Topic: June VB Predictions

Correct, in Jan-2018 PI they have shown the pending I485s until Dec-2017 for EB2I..... (Interview process was announced in Oct 2017... I guess).....

Now they have removed all of them from March 2017..... Not sure, if having interviews will make them disappear from the list is correct assumption....... I may be wrong ..... I assume it might be system glitch...

I guess, I485 will be filed along with EAD/AP when the dates are current,,,, and then they will be called for interview, am I right?

If your assumption is right, then why did Jan-2018 pending inventory showed EB1I data until Dec-2017?

Topic: Any hope for PD 2012

you are right, China with very less PERMS being filed compared to India... is still backlogged ... of about 4 years....

I'm trying to tell that... the numbers you put are real.. but not all numbers (of 2010 or 2011) will have the priority date of 2010 or 2011 ... that's all...I was trying to convey...

"total perm in 2010 from indian origin people 28930
and in year 2011 its 31273"
------

The numbers 28930 in 2010, and 31273 in 2011 are nothing but total Indian PERMs that have been adjudicated/approved.
But the priority date of the PERM (approved in 2010 calander year) can be from 2009, 2008 , 2007 or even earlier......

Note: PERM filed in 2010 Dec can be approved in any of the following years.... (like in 2011, or 2012 or 2013)
note: If a PERM is randomly selected for an audit, it may take few years to get adjudicated...

To get a total list of PERMs filed in 2010 for Indian applicants... see below...

try taking a look at this sheet....try going through all sheets in the google doc....

"The biggest EB1C usage was in 2004."
I think below is the link

https://travel.state.gov/content/dam/visas/Stati...

in 2004, only around 3K visas got allocated to whole EB1.(Including EB1C).

This PDF was created in 2006 and was talking about L1B abuse (if exists) in general. Not really about EB1C issue.

Usage in EB1C increased drastically from 2011 on wards .... Note: not all Eb1C cases are fraud/abused....

Ans:
1) Yes
2)Cap Exempt. (Doesn't come under cap)
3) H1B recapture is not needed in this case, as you are eligible for 3yr extension provided you meet all documentary requirements.

There is a high chance for EB2-I to reach End of April 2009 by Sep 2018 with good spill over (if total gets to 7K+),

Based on the assumption that: in 2014 last quarter.. 4000 cases of 2009 got GC approval ....

Topic: Time to unite - stop discussing about RHC and IV

There is a concept called 'Confuse" if you "cannot convince". That what is happening... now....

"HR-392 alone", itself has a slim chance to become a law.

On top of that ... if we think.. we better get X, Y Z things also done ..... to clear all backlogs.... that's a sure shot to confuse and make sure that "NOTHING" is gonna get materialized........ (better not be over ambitious..)

"India has signed a totalization agreement with the USA.",

The day INDIA enters "TOTALIZATION" agreement, then BACKLOGS will automatically be cleared with immediate effect....... :) just a wishful thought....

As per pending Inventory 2008 EB2I still has around 8000 pending cases...(not getting into the details of if that number is true or not, but personally I believe so.. as per my data sheet),

But, not all will be getting GC as some cases may take more time to get adjudicated/processed.... assume if we get good spill over and at the end, if EB2I get a total of 7000-8000 visas then dates will reach March 2009...by Sep 2018. (because: there were around 4000 2009 Q1 cases that were cleared in 2014 Aug-sep timeframe... )

see this sheet for more details:

I mean, USCIS can still call for Interview the folks who have filed their I485 before March 6 2017. But that will be very less in number.

But for folks who are filing I485 after March 6th 2017, "Interview" is mandatory for everyone.

"Interview" requirement is made mandatory for folks who has filed I485 after Mar 6th 2017, it was optional (means not all will be called for interview) for the folks who has filed I485 before March 6th 2017.

This is another wishful thinking by the author..

Slow down will happen across the board.... because of the "Interviews"...

If the demand in ROW is less because of interviews, then there will be decent (not very much) spill over to EB2 & EB3 I, and dates will move little further... (as EB2I folks don't need Interviews) and also because "to build up the inventory"... but not to the dates (dec 2011) as mentioned in the article....

but by next year demand across the board will sync up as the 'I485 interview' process will be stream lined...... for all...

If ROW demand is generally decreased because of restrictive policies... then there is a good chance that EB2&EB3I will move at a decent pace...from next year.... not this year summer....
