continuity, financial aspects, job relocations - so we need to understand and discuss about the real problem before us and find ways to manage our situation better.

curidpostn's case is classic example for many H1 visa holders children whose life might end-up in a similar way.

So it's important for us to understand the potential impact that this single issue alone could bring to our families.

Groups like SIIA can represent our community situation with Congressmen (similar to country-cap removal efforts), and work with the respective agencies to fix the present form of "USCIS - Child Status Protection Act (CSPA)" rule.

To all H1 parents, I am re-posting my earlier message to get your inputs on finding potential solutions w.r.t. preventing our children from aging-out (USCIS) policy, and manage college admission and tuition fee part being on H4 or F1 visa.

Being in H1 with children in High School definitely we are in a situation already, even this problem applies to H1 parents whose kids are in Middle School though they may not have immediate impact - at least for 4-5 years.

Unless we take some meaningful steps and explore the possible options with the help of interested groups and congressmen, it's certain that our children will be impacted in getting admissions based on Merits, and parents will be ended up paying exorbitant State tuition fee.

Can we approach SIIA or similar groups to discuss about our challenges and the possible implications that our family/children is likely to face in coming years assuming the current GC wait times are expected to remain unchanged?

One of the possible solutions that we should ask for is that, thru Rule Making process USCIS can freeze our children age when they turn 21 considering the decades of waiting time in the GC queue for H1 holders of Indian community.

I happen to notice some of your comments in other threads as well, and I appreciate you for coming forward to share your views.

It appears that you are not one of the impacted legal immigrants, however we are still open to hear opinions from both sides as long as the points have substance.

For example on one hand you are referring the EB-I community are cheap labors coming from populous countries, but you are also pointing that we are replacing american workers, aren't we missing something here (common-sense?). How come the cheap labors who are NOT highly-skilled would be able to replace the talented workforce in US.
