It takes less time to contribute to an organization like IV(without any money) rather than wasting time and explaining each other over here. They atleast have a plan and they are fighting against all odds without losing hope. At the back of mind all of us coming to forum everyday know that we know nothing about what is going on in the white house still we keep on wasting time to argue over here explaining with detailed posts. Only trackitt is making more money here with their ads and traffic and you continue to read the posts being addictive as if some good news will come from somewhere.

I didnt like IV myself earlier due to their rude behavior but I have started to understand that they definitely value their time and energy and channelize it for constructive work rather than reading media BS. Even if HR 392 doesnt work, educated people that are engaged could find something fruitful. If you waste time on these forums, you are not valuing your own time and effort and hard work to reach here in US.

Well you do need to file PERM/I140 for getting EAD/GC in future or when your date is close to current. If you change jobs currently, you are forced to do PERM/I140 again so that you can keep on extending your H1b. With new rule, you can officially use old employer' I140 to keep on renewing which uptil now was a gray area, some people were able to sneak in and many were denied as well to use old employer' I140 for renewals. Now you have confidence to keep jumping till your date becomes current without going through PERM/I140 at every place you work at. I am not looking to do PERM/I140 at my new job now and will only request that when my date is close to current.

Given a choice, I think 3-year H1B renewal is much better than 1-year EAD extensions many of my friends have to go with but I understand everyone' situation is different.

If you think calmly, you can use I-140 similar to EAD i.e. u can change jobs whenever and how many times you want using old I-140 and renew your H1B status. Isn't that what people do when they get EAD while waiting for GC? You also have 60 days incase u get laid off ever. When your priority date comes to current, you can get GC.

It seems people are disappointed that they have to do PERM/I-140 again but actually you don't need to do it at all till ur date is near to current. You approved I-140 after 180 days in a way becomes your EAD and ticket to remain in US till your date becomes current. I think it is a big win for job mobility.

I feel that would be the case as well, thats why we have this whole new concept of Supplement Form J which will make new employer kind of justify the availability of position at new workplace similar to position for which PERM was filed by old employer.

It will be extremely confusing if people leave their current jobs in the name of portability and then Congress decides to override whatever Obama is giving right now in 2015. I feel better to have something but have mixed feelings about all this.

I have I-140 approved and my H1B will expire this year(completing 6 years). My current employer is going to file H1B extension for me but I was looking to change my job. I had a couple of questions and would appreciate if someone could answer it:

1) Right now I am a software engineer, can I join my new job as a manager? My new employer will obviously have to file PERM and I140 again but was wondering if I can jump into manager role with my current I140 which was given to me for a role of software engineer.

2) If I leave the country before my new employer files PERM and I140 for me, will that be a problem? Because I will have to come back with a visa stamp once I leave the country.

My company says that they dont give copy of I140 to the people unless they leave the company. Do any of you have any suggestions how to ask for I140 copy from the company? Is it legal for company to not give my document to me?

I think instead of overly popularizing this rule, it would be better to downplay it by saying that there is nothing new or revolutionary in this. L1 visa holders have always had dependents with EAD. With this rule, there will be more consistency in dependent rights for both L1 and H1 visa holders. It has got more chances of passing with downplaying it rather than making it a centre of attention.

If an H1B employee with I-140 approved leaves the job, that employee will not have I-140 approved from the new company till his PERM and I-140 are re-applied by the new company.

Will the dependent H4 visa holder loose the job at that time or does it mean H1B employees will now have to remain stuck with the same company till gc is in hands. Thoughts?

Hello board,

I got my PERM approved. But my job title has changed due to my promotion like Software Engineer 2 to Software Engineer 3 and my salary has also increased. When filing out I140, should I mention my old job title and old salary or it is fine to mention the new job title and new salary.

Is there any issue with this?

It looks like we might already be processing May cases. Most people here are telling that A numbers may not be real PD.
So A numbers with dates like 4/24 or 4/25 might also be cases with May PD that are being processed.
