Topic: Going to India on H1b with DUI

I got DUI in 2000. Have expunged the records from the court but getting visas stamped have never been easy. Firstly you have to disclose on DS160 where it asks you whether you have ever been arrested and charged. VO ordered my finger prints and sent it to FBI for verification. Took 2 months for the process. The visa was issued and it is mentioned on the visa that "FBI hit, no moral turpitude".

You are a total nutcase man. You have no clue what you're talking about. I believe you are a fresh graduate who got pressurized and got married recently and accidentally landed in US and who wants to make changes by being a keyboard warrior.
Please don't blame the system if your wife is a graduate with no job. It has been made clear on multiple forums that the new rule (if becoming a law) will be grand-fathered in. Which means will be applicable for the people wanting to come in future not the people already in line as it will invite numerous lawsuits. Think about a person who came here in early thirties who would get maximum points for his/her age but purely because of the backward immigration based on country of birth, could not get the gc. But suddenly now the rules get changed and the person now is in 40s and does not qualify for the extra points. It is none of their fault for crossing the age as the system was broken.
I request you not to vent out just because it is a problem of your household but look at the bigger picture where everyone will be benefited once this rule becomes a law.

No you can't your brother can sponsor you in F4 category for which the current filing time is 2004. Him sponsoring you doesn't give you an official status untill your priority date is current. You either need to file your I140 through an employer to continue to extend your H1B or wait outside of US for your priority date to be current.

You are asking me the same question again and again and the answer is yes it CAN BE APPLIED IN ADVANCE OF 180 DAYS (Both H1 and EAD). If you ask me this again, I will not reply to you and will advice you to cough up some $$$ and consult an immigration lawyer

Yes, it can be filed together but EAD only gets approved once H1 is approved so there is no guarantee but yes, they can be filed together. Although H1 applicant can continue with their jobs pending approval just on H1b receipt notice, EAD holders must have the card in hand to continue with their respective jobs

You are absolutely right. Thanks you for some sane minds like yours especially silently going through posts of people like Raj, who have no business besides scaring people without any info themselves. I enjoyed reading our post and thank you for your first positive post. I totally agree that legal applicants have nothing to worry about because changing any existing laws and rules have been drafted through rule making process, is a tedious and time wasting process where republicans will not be concentrating. I bet anyone that no existing, simple legal community affecting rules will be touched because they know that sooner or later, we will be their vote bank.

So, I thank you again for bringing some meaning to this blog and I hope that the legal community will stop worrying. I am sure that the good days are about to come and DT can and will end all the frustration......

There is no provision for it right now. Hope the new regulation makes I140 the employee's property and non revocable. Until then, employer can can cancel it anytime.

That is so not true. I am on the second extension on the original I140. As long as it is not cancelled by employer A, you can get multiple extensions.

UPDATE on EAD for I-140 (Job Mobility regulation)
Here is the link to the USCIS Internal Memo from June 2015 about EAD for I140. The work is underway and we expect the rule to come out in public for comments in around 15th November.

There is also background activity whereby immigration lawyers and companies are working very hard to derail EAD for I140 fix. They are trying all sorts of ways to derail or water down this fix that we have worked for years.
Immigration lawyers and companies want this fix to be only applied to those with 'Extraordinary Circumstances' i.e. where employee can show economic hardship, exploitation by employer etc. They are trying to water down so no more than 600 people in an year would be able to benefit from this fix.
We ask that you NOT engage in any online petitions. Online petitions are distraction and diversion from real effort. Often times these petitions are started by immigration lawyers as diversion from real advocacy. Online petitions severely hurt our efforts. Again, please DO NOT engage in online petitions.
We will soon publish action items and we ask you to actively participate in these actions items.
