I see. But in my case, when i move from my current employer Subsidiary A (example Apple Watch Co.) to the new employer Subsidiary B (example Apple Macbook Co.), then my new H1b and i-140 process will start again under Apple Macbook Co.'s name. I'm hoping there wouldnt be a lot of trouble with USCIS or during visa interview due to EC model.

Is there a lot of special docs that I need to take along with you for the visa interview under EC model?

The parent company (MNC), my US subsidiary employer (Company 1) and the other US subsidiary (Company 2) of the parent company all share the same 1st name.

Example: Apple Phone Co. (Parent), Apple Watch Co. (Company 1) and Apple Macbook Co. (Company 2)

My H1B and I-140 have US Subsidiary (Company 1) name. I also did some research and understand that i would be under the Employer-Client relationship model.

Since this is the first time I am ever getting into such kind of models (always been FTE / direct hire), i am curious as to what kind of impact the new USCIS policy memos are having on such models.

I want to clarify, the contract between company 1 and company 2 will be annual contract. However, they may add language that the contract is autorenewed (evergreen) unless cancelled by both parties.

What would be the implications for my new H1b visa due to this 1 year and possible auto renewal time frame? I am asking based on the new USCIS policy memo..... do let me know. Thanks.

Fellow Trackitt Users,

I need some guidance from you based on your expertise, as this is completely new to me. Apologies for the long post in advance.

I am a FTE / direct hire employee performing Job Function A (in-house / non-IT job function) at a US subsidiary (Company 1) of a large MNC (our parent company). My current H1b through Company 1 (7th year based on approved I-140 2016 PD from Company 1) was recently renewed earlier this year and is valid till 2020.

Our parent company has another US subsidiary (Company 2) which only specializes in Job Function A (non-IT job function) for all global branches of the parent company. As part of strategic decision of our parent company, it looks like later this year my entire department (which performs Job function A) in-house as direct employees of Company 1, will be absorbed into Company 2 as direct, FTE's of Company 2.... but we will continue the exact same work at Company 1. Company 1 will sign a contract with Company 2 for the performance of Job Function A (i.e. our entire department in Company 1 is outsourced to Company 2).

The only thing that changes is our employer (from Company 1 to Company 2), but otherwise, everything else will remain the same as how it is now (including where we work, work stations, job roles and functions, etc.).

Therefore:
- Does USCIS consider this as Employer - Vendor business model?
- After the transition, i will become Company 2 FTE / direct hire employee but "placed onsite" at Company 1, what kind of additional documents would be required for getting my H1 transferred?
- Is there very serious scrutiny being given to Employer - Vendor business model? Would it make any difference (positive) if both Company 1 and Company 2 are globally well recognized companies, and subsidiaries of the same parent company?
- Any other potential issues in your opinion?

Yes, I was there at 10am to drop off the docs. This is my 1st time using the Dropbox option. The lady at the counter told me it'll take ~ 3 to 5 days to get my passport back. I'll be picking it up on Monday.

Wanted to give everyone an update regarding my case. I am a FTE at a large Chip company working in the Valley. I have approved i-140 as well.

Case: H1-b extension 7th year based on approved I-140.
Post: Dropbox at Mumbai.
Docs Submitted On: 1/16/18.
CAEC Updates:
1/17 = Case created
1/18 = Administrative Processing
1/19 = ISSUED

So generally, it's taking ~ 3 to 5 working days at Mumbai for extensions. 2 of my friends with similar FTE background working in the bay area also got their cases approved and passports back in 5 business days.

Good luck to everyone who is going through the Dropbox process.

Quick question, when was the last time (year) you did your visa stamping at Mumbai? I am asking because if it was a long time ago, they may require fingerprints again.

Did you only have to do fingerprints, or fingerprints and interview?

When you were at the consulate, did you notice if they were approving the visas for other dropbox candidates who were called in for fingerprint / interview? Kindly give us all an update on your status so others are aware of current trends. Thanks bro!

Topic: DS160 Question about unlawful presence, overstay or violation

Guys - quick question, if many years ago, you were out of status (in my case 3 months) and you wrote YES on the DS160 for this question about unlawful presence or overstay, then explained old case reason to the VO at the consulate when applying for a new H1 and they issued a new H1 with new employer...... now when it is time to extend the H1b visa again with new employer, do you have to keep writing YES for that question and keep mentioning that OLD case? Or is it that once you've explained to VO already and they issued you a new visa, then after that you always mark NO for all future extensions?


Background details on old case:

- Last day of employment with previous employer was Feb 2015. Their H1b petition was valid till September 2017. USCIS revoked this petition on April 2015 after employer notified them of end of employment.

- NEW employer's H1b petition filed in April 2015, approved in April 2015, stamped on my passport in May 2015 and valid till September 2017.
