Topic: H1b extension denied after RFE

RFE is very common these days. Every one is a FTE to some company, are you in EVC model or FTE to US company?

If you have solid documentation from your attorney then I think you should be good to go. It all depends on how your attorney is / will be responding to the RFE. So stay strong. Good luck!!!!

Topic: VISA Stamping-221(g)

Hi guys, I appeared for H1b visa interview yesterday (3/29) along with my spouse at chennai consulate. VO asked only 3 questions to me and said your visas are approved.

I checked the status, my (h1b) is in Issued status and my spouse (h4) in administrative processing. VO did not ask any question to my spouse during the interview.

Not sure when this will get resolved. Any help on this is appreciated.

1. No case number is different from case received. Say your employer started to create your perm today in icert site so you will get your case number as 18081-(random system generated number) and submits to DOL only during April. So your case will be considered only when April 2018 cases are processed. The date on which your perm submited to DOL is your PD.

So same PD can have cases from previous years also.

Did your employer applied for your PERM while you where in 5th year of your H1b? I believe (I might be wrong please validate with attorney) only if your Perm is applied before 365 days of your H1 expiry and you are still waiting for the result, then based on the applied PERM you can get 1 year extension

yes its true.. its called H1b out of cap extension. Google about it to know more info.

Mid of April your H1 is expiring, so you are looking at ~ 25 days, November perm is yet to start getting approvals, lets say even if you get your perm approval by first week of April, from there you have to wait for 5 days to get the perm hard copy. If your attorneys have already kept your I140 package ready, then you can file it right away otherwise some more time to prepare for I140 and if its Premium 15 days to get approval if it gets into RFE then its more issues. so its upto you to take a chance and see if all this can be resolved in 25 days.

I was in the same situation and I came back to india, got my perm, I140 and H1b approved.

I am FT with a american company and my job title is Program manager. This was my H1b out of cap Transfer + extension. My attorneys collected the expert opinion letters, they discussed with my HR and project manager for coming up with roles, job duties and percentage allocation.

They did not ask me for any documentation. It was completely taken care by the attorneys.

Wage Level - I think it should be 3 or 4. I did not get a chance to see the LCA. In my PERM the wage level was 4, so I am assuming it should be that.

guys I got the same RFE for my H1 transfer which was applied on Feb 12th in PP. Attorneys responded back to RFE and I got the approval today. Case was processed at CSC.

It will get through guys...dont give up your hope and make sure you dont trouble the attorney's. They are the best person to rely on...

hi, even I got the same RFE on my h1 transfer. I got the RFE on 2/26. I dont know when my attorney will be submitting the response...

I will keep you posted on my progress.. my soc is 151121 and wage level is 3. 13+ years experience and this is h1b transfer (out of cap extension) based on approved I 140.

Mine is H1 transfer- out of cap extension. I joined the company with my L2 EAD, got my perm and i140 approved and trying to get back to H1b.tomorrow will be the 12th day in premium.
