Had my interview today, took about 2 hours total. Standard questions, full legal name, DOB, spouse's DOB, date and place of marriage, parents names, addresses, employment history, how many passports did I have, how many visas, how many times did I enter the U.S. and in what status, what school did I go to. The officer also asked every single yes/ no question from the form which took a while.
I did not update my DL for a while and had a different address, which the officer asked about and said I should get a new license. He asked for originals for passports, birth certificates, marriage certificates, EAD cards, and an employment letter. In the end, he handed us the form saying the case is being held for review and we;ll get a letter if they require more documents. | |  |  |

That makes sense, it is not necessary easier or harder, it is just a different legal standard. I find NIW to be more subjective for various reasons, which makes it easier to make a legal argument without having to fit the facts into specific categories. That being said, if an attorney agreed to take your case for EB1-A, it is a good sign. Most large law firms that I know, i.e. Chen, will only take your case if it is easy for them and literally use the same cover letter template for every petition. | |  |  |

I find it hard to present evidence in a convincing manner in a 5-10 page letter, especially under a more stringent NYSDOT standard that was in place when this application was filed. Just judging by the credentials, I think they are sufficient so the issue has to be with the cover letter or/and LORs. Just my opinion | |  |  |

Unfortunately a lot of lawyers use the same exact cover letter for all the clients and just change minor details where appropriate and many of these letters have not been changed to reflect the new standard. This RFE sounds like it is asking for a letter specifically tailored to a new standard and how the evidence supports prongs 1 and 2. I do not know who was your lawyer on that but it might be worth seeking a second opinion if he/ she did not do a good job with the initial cover letter and evidence presentation. | |  |  |
