Given your credentials, your case will likely be denied even with additional letters, especially without a lawyer. I would start considering other options, e.g. employment based EB2.

Sounds like you graduated back in May so you would not be able to resubmit the application. 290B is for USCIS errors and would not do anything here either. Check with a reputable lawyer, they might be able to work with your DSO on other options.

That makes sense, it is not necessary easier or harder, it is just a different legal standard. I find NIW to be more subjective for various reasons, which makes it easier to make a legal argument without having to fit the facts into specific categories. That being said, if an attorney agreed to take your case for EB1-A, it is a good sign. Most large law firms that I know, i.e. Chen, will only take your case if it is easy for them and literally use the same cover letter template for every petition.

Get a lawyer who is experienced in employment-based immigration, it is a lot of work to prepare a strong petition and from the qualifications you listed, it sounds like you'll just be wasting your time and money doing it yourself.

I find it hard to present evidence in a convincing manner in a 5-10 page letter, especially under a more stringent NYSDOT standard that was in place when this application was filed. Just judging by the credentials, I think they are sufficient so the issue has to be with the cover letter or/and LORs. Just my opinion

Unfortunately a lot of lawyers use the same exact cover letter for all the clients and just change minor details where appropriate and many of these letters have not been changed to reflect the new standard. This RFE sounds like it is asking for a letter specifically tailored to a new standard and how the evidence supports prongs 1 and 2. I do not know who was your lawyer on that but it might be worth seeking a second opinion if he/ she did not do a good job with the initial cover letter and evidence presentation.
