Topic: Will H1B fall under its own weight?

Quite Likely, Already H-1B are replacing ex H-1Bs (now GCs and American citizens). If the wait gets longer, maybe long time H1Bs would also come under the chopping block.

Topic: Hard H1 rules coming now

The terms "highly-skilled" and "best-and-brightest" should be used carefully. And because it was used fuzzily, we have got into this mess (most probably, intentionally). I am not saying developing business process automation is easy but then so is being a car mechanic... You will never get a H-1B if you say you are a car mechanic... Big business lumped everything into the "highly skilled" category to ensure mass H-1B and hence reduced cost. On other hand, developing software at Google or Apple needs serious amount of specialized computer science knowledge which requires lots of education and study. BTW: I am not at Google or Apple...

I think we know the problem: Calling IT as "highly-skilled" is kind of a stretch., Actual s/w development (say Apple, Google, etc) is in that category. It was a good PR move earlier, but now everyone knows where IT stands.

In Canada, are IT Layoffs common? If so, is it possible to get another job quickly? That is a problem in European countries - if you get laid off, too hard to find a new one. But on the other hand, layoffs are much less common that the US

Why would even congress pass bill to remove per country cap? It's not urgent for them, no one is getting deported like DACA kids and Indians who are voters here don't bother if fellow Indian immigrants are stuck in long queue, unlike Latinos who are big in number of registered voters and do care of their fellow illegal community.



The main reason for lack of interest is that HR392 benefits just ONE country - India! And the reason the backlog is because we have FLOODED the system. If 75% of H-1Bs are from India, it clearly cannot be about "best and brightest"

But that is voluntary return not forced due to H-1B denial of extension .. As I said, I dont think anyone (or very few) actually returned to India because of denial. People can always find some other way to remain (or come back from India), or move to Canada!! It is just the fear which is debilitating.. the truth is different.

I dont have exact data but I think the number returned to India for good due to H-1B denial is close to zero or negligible. Ther ei s always a way to stay or come back in some way.

"if ur gc pd > 2009 - chances are u will be denied before u get gc" Is there a basis behind that statement, some article or new policy? or are you making a general statement based on current trend?



Observations from diff posts. I am 2014 PD so been following h1b trends diligantly. also from my observations in murthy fourms and immihelps. things are very dire. its closer to home for me since my neighbor was h1b and he got stuck in the situation and has gone back to india for good. he was a bachelor so wasnt hard for him to relocate.



Going back earlier is much easier to handle, both personally and professionally. Almost impossible ot get a job in India even after a few years of experience, Also, easier to settle down.

Topic: H.R. 392, Fairness for High Skilled Immigrants Act

For this year, HR 392 is not going to come up because of the mid term elections. No blll of this magnitude will be discussed. Hopefully, it gets reintroduced in the next congress next Jan, but there are many more unknowns now!! Yoder may be out in Kansas!! The entire Congress may be different along with senate. Also, Republicans may not be in power in one o both bodies. So too many unknowns after this.

it is not just fresh H-1B, H-1B extensions are also being rejected at very high rate. The number of approvals was 1,97,129 and number of applications received was 3,36,137. Nearly 58% approval. Of course it includes all countries, but Indians are by far the largest number of H-1B applications.

Guys,
Its big game and its my opinion..
1. Right now they dont want to solve the H1 gc backlog issue.
2. if they revoke the H4 ead then there is media hype / pressure to clear to gc backlog.
3. h4 ead will not go anywhere.
4. h1 gc backlog will be in loop.(no solution)....


My feeling is that all the USCIS wants to do is keep hammering away at the H-1B applications. Keep reducing the H-1B population by making them go back mostly to India. Apparently the H-1B acceptance rate in 2017 was just 58% compared to 2016 when it is 84%. This year will be even low and thus the H-1B population will keep falling. Automatically, H-4 and backlog issue will also get resolved. we are going back to the early 2000 days when there was no backlog and H-1b population was small before the massive Indian influx.
