Just want to share this positive news

I filed my H1B extension (post 6 years) + H4 (spouse) extension+ H4 EAD extension under PP on 7/20. My H1B was approved in 5 days and in the next 5 days both the H4 extension and H4 EAD did get approved as well. H4 EAD status shows the new card was mailed on 7/29. Awaiting all the approval notices.
I'd like to highlight that my wife's H4 EAD was expiring in December 2016 which meant that I couldn't file 120 days prior. However, based on my attorney's recommendation we filed all three applications concurrently well before the 120 day limit and all of them got approved.

P.S Filing all three apps. did make USCIS's admin job easier and hence all apps were approved. Hope it helps.

My attorney stated below

We were merely acknowledging that despite our request to the USCIS when we filed the I-140 petition, they listed the priority date of the current Company ****** PERM on the I-140 approval notice. It is common for the USCIS to issue the I-140 approval notice this way. There is no formal way to have the USCIS update the I-140 approval notice itself and requests are often unsuccessful.
When the AOS is filed, we will be including current EB2 I-140 approval as well as your prior I-140 approval with the your earlier priority date.

Yes, my attorney did attach my old revoked I140 but I guess for the time being USCIS did not consider it. It's a bit of a gray area. Having said that, my attorney assured me that while filing for AOS we will be including both old and new I140s. It should then be okay.
Like I said earlier, the real test would be once my old PD becomes current.

I think you should be able to retain your old PD. Here's my situation

My previous employer A revoked by approved EB3, I140 (on the basis of I changing employers), PD Jan 2012. My new employer B filed my I140, EB2 and got it approved. However the PD on my new I140 shows Feb 2015. My attorney says that as per 8 C.F.R. Section 204.5(e), I can still use my earlier PD (Jan 2012). My Attorney has confirmed that I am entitled to use my previous PD coz withdrawing an I140 is not same as revocation. Hence my PD is Jan 2012 and category is EB2.
My employer's law firm is one of the top US firms. Having said that, the real test be once my old PD ie. Jan 2012 becomes current.

My case...
My current H1B expires in Dec 2016. We intend to file for H1B extension (beyond six years) + H4 extension next month. My wife's H4 EAD also expires in Dec 2016. Per USCIS, we can't file her H4EAD extension 120 days prior. However, can we file my H1B extension+H4 extension+H4EAD extension at the same time next month?
We intend to file in Premium. Thoughts?
