Topic: I140 revoked. Will it be reopened?

Employer can only withdraw I-140 and can not revoke it. Revoke is for USCIS in case of any fraudulence. Once the I140 is withdrawn, your employer has to start the process from Perm.

Hi, With the fact you stated that your I140 was approved 3 years ago and is still active, you can get your H1 transfer/extended any number of times until your priority date becomes current. Only thing you need to remember, your new employer should start your GC process from the beginning to be able to file your I485 once the priority date becomes current.

I797(Approval Copy) will have Priority Date and Beneficiary(Populated with A number different from Perm A number) populated but not I797C.
Perm details will be populated both on I797C and I797.

Topic: Advice please Salary change in I140

Hey One thing to be clear, You current salary is tied to the LCA filed during your H1 processing. I140 is to qualify the companies capability to pay you the PWD (PWD filed for your GC not for your H1B remember). As long as your company is capable of paying PWD once your dates become current and you get your green card, you dont need to worry about your salary with respect to I140. You just need to make sure your current salary is equal to or above the prevailing wage used for your H1B. If it is below, you would need an h1B amendment. Dont mix up your H1B prevailing wage with Perm PWD and get confused.

Hi, First thing, Employer can not revoke I140 but can with draw it. Revoke can be done only by USCIS for fraud and errors.

1. Employer can withdraw the approved I140 at anytime. If the withdrawal happens WITHIN 180 days of APPROVAL, you can not use that I140 for your H1 transfers/ extensions.

2. If the I140 is withdrawn post 180 days from the APPROVAL, you can still use the I140 for your H1 transfers/extensions but you can not file your I1485 for AOS. You need to have your GC process started all over again but you can port your priority date and use I140 for H1 extensions until you get your new i140 approved before you file for your I1485.

3. If USCIS revokes I140, you or your employer can no longer use it for your GC/H1 purposes.

I believe it is too late for you to file H1 extension with USCIS. You just have 2 days. Good part is you are eligible to apply for your H1 extension based on your approved I140(Cap Exempt). Consult your attorney for the pros and cons for post 22nd June 2017. This is not a legal advise.

Not a legal advice. I believe one has to to go home country for the very first H1 stamp. One of my friend came to US on L1B, Moved to H1B and his attorney said he has to go to India for H1B stamping.

I think it is not about discrimination. Immigration law distributed equal number of Visa numbers for each country. Due to heavy crowd from India, we got stuck in long line. Not sure when this wait gets over.

One of My friend's H1B extension is denied on 8th April for the same reason. His I94 was expired so he went back to India. He is waiting for his employer to file another H1 extension petition with his approved I140. He can come back only after H1 extension is approved and attend for VISA interview back in India.

Hi Sohail, I got my I140 approved through happy path, meaning no audits. My Perm was initiated(Started collecting documents) on 01/18/2016 and approved on 10/03/2016. My employer waited until 02/14/2017 to file my I140 to get the latest Tax documents. Attorney sent my I140 to USCIS in premium on 02/27/2017. USCIS received date 03/03/2017. I140 Approved on 03/14/2017. If there is no wait time for tax documents, if my I140 was submitted back in Oct 2016 in premimum as soon as my perm was approved, I would have gotten my I140 approved by 2nd week of November 2016(~total 11 Months). This might give an idea for you on the timings.

If the I140 is revoked with in 180 days of the approval, you can not use it for H1 extensions I guess. If your wife uses 6 years of her H1, she has to go through regular CAP.

1) No. Need a new H1B under CAP
2) yes I believe if her H1 is picked and approved with out the extension of Stay. If the new H1 gets approved with extension of stay, no need to exit.

1. Yes.
2. You will be okay until a decision is made on your H1 transfer. You can start working for your new employer as soon as the receipt number is generated for your H1 transfer. You can leagally work in US for 180 days once your transfer is filed.
3. 60 days grace period starts from the day the H1 transfer gets denied.
