Topic: H4-EAD i140 withdrawn from previous employer

I doubt you can. Because H4 EAD is based on your approved I-140 and if your old employer is revoking it, USCIS will not have any basis to renew/approve your wife's H4EAD. But have you not applied for I-140 with your new employer?

Hey bud,

Did your attorney respond to the RFE? Did you have to do anything like filling/signing the supplement J form OR your attorney took care of everything?

I informed my attorney about the RFE and she said, now it has become pretty common to get RFE for Supplement J and all of their other cases have been receiving RFE. She also said that I am lucky since they have asked only for Supplement J and nothing else. She promised look into to my case and submit the supplement J asap. I don't know how long will that take.

I got a text/mail alert and change in online case status saying they have sent me a notice asking Request for Initial Evidence. I also received the physical notice by USPS mail today and its a pink paper asking for the supplement J. It was sent from DHS, NBC at Lee's summit, MO.

I hope my attorney will respond asap.

My case transferred to NBC on 28th Nov 2017. Rest of the timelines in my profile.

1. Yes, you can apply for H4-EAD as soon as your spouse gets the I-140 (was it applied on premium?). I don't know whether your spouse's employer will file for your H4-EAD or not. Because they are not obligated to. So they might or might not based on your spouse's relationship with the employer.

2. I don't think there is any difference in the time taken to get H4 EAD when you self apply or apply through your spouse's employer. As far as I know, it takes anywhere between 3-6 months to H4 EAD as there is no premium processing for it.

In either case, you might have to bear quite a bit of expenses (attorney fee, H4 EAD filing fee etc.) especially when you are not sure if there will be any use of H4 EAD or not (not trying to discourage you).

Since there are so many confusions regarding H4 EAD and DHS/USCIS will arrive at a conclusion soon (1-2 months), I would suggest you wait for few weeks before you apply for your H4 EAD.

Hey,

I feel you are worrying too much n getting too worked up. Don't worry, things will work out just fine!

I went and renewed my licence using the EAD card and it took me less than 15 mins. They DID NOT ask for my lease agreement, car insurance, car registration, I-94 nothing! I was surprised with that, because, they sent my wife back coz we did not carry her I-94 (My wife hasnt got her EAD yet and she was trying to renew her license using H4 extension receipt notice).

So, just go to DMV with your EAD card and you should be fine!

There you go! :-) must be some relief!

Its most probably an EAD card. See if its a 'Package' and not a 'Mailpiece' and has an insurance of $100 added to it. If yes, then its definitely EAD card. You should get EAD Card from Lee Summit and EAD/AP approval notices from your service center (Texas may be). I got 2 separate notices from Texas Service center even if though the card is a combo card and these notices were listed under 'Mailpieces' tab in USPS informed delivery.

Also, even though it says expected date of delivery is 8th Jan, chances are that it will get delivered couple of days earlier than that (I got mine 2 days earlier than the original expected date of delivery).

I guess, you are not getting my point. I don't think USCIS will give you a tracking number. You can try calling them.

But I would suggest, Sign up and use the free service, i.e. Informed Delivery from USPS (US Postal). This service will show you tracking information along with the images of ALL the mails that are shipped/mailed to your address and your EAD card mail should be one of those. Google 'USPS Informed delivery' or check out the link below.

I don't see your case in the tracker. Do you mind sharing your timelines?

I live in Cary/Morrisville area and wondering if my interview will be in the Application Service Center in Chapel Hill Road, Morrisville (I had my Bio-metrics/Finger printing there).

I dont think you attorneys get your EAD card. I got mine mailed directly to me from USCIS. I have signed up for Informed delivery in USPS site and I got the alert with image of the EAD mail as soon as they shipped it. It was anxious 2-3 days waiting for it as I had to renew my DL.
