i wish all the legal "experts" on this forum go through what a "Precedent" is, a legal precedent doesn't care if previously million people were affected and now only 10 people were affected.

Anything which were previously discussed and ruled as legal becomes precedent to the next case on the same basis.

Read up kids, if DACA was ruled illegal to revoke by courts, the same precedent will be set for H4 EAD lawsuits, because court has already discussed on the legality of DHS authority. The precedent is already set by DACA court cases.

BAHA is campaign BS, it won't stand in court....

There is no way DHS can claim that 100k H4 EAD's (out of which not everyone would be working) is affecting US citizens, the lawyers will counter argue how OPT/Asylum EAD/OPT EAD and many others are not affecting US citizens.

The lawyers can also argue what happens when these H4's eventually get greencard once their date is current, what would happen to the US citizens in that case....

and calling reps will help how? Dreamers attacked almost every single congressman in hundreds of thousands, and got nothing....only thing that happened for them is court hold up on Trump admins rescinding the rule....

Court needs reasons to for any decision....

BAHA is bullcr@p, there is no legal basis for BAHA, on the same lines every single visa can be stopped......why does US need immigrants ....

Such BS won't stand in court.....they have no way to prove H4 EAD's are actually affecting US Citizens, even if they do, the same argument can be used in court why DACA is blocked yet....

USCIS is looking for any loopholes they can use to rescind H4 EAD, this is why courts are in place to keep rouge govt in check,.....

i am all ready with popcorn to see this unfold.....makes life much more interesting haha

vijay i thought u are better than this buddy! Nobody gives a rats a$$ about comments....ever heard about net neutrality? pretty much the entire country was against revoking it.....over a million comments mostly asking the admin not to revoke net neutrality....

Trump admin went ahead and revoked it anyway to keep verizon /comcast AT&T happy.....

People do care about H4 EAD, companies/people will be affected.....lawsuit is the only way to block H4 EAD rescinding..... everyone affected should crowd fund lawsuits specially from west coast eight circuit courts.....

Don't waste your time trying to justify with comments....no one cares, instead at least donate what u can for crowd sourced lawsuits.....there are many serious businesses like Baubaux which will be affected.....so lawsuits is the way to go...

but lot of trolls, jealous uncleji's who can't stand other successful desi families, sexist desi uncleji's who can't accept a successful desi women in workforce have been bickering about H4 EAD for the past few weeks....

they need their own dose of trolling to keep them occupied....

I don't see how many of you guys are absolutely 'top notch' as you claim when you don't know the difference between
'average' and 'median'.
Also this report compiles overall sectoral salaries and not H1B which I suspect would be lower.

Finally, those demanding a 150K floor for an entry level h1b position are strangely silent about the 000's of fraudulent EB1C applications filed at 70 grand a year..




unfortunately the EB1c's making 70k may look as fraud to us, but not to USCIS as it is within the USCIS guidelines for EB1c eligibility.

and only congress can change EB1C rules, it is the law of the land......we all know how reluctant the congress is regarding changing any immigration rules.

What i say is, if u can't beat them....join them......try to file under EB1c rather than complain about them.....it is not going anywhere...

just because many save 120k doesn't mean all 85k H1's every year will save the same amount...

Only around 10k of the 85k annual H1b's break the 100k barrier....and not all of the H1 spouse works.....many are simply not interested.

No one is saying all H1's are paid low.....but majority of them are paid less....

What will happen

1. Agree they will take a good amount of money to India, but from whre you got this 300K USD saving? This is an unbelievable number .
2. 10% may take their jobs with them, others will be in the job market , which will hurt the demand- supply proposition , reducing salary for all. If osshore business improves then it will be compensated.
3. Unemployment rate in india wil hit a high.




buddy, 300k is peanuts......myself and my family are high spenders and to most part careless with money, yet we have managed to save well over this amount.

I know personally many desis on H1 who save minimum 120k/yr....you do the math what happens over a period of 10yrs,.....of course they are smart enough not to just keep them all in cash at 1.5% interest, they have diversified and invested in right places.....but that's what they will take back to India if trump kicks them out.....

like the other post said, this may be a tiny fraction of money for the US economy, but for India this is a good amount of cash flow...

this is what i have been saying....people ranting about EB1c abuse/H4 EAD are all just frustrated sitting in the queue for decades.....

Instead of fixing the root cause, blaming the effects doesn't make sense...if wage requirement for EB1/H1 are set to the right levels, we would not be in this situation, companies would either hire directly as FTE or offshore low end work.....

So the folks who survive will earn more and possibly also reduce the backlogs...

yes, my good friend recently bought a single family home for 1.4MM in santa clara area.....its a good sized home but very old (build in 1960s)..although 1.4MM is a lot of $$ i guess it is still a good investment for the location....

Downtown would be something way more....

This is coming from me: Someone who was on H1B for a decade or so and is surrounded by H1Bs all around in work place. I work for a big MNCs with 100 billion dollar market cap.
My company hires H1Bs big time and pays them what they pay to Americans. So, H1Bs are not cheaper. On top of the equivalent salary, you'd need to pay for immigration expense as well ( H1Bs, lawyers, gc processing ) But the managers in my company ( all desis ) prefer to hire H1Bs ( mainly Indians ) because of these reasons:

1) Indians on H1B once hired are forced to work for a given company for a decade or so because of green card backlog.
2) This makes them a pliant and willing work force i.e indentured workdorce
3) Thus, they'd happily work even on weekends, many putting in 60+ hours/work without any complain.
4) Although their salaries are same as what Americans would get, if you consider long hours they put in, they are still cheaper on per hour basis.
5) If not all, but most of the H1Bs don't belong to so called 'specialty occupation" category.
6) For the above reasons, Indians on H1Bs are favorite employees for employers. ( i.e. cheap and compliant technical work force who would be with company for a decade or so ).
7) For the same reason, you'd see big MNCs lobbying to increase H1Bs visas but would never ask to reform the broken Green card Process

The intent of H1B was good for 'speciality occupation' but now it is synonym with cheap technical indentured workforce.





Finally someone has summarized better than me and explained why/how H1 is bringing down wages directly or indirectly!

On the same lines, our very own desi CEO's ...u hear pichai/nadella being vocal about DACA but not a word about GC backlogs ever....indentured workforce is the backbone of these tech giants.

On the books google may apply for 700-1000 H1's only in a year and pay comparable $$$ to US citizens, but they also hire a huge chunk of H1 BA's/testers/PM's from consulting companies for much lower wages....

If you hire a H1, you don't need to pay costly 401k benefits/free healthcare/stock options.....so all of this saves a ton of money for google....this is just one example....

For Google FTE's stock options are most of the time a huge chunk of their pay.....over a period of 5yrs, you earn significant $$$ in stock options which is almost equivalent of your annual $$, they don't need to pay any of this to H1 consultants....

then explain me how most of the companies are posting record breaking quarterly earnings? Since they are struggling to fill positions they must not be doing so well i guess?

Even now high skilled programmers can earn 250/hr, that's exactly my point....then why do we need so called high skilled folks on H1 working for 40-70/hr? does it mean they are not so highly skilled?

You appear to agree on my points but yet come to a different conclusion.....

I know application development is not easy either. But what % of H1's are actually even doing application development?

I work directly as FTE for one of the largest US companies by marketcap , almost all of our operations/Dev Ops/Production suport/BA's/testers/PM's are from outsourcing firms on H1.....we have folks mostly from Infosys/TCS/Upma consultancies even Deloitte in the high end of business consulting.

None of these are actually application development and don't necessarily need "high skilled" immigrants, the only reason company hires them is because they can hire them cheap and hire/fire at will....in most cases client pays around 100k(infosys keeps 25k and pays 75k to the employee).

I have spoken to many employees/account managers so i know how things work, there is also large scale corruption at high levels where senior desi managers within my company get kickbacks for deals with outsourcing firms......end of the day H1 is being abused at the cost of US citizens and wage suppression in IT.
