Topic: EB-1C eligibility

Quick question on eligibility of EB-1C - executive manager in USA on L1-A and was on the same position abroad for 14 month and during this time abroad visited USA on B1 for 2 times ( close to to 3 months stay). As we know minimum requirement is to have at least one year in abroad but in this case I was there for 14 months and if I exclude 3 months which I traveled to USA on B1 then my total stay in abroad is around 11 months. Do you think this will create any issue in eligibility of on EB-1C ?

Topic: I-485 - Birthdate Late registration

I don’t have birthdate certificate and while checking the records with municipality I found my birthdate was 2-weeks late registered (BB/Aug) instead of AA/Aug which is in passport and other records. to file I-i485 Birthday certificate is mandatory and I know from various sources about how to deal with it in case one cannot have original Birthday certificate.

Since records is available I cannot get Non Availability of Birth certificate so in that case I have to get birthdate certificate(BB/Aug) and file I-485 with
- I-485 application with Date of birth mentioned as per my Passport (AA/Aug)
- Submit birthdate certificate (BB/Aug) (since I am not able to get Non Availability of Birth certificate)
- Submit two affidavit from nearest relatives saying that my birth (BB/Aug) was registered late at municipality but my date of birth AA/Aug is the correct
- Also submit school leaving certificate and Birthdate certificate from US Embassy ( as per Passport)

Please suggest if the above options is sufficient to file 485 or need any additional requirements.

Note that I don’t want to change date of birth(BB/Aug) in all of my records i.e. Passport, school certificate, SSN I-140, Visa copy etc. etc. which is I believe a long process.

I have been trying for last 10 day and we are four members to get an appointment in any consulate before July 31st. no luck till now. I saw 1 or 2 slot but not 4 and not sure this can happend near future. anyone can suggest any better way to monitor appointment dates.

Delhi and Mumbai 1 Aug - but when i try it does not may be one or two slot. I have total 4 applicants so don't see it. is there anyway to see available date and available slot without going to recshedule options ? if i keep trying reschedule option my account will be lock and this is happening in past few days and need to wait for 24 hrs.....horrible....experience. stuck in scheduling appointment for last 10 days.....

I haven't seen July date in Mumbai It always open from Aug 1 to 9 ( one or two slots) and within fraction of second filled and reached to last week of Aug. I got Aug 12 but still waiting for Jul hope it opens soon.

No. you can not book without ds160 and paying fees but you can see which earliest date available when u login with your profile.
you can use any bank (via NEFT) and pay the fees.

QQ on visa appointment payment. I have four member and total fees is Rs. 51680. while doing NEFT transaction my bank does not allow payment over 50,000. not sure uscis acccept two separate payment let say (50,000 today and 1680 tomorrow)
or four payment for each applicant of $190 ?

did anyone has similar issue ? what are the other options.

I am not sure about first two que# but here is answer for the rest.

3) In case my fiance and i decide to take a common date for the interview, will we have to fill out and submit 2 separate DS-160 forms or can i be added as a dependent in his form itself?
- Two separate DS160 one for you and your fiance. once you book an appointment then u as primary applicant and add her as dependent.
4) If we club our interview dates together, the amount to be paid for scheduling the appointment ($190) will have to be paid by both of us ($190+$190=$380) or only a single payment of $190 will have to be made?
if you want appointment for both then payment will 380(fpr both in a single payment ).

5) How long after the interview will we get our passport stamped (in case we schedule at US consulate in Mumbai)?
I think 3-4 days.

I have I797 appproval which is expired in Dec 2016 and do not have visa stamp on my passport. my H1 amendment(location change) is in process. Can I visit india and get visa stamp for my old I-797 approval while amendment in procrss?

self and my family member's My H1 expire in Nov and do not have stamp on our passport. we are planning to visit india in Jul/Aug. can my company file an extension(in premium) while we are in india if yes then in that case once it is approve i can get it stamp with new H1 expiry date and return to USA.

Someone told me that H4 spouse has to be in USA during renewal process is it true ?

I was on L1-A for three years and now on H1b for the same employer may I eligible for green card on EB1C ? I am manager for last 5 years in usa and more than a year in abroad before came to USA. My co. has filed my PERM and I-140 in EB2 after converting my visa from L1-A to H1-B. I stilll hold the manager position in USA. Can I apply for i-140 in EB-1 now?

Aman is right and I think he was prepared what to speak and he was more on aggression which is fine in this case and
everyone on the other side realize but they didn't oppose because Aman was right. he very well articulate and explained about what uscis produced reports/graph on RFE and other visa related stuff but they never interested to discussed on what is genuine rights for Legal immigrants like us. at this points i don't think diplomatic way works with USCIS. I believe USCIS will take it positive and do the right for what is right.

AC 21 portability of the I-140 petition for change of employment without losing the approved i-140 petition.

I have H1-B valid for another year based on i-140 approval and visa is not stamp on my passport.
my current project is getting over in few days. My employer may layoff me immediately once i am not on project.

Can i transfer my H1B with other employer without any job/offer in hand considering that it may take few days to get a new job outside and not sure whether my current employer allow me to stay here without project.

your early response would be appreciated.
