I agree he should have not used that language, doing such he is only distancing from his allies and creating more hatred upon himself and his party, not good
But he is also advocating merit based system, favoring people who obey laws and waiting in lines from ages. Here is the white house brief, check last line

It depends on case by case.. for me only concern is, i have kids who are born and brought up here and it will be a huge change for them ,they only know this country and culture till now and are very happy.If it goes well and they get to enjoy and have a good education in india i will be ok , i am only worries what if not

Totally agree with you. I was in favor of DEM until recent election ..felt bad they lost it.... but slowly realized they are worse than REP ... just bcoz they talk something and do totally different and make Legals as a face of the issue and do nothing for them ultimately

Guyz please cool down... its sad H1b is becoming such a nightmare day by day. We all came to usa for one purpose to have a better life and give good future for our family.We are quiet community who work silently and obey rules and its sad we are in major focus all the time when it comes to immigration or politics.
This discussion forums alone generating lot of information about our flaws and diversity, i dont think it happen ..just assume if someone in uscis just go through these discussions, they dont need any research on how to screw us.
I hope we all will get some good news but lets prepare for worse and move on

Topic: H4 Extension (I 539 petition)processing time

Any one in the same situation , my h1b and spouse h4 were applied in premium on Mar 20,2017 at Nebraska Center.
H1B was approved on April 3rd, so far no news on H4 approval. Only update i received for h4 is receipt notice.
I was following notes on H1B tracker , certain H4's applied on Apr/May got approved, not sure how the applications are being processed,it looks like a random order to me

Have to see how the salary limit becomes applicable for states. For example keeping 110k limit in california vs keeping 110k limit in states like MS,NC,TN,SC,FL etc will be different i think.

According to new rule if our 140 stays valid ..lets say next govt restart h1b policy..can we file h1 from india using approved 140..or may be if dates are current concurrently file 485 using approved 140

Any one knows what this means to us ,
The Department of Homeland Security (DHS) amended its regulations today to improve the programs serving the H-1B1, E-3 and CW-1 nonimmigrant classifications and the EB-1 immigrant classification, and remove unnecessary hurdles that place such workers at a disadvantage when compared to similarly situated workers in other visa classifications.

This final rule, posted to the Federal Register today and effective on Feb. 16, revises regulations affecting highly skilled workers in the nonimmigrant classifications for specialty occupations from Chile, Singapore (H-1B1) and Australia (E-3); the immigrant classification for employment-based first preference (EB-1) outstanding professors and researchers; and nonimmigrant workers in the Commonwealth of the Northern Mariana Islands (CNMI)-Only Transitional Worker (CW-1) classification.

Specifically, this final rule amends DHS regulations as described below:

DHS is including H-1B1 and principal E-3 classifications in the list of classes of foreign nationals authorized for employment incident to status with a specific employer. This means that H-1B1 and principal E-3 nonimmigrants are allowed to work for the sponsoring employer without having to separately apply for employment authorization.
DHS is authorizing continued employment with the same employer for up to 240 days for H-1B1 and principal E-3 nonimmigrants whose status has expired while their employer’s timely filed extension of stay request remains pending.
DHS is providing this same continued employment authorization for CW-1 nonimmigrants whose status has expired while their employer’s timely filed Form I-129CW, Petition for a CNMI-Only Nonimmigrant Transitional Worker, request for an extension of stay remains pending.
Existing regulations on the filing procedures for extensions of stay and change of status requests now include principal E-3 and H-1B1 nonimmigrant classifications.
Employers petitioning for EB-1 outstanding professors and researchers may now submit initial evidence comparable to the other forms of evidence already listed in 8 CFR 204.5(i)(3)(i), much like certain employment-based immigrant categories that already allow for submission of comparable evidence.

This final rule does not impose any additional costs on employers, workers or any governmental entity. Further, changing the employment authorization regulations for H-1B1 and E-3 nonimmigrants makes them consistent with other similarly situated nonimmigrant worker classifications. Additionally, this rule minimizes the potential of employment disruptions for U.S. employers of H-1B1, E-3 and CW-1 nonimmigrant workers. Finally, DHS expects that this change will help U.S. employers recruit EB-1 outstanding professors and researchers by expanding the range of evidence that U.S. employers may provide to support their petitions.

“We constantly strive to improve our processes and ensure fair and consistent access to immigration benefits,” U.S. Citizenship and Immigration Services Director León Rodríguez said. “This Enhancing Opportunities rule removes unnecessary hurdles that place workers at a disadvantage and will be beneficial to both employers and their workers.”

Friends couple of quick questions,
why can't we reach to opt folks and request them to help us reach 100k goal. They are future I-140 beneficiaries correct and this will benefit with outcome of this rule in long run.I am not sure if they are already aware of this , if not we can educate them to help us.I believe if we fight with unity we can accomplish this.
Also another idea, this has nothing to do with these petitions though.
Can we understand the standing of DJ Trump with his immigration policy and with respect to people who came here legally.
- Does his birthright stance applicable to people who are born to legals.
Since the presidential debate is coming soon and certain questions for debate are picked from social media can we check what republicans (specifically DJ trump) are thinking of.If we all can post on social media i am sure the question will be definitely popular and will be answered.The reason why i am thinking like this is , so far all reporters are only asking about illegals, why can't we make them aware of this

when i checked at 12PM EST, but they delivered as scheduled after 1PM .May be check your status now.
Only difference i did was i asked for signature confirmation and thats how usps updated the tracking to delivered and received by USCIS personal
