positive here and hoping for the best. Since I already have approved I-140 so i can move to H1 any day once i decide my self-extended maternity leave is over.

Thank you for your concern but everyone's situation is different. I am on h1b with approved I-140. I had a baby recently and I have decided either I will not work or work flexibly for the next 2 years. I recently got a WFH job offer but the company do not want to sponsor h1. They are more than happy to hire me if I have H4 ead. So i am taking my chances with H4ead. If I get my h4 ead before the rule dies I will have work authorization until the end of 2020 which is the validity of my spouses h1b. After that I can anyday come on H1 using my I140.



While the admin can take the easier route of just letting existing H4 eads expire, that very well may not be the case. So basing your future EAD being available till 2020 may not be wise.
They could set a date in the near future after the rescind rule is approved and say that all EADs expire on that date or cease to be valid with immediate effect. No one knows for sure at this point.
Just be sure you have other options before going this route.

All Graham said was that 25K would go to Under-served countries (whatever that means), mostly African countries based on Merit. Really did not make any sense.

Please refrain from posting from crappy Indian websites who speculate to the maximum just for the heck of it.
Is Trump their chacha that they came to know that existing H4 EADs would be allowed to just expire and not retroactively revoked?? Even the rule that was proposed in the Federal register does not contain any such language.
This is same reporter who was lazy enough to post that 110,000 spouses had EADs, when that number actually includes renewals.
Stay away from Indian media for everything related to Immigration. They have no clue!

There is no denying that there is misuse in the EB1C category. But that is squarely because of the rules set for EB1C, so that any TDH can qualify. Indian companies are exploiting it to the maximum until the hammer comes down on them hard. In this time and age, they better watch out and it will be very soon before they are held responsible.
The EB1C numbers really are not that much there yet to hurt EB2/EB3 as such, but that very well can happen this year or the next.

non-Indian EB1 visa consumption is increasing every year and eventually it will hit at 37000+ and EB1 India will be backlogged like EB2 India and EB3 India.

EB1 = EB1A (Primary + dependents) + EB1B (Primary + dependents) + EB1C (Primary + dependents)

Year -> Total Eb1 - India EB1 = non-Indian EB1

2016 -> 43,723-10,985 = 32,738
2105 -> 41,990-12,253 = 29,737
2104 -> 40,608-12,978 = 27,630

If I look at that link for years 2012 - 2016, EB1 India numbers are almost same 9000-12000 but EB2 for 2012-2014 were good 20k+ but in 2015-2016 they dropped . So it seems 2015-2016 we did not have good spillover but it was not due to EB1 India. It was because ROW used more EB1/EB2/EB3.

2013 - India EB1 EB2 EB3 - 9,640 17,193 7,763
2014 - India EB1 EB2 EB3 - 12,978 23,527 3,465
2015 - India EB1 EB2 EB3 - 12,253 7,235 7,003

Dude, it is primary. Also look at CTS 140 thread-- they are doing only EB1C now.... you think there will be only 10,000 total India EB1C !!!

Also stopping EB1C does not require any rule change, they will just make it tougher. Maybe they should require peer review or some publicly published achievement like a news clip (they require it for EB1A and EB1B anyways so why not EB1C )



You now agree that EB1C India has been 10000 till now and are worried about exponential future filings. Like many other users have pointed out to you using government data, there really is not much to be gained even if there is a reduction in EB1C usage because the EB2/3 backlog is huge. IV has it right.
It is fun to watch your personal crusade on EB1C here on trackitt in multiple avatars over a period of time. Comic relief is great for a time when there really is not much positive going on all around. Keep it up until you get banned again and see you in your next avatar!!

That is exactly what I am saying. They want to offer only little help and nothing else. If they really wanted to help the people stuck in the backlogs, they very well can. They come out batting for the DACA kids without any reservations. Why can't they do the same for people on H1 and in many cases their own employees?
This is just a request to the govt, which the Trump admin can simply ignore. Meaningful reform needs to come through congress, which cannot be overturned.

It's funny how these folks who support IV and thank IV supporters mostly have single digit number of posts (or may be teens).



That's because these are guys from IV itself who create dummy users here to promote IV and ultimately would start asking for your $$.
IV might seem to support 392, but within I don't think they want this to pass. As long as this prolongs, IV would make money. If this issue for legal High Skilled Immigrants issue is fixed, that $$ would stop flowing in. Its just want I think.



And how are they striking the right balance between looking like they are doing a lot and not do enough so that the bill doesn't pass?? I am no supporter of IV, but I believe they are doing what we can to get this bill passed. Granted that they are not transparent and can appear arrogant, but there really is no other organization doing the groundwork for us. SIAA folks are also well meaning, but I think at best they have no clue of what they are doing and at worst, they may be doing more harm than good.

My assertion about people toying with desperate folks stemmed from the IV episode with the H1 extension business.
They really played with people’s emotions there. It really is hard to just trust anyone for that matter.

There really is no need to be so touchy about this. You are going to come across people who disagree with you. Frankly, someone who claims to be so highly connected and placed would not be bothered by what a random poster says about them or their ideas online. Your advice is always welcome here, but do not expect adulation here. We are all perfect strangers to each other.
I take your advice for now, but will continue to work on getting HR392 passed.
Btw, you said you offered proof of the changes that are coming. Did not catch that. Could you please elaborate?
