Ill take the 34000 per category any day over the 4000, wont you?

The whole calculation is based on assuming 85% as a whole for EB2\EB3I i guess which is why you are saying 34k. But should be 85% for EB2I & 85% for EB3I max which totals 68k (hoping i got this right - "not more than 85% of EB-2 and EB-3 visas for natives of a single country: 85% of EB2 and EB3 is 85% of 80,000 (40k EB2 + 40k EB3))

The backlogs wont vanish in a couple of years but at least it will be fair and ONE waiting line for everyone. ROW might say its unjust. Bring it on - 1st amendment is there for everyone)

Reading through - i just had to comment

i can describe you in 2 words -

"uneducated literate"

Whats the use of 2 Masters degrees when you cannot be mindful of what you are saying - irrespective of you being dude or dudess. Money can buy the dog but can never make the dog's tail wag - as in you can be rich but it can't make be cultured.

AI is definitely a priority for people who were born without the I - good job on that.

Anyways, i sincerely hope the guys\gals in the forum save their energy by ignoring your comments.

If you don't like the comments - ignore\ move on. next time, don't attach your returns and p stub for the sake of sounding superior.

I have no more cards to play. the coin has 2 sides.

I consider this bill common sense. You may argue that its not and favors one specific country. We all have our opinions.

There should be no place for diversity in EB immigrant petition when you dont restrict EB non immigrant petitons by diversity.

The spouse and kids shouldn't be counted against EB numbers (i dont know where else to account for them - should be EBD1 / EBD2 / EBD3 - emp based dependents)

Freeze new applications when the queue reaches a certain limit or there should be freedom of movement after 140 is approved.

The current system awards way more than 50% of Non immigrant visas to Indians. It is only logical to give freedom of movement. This alone is a big cause for stagnation of wages.

Its not the wait that's bothering most of us, at least not me.

Every country is capped at 7% - no doubt.

We are not bothered about the wait but you guys are missing the point.

Im ok with country CAP. But then when you (as in USCIS) say you are qualified but wait for 10+ years and tied to the employer - its a mess.

Give the folks freedom of movement by issuing an EAD. I don't care when i get my GC as long as im in my queue and assured of it.
all i want is -
1. EAD (to switch employers which will otherwise stagnate the wages)
2. allow 140 approved guys to switch without having to redo the paperwork if #1 is not doable
3. Lets us move freely back and forth atleast to the home country. (in a 20 days vacation every alternate year - 4 days go in flying, 2 days just for the biometrics and stamping. This way we can fly more - generating more revenue to the airlines which is $$$$ floated in the market - im talking $7k a year)

Alternative is to remove country CAP and let everyone else come in same queue so there is meaningful wait for everyone. There is no point in making diversity argument in employment category. The resource India has in abundance is Human resource and so you will see us take a leap to wherever they can possibly.

you have my sympathies and your frustration is justifiable in your own respects. And i cannot stress enough that you are missing the point.

There is always a demand and supply. The companies demand and India supplies. Any other country has so many engineering colleges? Any other country has the kind of population in the 20-40 years of age group like India?

You seem to be scientist material :-) India needs you and your patents but you chose to shun and strive to be here.

Just because some people work in WITCH doesn't mean they all write sql queries. We only have so many EB categories and the people who apply qualify for the outlined requirements. You should advocate for separate category, say EB10, we are OK.

The whole point is treat everybody equal - 2 janitors from Srilanka and India who apply for EBx category should come in line and get the credit based on who came first. We are not talking about the profession itself but how the queue is managed. This is common sense.

My colleague and a good friend from Bangladesh who filed his EB3 application got his GC in less than a year. While a cardiac surgeon from India is still waiting for his priority date and it has been 8+ years. You are arguing that because the queue is full of WITCH emps. The former is single, while our surgeon has 3 kids - luckily all citizens - otherwise 5 visa numbers would have gone along with him.

I say flush the line, so everybody waits and then there will be broader audience.

We don't see onsite Australian engineers, UK onsite engineers from WITCH is far from reality and i have living evidence. And to add to it none of the countries you say has 1 billion heads except China and they are also in line - not just as much as us.

Now, i can wake you up if you are sleeping but if you are acting like sleeping, then nobody can wake you if you don't want to wake up.

Green card is a privilege and not a right. You were fortunate enough to pursue PhD, good for you! Not everybody is fortunate enough like you. Does that mean we have .3 KG less brain?

You knew what you are signing up for!!! We can discuss this over beer if you want to :-)

And as for skills, you can pitch me any day against my counterparts in the area of tech and you can see why i qualify for the category.

Like i said - You, my friend, should not be in EB2 but EB1.75. pun unintentional.

Its the system and we cant change it.
Changes are on the Horizon and i have no problem going back to where i came from when i want or asked.

It is what it is. I understand the pain we are on the same boat but cant help you. You are entitled to your opinions and so am i - half freedom of speech baby!!!

You could have been the brain behind the first iconic iPhone but USCIS doesn't see your skills as qualifying enough for EB1 or EB1.45.

I think that you do qualify for EB1.75 which gives you an edge over us EB2\3 with respect to job. BUT USCIS rounds off to nearest whole number...which is why you end up with EB2.0 :-)

Good Luck!! If you can somehow magically get ahead of us, we are happy - good riddance - you guys drag us all down by fighting within instead of fighting for a common cause.

Having a PHD, postdoc etc, i would like to assume you have common sense. How does spouse and kids qualify for EB visas? does that make any sense - just that will solve most of the problem.

But if you want to blame it on WITCH and take comfort in it, please do so. Wasted emotions !! :-)

The opportunity is for everybody's taking. You say gaming the system- could be, may be - but you are generalizing here.

"So h**k yeah I would be mad!" -- ?????? I think you are already there. Not that my opinion matters anyway. You probably know that - the former, the latter and/or both :-)

You can argue about changing the qualification criteria - I'm with you there but FCFS should be the norm.

This bill is NOT promoting immigration but restricts discrimination, restricts employer abuse, levels the playing field, creates direct\indirect jobs (buying homes, startups, investments)

Without a meaningful wait time, there is no way i'm risking my $$$$. Most folks, for the same reason, have probably been withholding $$$$$ & $$$$$$.

Gone are the days when there were politicians who stood for what is right, who saw this Politics as Serving this great country and the people. Now politics is a career - its not service to country or the people anymore.

Look at Alabama Governor.

The realization is happening at snail's pace that this country is heading towards what we are running away from - Bad Governance, Corruption, inequality, discrimination, caste system, racism.

Americans are smart generally and i plead to them to stop watching the news, which is twisted to make the people think and see what these news medias want you to think and see. Time for David to take on the Goliath.

We are nobody - meager 100K out of the 330 Millions. We wait, patiently - the Gandhian way :-)

That's the problem. You see this country is all about individualism\capitalism. We, on the other hand, semi-socialist\collectivism.

I'm sure most of us want to take some action, but we are always like - we can't do if we don't have a big group, you-go first - we will follow, lets go in groups, no money.

How many of the active posters tweeted - that guy has been crying for all of us together for ages.

Start small. May be other folks like arc99, who don't share the optimism of this thought, want to follow if this gets the slightest attention.

There are many ways to attract attention -

1. Run a marathon like BOSTON,Newyork, chicago with "Just 10 YRS AWAY from MY GreenCard" or some thing like that
(we will need more people - bigger the crowd - the better)

2. An individual can do a 100 mile walk with above to create awareness - lol

3. Volunteer with the same logo tshirt

one T-shirt many ideas. Lighten up and think out of the box folks.

Send a $10 bill to Washington to be adjusted against your share of federal debt (i.e if you were to become a citizen, BTW the US national debt works out approx $60000 per individual - how sure how close this figure is)
