hi,

Can I apply EAD for wife in such scenario? Reason I am on h1b and I have EAD -i485 but my wife doesn't have , she is on h4. But my situation is forcing me to change employer on I-485 EAD and wife's H4 will get invalid when I go on I-485 EAD. so I am just exploring all options like one is converting her visa from H4 to F1. Is there any way I can file EAD for her in this circumstance?


Please suggest.



For EAD based on compelling reasons, there are conditions listed in uscis i765 instructions.
If you are applying based on compelling reasons that is on category 35, you can apply for your spouse based on category 36, check the instructions on uscis site for minimum requirements to apply.
Since you are already on i485 ead, you need to read the fine print on the final rule published as well.

OP was right.
Don't compare racism and casteism, they are two different things. Indian browns using caste to fill up positions is what is creating the whole problem.
A few years ago I was trying to get a contract position in a city I prefer, no jobs or no offers and later I came to know these were being filled by a certain caste group internally as they have grouped together and getting their own people.
This is why Americans are frustrated they do know where are these positions going and they start pointing fingers on the entire Indian browns.

Who gets benefited here? The caste group who are forming groups at client sites allowing open positions to go to their caste group. Who are the losers? Available Americans and the remaining Indian browns who are not part of that group.

If you know a certain person is doing like this please note there are anti nepotism laws and this can be and should be reported and explained to the government.

I think only a few states in India have these type of issues.

I did raise a Service request five days back. Today I got an email saying my SR is denied. It was mentioned that SR is being denied because they are gonna process both the applications in the 90 days time frame and Its already 82 days for now.

I am not sure if they are really gonna process my applications in 90 day time frame or not.



What reason have you selected for requesting to expedite the case?

IF these things are going to affect adversely then you must rattle their cage man. Go and meet the congressman, write some letters and make phone calls. USCIS should hear you on multiple fronts otherwise nothing will happen. They are mostly asleep most of the time.



Why don't USCIS don't take up the expedite requests without people going to congressmen etc.

We need to ensure only people with merit gets here - the problem with many country people migration is they do not want to make way forward for them but instead find a way to pull others down - which should not be the way to live.
Do we really need those kind people around us - definitely not - inventions and not any other thing should be allowed as a single criteria is what I think we should all recommend for and vouch for



Yes agreed. One example is EB1c, they get the green card in a few months, and I saw many of them with 3 year degrees.
Engineering graduates are waiting for a decade for green cards, while witches are allowing these 3 year degree holders to get greened. Any high skilled entry into USA should have 4 year degree in engineering.

We should do a Video as well and send that to the FOX news facebook / twitter page and ask them to investigate that and show the abuse. Video speaks more than words.

one more idea could be to involve CBS and ask them to do a follow up on the 60 minutes on h1b.
THE only way u will get attention if this affects Americans. DONT show the victims as indians ( eb2 back logged ) they wont care. NO one cares about EB2 backlogged in this country . they have more important things to worry about. the focus shoud be Americans , they should be shown victims with this abuse as taking away American jobs easily , only then people and media will care. 60 minutes got attention because of the Americans loosing jobs.



EB1C does impact Americans. Those who come in with EB1C work on taking away jobs to outside America. They work on getting the jobs out of USA. That's why it should be banned or if some companies really need them, they should stand in line along with EB2. I don't see any reason why they should be given green cards for taking the jobs out of USA

We need to do something to shutdown ALL fraud Desi consultancies who market fake resumes and send people on OPT on 7 years resume , as this is the main reason causing blockage of Eb2 queue. we keep blaming Eb1c just to get that little spil over but the main culprits are thesee fraud Desi's who have flooded the market with SOOOOO many OPT"S who convert to h1b and then file i140. these are more desi consultancies in USA than gas stations.



So the already looting witches can hire more 3 year degree holders and swamp USA right?
You sure are from a witch and deviating the topic. EB1c must be banned. Its not fair for a 3 year degree holder to get a green card in few months while an engineering graduate is waiting for a decade for the green card.

Hi Guys,

Will the GC backlog be removed if each country is awarded 7% of 65,000 H1-B visas for each year.

( So India will have around 5000 H1-Bs each year, and so does the countries of the rest of the world).

And then what if there is unlimited H1-B visas for all US Stem graduates.

Excellent post.
This is what is required to maintain line without backlogs. But the greedy companies won't allow that because its a loss for them.
Either they need to clear the backlogs or impose country caps on H1Bs in line with green card categories.
If there is a country cap for eb3/eb2 categories, then there should be cap for H1Ns too.
The moment it happens people will know the value of H1Bs because there would be huge requirements without skilled people.

Also the need to cap L1 visas which are being exploited by witches.

No...stop talking about abuse....its time EB1C is removed. Its cruel to award green cards in few months to 3 year degree holders while a lot of people are waiting for green cards for a decade.

Just fight for removing eb1c and ask them join the line behind us.

I have a related question to the i140 rule.

My i140 has been approved with employer A since a year (Apr 2016) and have H1B through 2019.
Have an offer from Employer B who plans to start my H1B transfer in the 2nd week of April.

Now since employer B cannot do H1B premium processing, it might take several months to get H1B transfer approval.
Employer A will withdraw my i140 as soon as I quit.
Will the new rule i140 protect me? Can the H1B transfer be denied if the i140 is withdrawn before the H1B transfer is adjudicated? Thanks.



Yes this rule will protect your situation. Even though your employer A withdraws i140, your priority date will be the same. And your H1 transfer will not be denied. Why dont you wait until your h1 transfer is done and then join employer B? You can ask your employer B to do premium as the suspension will be effective only from April 3rd.

Reporting abuse is fine, but we need to push for banning eb1c. It is gross injustice to allow 3 year degree get green cards in few months, while engineering graduates are waiting for more than a decade.

Agreed, some of the WITCH employees and talented and excellent. But the problem here is about eb1c person getting greened in few months ...while eb2 and eb3 people are waiting for a decade. So my suggestion is to merge both eb1c and eb2 and eb3 ...so that no one cuts the line.

I don't see the thread that I posted earlier.
EB1C is hurting the skilled people who are waiting for a decade.
Even a 3 year degree holder is getting a green card in few months, while engineering graduates are waiting for a decade.
They cut the line for green cards and push the people who are already waiting for a decade.
This must be banned or have to rightfully stand in the line on first come first basis.

Why to support EB1c?
To get the USA jobs shipped to other countries?
To cut the line for green cards and push the people who are already waiting for a decade?
To get a gift card called green card in few months even with a 3 year degree, which would otherwise require you to get high skills and come to USA with most difficult legal path?

Why, why to support EB1C...innocent american managerial jobs are at stake with these green cards. Also taking away the immigrant visas from the people who are waiting and waiting and waiting for a green card for more than a decade.

EB1c must be banned.
