Technically, H4 EAD will not be approved without H1 being approved. I have had my H4 EAD approved first followed by H1 and H4 applications in a time span of 2 days in between.

Hold on tight you should have all the approvals soon.

I second you on this. Though this is a priority bill for many of us but not for Congress. It will eventually added to another bill related to immigration and should pass hopefully this year.

Topic: H4 EAD USCIS Receipt

As of yesterday, I 765 status says "New Card has Been Produced" but H1B & I-539 are still in process. I would expect the status to be updated today/tomorrow for those as well. Anyone in similar situation where EAD is approved but H1 & H4 are in processing?

You are good to go. H4 EAD will not be revoked because you changed employers and started your GC again. I'm in the same boat as you are.

Topic: FI - H4 and H4 EAD applied on Jan 31 2017, cases still pending

Historically, it is taking about 4-5 months to be done with H4 COS and they will adjudicate EAD along with that.

Topic: Can I-140 get denied due to RFE in H1b-Amendment

Remember, GC is future employment. By the time your dates come current, you might as well change jobs and do whatever provided you file a labor.

RFE on your I 797 will not have any impact to your approved I 140. Breathe free and enjoy!

Remember the retention rule became effective Jan 17th 2017. Your employer can no longer cancel your I140 if it has been 180 days since approval. You are good to go!

Topic: Transfering H1

I almost fall within the same time line as yours. You will not lose your PD irrespective of your move now or after Jan 18th when the new role is effective. The only advantage if you moved is that your employer can never revoke/withdraw your I140. I assume that you used your existing I140 and got 3 years extension.

Why would you tell them that you are not going back?
If not going back, why do you need dates so soon?
