Hope your friend knew that GC is based on country of birth and not citizenship. Even if he is an Australian citizen, his GC will be based on his country of birth which would be India. He will eventually get his US citizenship after many many many years like rest of us Indians.

Hi
If this kind of uncertainty(denial, troubles etc) keeps happening on around in US, then I've a feeling that this will collapse the Housing Market at some point of time.. Soon people from other countries will stop coming to US either for job or studies, as there is no point of wasting their time and money for no reason. Most of these people is/was coming here for their personal development,enhancing skills, lifestyle, money etc. but if it is not possible, then what is the point in coming here. -;)



Other countries will have no problem in coming here. As I read somewhere - 'A child that will be born in Greenland next year will get a GC faster than an Indian who is currently in US'. So people from India and maybe some from China will have issues coming here in the future. ;)

I always used to wonder, if this was supposed to happen wouldn't the democrats be against us? Worse, the whole Hispanic community will start hating us along with the millions of liberals. The only people who might applaud this are the whites in the deep south and even I don't think they would suddenly start welcoming us because we paid for the wall. All in all, this was a moronic and desperate move. The Indian community would be hated all along and alienated.

I as a potential immigrant who respects the law of the land where I want to immigrate will not be on the roads demanding for something which the country offers GC as a privilege.




So tomorrow or in coming days, if people really get on the roads which diverts attention to the desi plight and gets HR392 passed, will you decline your GC because it was not done under the radar which you wanted? That time you will have some other reason, right?

Guys who are in denial that h4 ead rescind wont happen - have a life, keep those self convincing funny arguments shared with family and friends in India. If you or your spouse are in H4 EAD have a Plan B. Good thing we got almost 1 year and based on trend DHS is not going to shut down that program immediately even TPS rescind they are giving 18 months. So for H4EAD DHS will be very careful, as they need to negate another Rule.I guess they need to follow a flawless rule making process and it can take 4/6 months or wishful thinking 2 years.

First step is it will be rule making plan published in NPRM and generally the department published the plan ahead of start of year and hence it will be in December or before the court they will have submission of their plan on January 2nd, which ever comes earlier.

I have been this country for quite a while, and back in 2012/13 I used to write blogs and H4 EAD was one of the topics and many trackitt freinds used to have updates on it. This is before even those Facebook pages even existed and many trackitt were following the blog. I shut down the blog in 2014 as it was too much time consuming.

Way back in December 2016 when Immigration Voice published that H4EAD will go away and the same was listed in one of Rules of 200 Obama Era Rules - Federation for American Immigration Reform(FAIR) recommended Trump and Ryan to rescind, the path was clear. That document was very commonly circulated in trackitt and some attorney blogs.

Despite Jeff Sessions confirmation, nothing changed and they were asking court for more time and over 8 months passed, so my mind also was getting a doubt like many of you that Companies would have cut a deal with Trump to save it. But October When DACA and TPS were getting rescind, the intent of DHS became very clear. They are going to announce rule making process with less fanfare and when people are not observing. Same was done for DACA rescind and TPS rescind for many countries so that media reporting is less.

The news about h4 ead rescind have got stronger from last week since many Attorneys have published the same, its common sense to think that they would have seen the draft leaked from their Attorneys friend working in USCIS /DHS. Even right wing websites like numbersusa, breitbart has published it. So Please dont be in denial, plan for worst case scenarios. This admin has become very smart after the Travel ban flop in January/February, they are doing without much hype. See all the USCIS rules/memo rescind/new memo which resulted in H1B mass RFE's they issued silently. I believe h4 ead rescind, we have easily 4-12 months probably we have get time same 2 years. Will they cancel existing H4EAD after the rule is enchanted etc , we will know only once Rule is published. Remember I140 EAD Rule not having EAD and compelling circumstances added,IV published in June 2015 and we came to know when Rule was published in November. My general observation is IV, Attorney blogs, certain news media like VOX are some good source of upcoming events as they get leaked info from their sources in adminstartion.

Let hope for the best, but there is no need to live in fools paradise and think that H4-EAD will be there for ever.

I don't know if you guys know this, whenever I change my address, I update in USCIS and along with that I register in USPS and register for their mail forwarding service. I give my forwarding address towards my new address. It costs a dollar for a year and whatever mail/package that comes to your old address will be diverted to your new address. USCIS always send it through USPS priority. You guys can check this out. It helped me get so many of my mails towards my old address diverted to my new place.

I can see a lot of confusion regarding the filing of perm and H1B max out. I will clarify since I have gone through this -

If your H1B is maxing out after 6 years and your perm labor and I-140 is not submitted till then, you will need to go back till it is approved, then file for a new H1B based on your I-140 and get it stamped. Technically the GC spoc is correct. You can file your perm after 6 years of H1B, but they are not telling you need to be out of the country.

Also if you are in the middle if the perm process and your H1B maxes out before 375 days, you will need to go back. If the perm process is pending for more than 365 days and your H1 Maxes out after that, you have the option for H1B extension since the perm has been pending for more than a year. That is why typically the perm needs to be submitted at least 18 months before the H1B max out so that there will be enough time in case of an audit etc.

Also nowadays it is a long process. Typically 7-8 months for perm and another 8+6 months(approximate) for I-140 and H1B (If it is not premium). You can speed up the I-140 and H1B by going premium. But labor process follows its own time.

Which location are you talking about? I just got a house last month. My mortgage is 100 dollars above the rent I was paying. Furniture for 50k? Were they made of gold? I got my furniture for 4K for my 2200 Sq ft home. The figures you quoted are way too high. By the way I am in mid west.
