Topic: Concurrent Filing - Premium Processing

My personal preference will be to file PP I-140, than if approved I would follow up with 485.

I-140 premium decisions are usually very very fast therefore concurrent or non-concurrent option does not
save you much time, HOWEVER if your I-140 petition gets denied for any reason, in concurrent case
your 485 will automatically get denied as well (unless you have some other petition pending)
which is never good.



Hi guys,

I am a EU citizen, therefore my visa number is current. The attorneys offered me the option to pay for i140 premium processing myself. I am filing i485 concurrently.
Do you think it makes sense? Will it shorten the overall processing time for the greencard?

If you ever applied for any serious job, then you know the drill (your strength, weaknesses, and position in the field of endeavor). EB1A is nothing more than expanded CV formatted to satisfy USCIS selection criteria. One can buy
car for 5-10K, instead of paying "experts" for whom you do most of the job.

Filing I-485 shows clear migrant intent.

I personally don't believe that _only_ approved 140 shows immigrant intent,
but it may imply immigration desire (yes such term exists). With TN in hand
you are at the mercy of CBP who may argue either way.

During the interview, the USCIS office never asked me about my trips. My assumption he was able to verify whatever information he needed based on the paper trail of documents I provided. Also make sure you can correlate your travel dates with CBP I-94 arrival/department travel history (https://i94.cbp.dhs.gov/I94/#/home).

How do you correlate I-94 [legal-visitor status] to LPR (GC) holder commute?
GC holders don't need I-94.

crypto accounts are anonymous, in the other words only the owner of proper keys has access to it.
Once when you cash out cryptos in real currency, it {may} count/register as a capital gain/loss for IRS.
H1b has absolutely nothing to do with crypto trading.

Was wondering, one (like victoria2 in this post) is the green card holder. Gren card is valid for 10 years and in principle
provides all the benefits of the citizen, furthermore, it saves you from jury duty nonsense, gives you easy checkout option
if one wants to get out from US "dream" ...

Now my question is why there is such desperation for obtaining US citizenship in a *timely* manner lol?

I will happen anyway within +-year if your application fits standard processing, gets denied (unlikely) you try again
after all, it is just money.

I am pretty certain that you can file I-140 for EB1A and NIW from abroad, however
I cant guess where to send petition with supporting docs. I believe that even if destination is wrong
they would reroute petition internally, however you may want to consult closest USCIS abroad

With the new executive orders, AP is prohibited I guess. You need to have a genuine visa to enter back into US. This was in my mind before posting this thread. I am kind of scared, what could be coming in the near future.

I think your case is strong and you will pass "Counting the Types of Evidence Provided" for eb1B

However If one wants to be picky your citation number is on the low side which may
compromise second step of assessment, Final Merits Determination.
I think it is not big disaster because letters (one from Nobel laureate) may fix this, company
support docs etc

Go for PP nonconcurrent, I think it is bullshit that PP rejection rate is higher and/or that one will
be assessed differently than during regular processing.
