As long it's making progress, you should be good. Case was transferred to NBC means, you'll hear about interview next. "The NBC’s primary mission is to prepare applications for adjudication that require an interview at a USCIS Field Office". My case may not go to NBC as it is "believed" that they had mandated I-485 interviews ONLY for those with PD after 03/06/17 and mine is 02/09/17. But you never know, they can still call me in. I am awaiting my I-485 RFE for expired medicals and have applied for EAD + AP renewals. Trying to maintain my calm in my second retrogression :). Hope you hear from them soon!

Yes, mine got approved on 03/19/18. Concurrent filing on 02/09/17, took 403 days for them to adjudicate I-140, no RFEs though, more details in my profile.

Congratulations on I-140 approval UK2USAGC! Yes, the approval notices are sent out to employer and attorney. Also, yes, now lookout for the interview notice for your I-1485 adjudication, since you're not from India, it should be before 10/01/18 though.

Hi,

This is one of their cookie-cutter responses, if I remember correctly, this was the response to my first SR, in their next SR, they mentioned I should hear from them in 60 days, which obviously not the case, it was only after 3rd SR raised, they processed my case, it took 403 days for my I-140 adjudication. Rule of thumb is wait for 60 days from the date they responded your SR, otherwise they may just respond to reach out after 60 days. Hope you get adjudicated before that! Good luck!!

Congratulations on your I-140 approval! I am sure, it would have brought lot of relief :-) Yeah, seems they have stopped updating the USCIS case status website, my visa extension got approved in July 2017, the status on USCIS case status still shows pending!

You're welcome, it typically takes somewhere between 3 to 10 days for any snail-mail communication from USCIS. Yes, attorney & employer would receive RFE notice, they may or may not share all details about RFE to you, at times USCIS has more questions about the employer's paper work than the beneficiary, I suggest that you insist strongly on having a copy of RFE, so you are on top of things. Good luck, I hope that there isn't anything major and straightened out soon.

Julie, here are the common RFE reasons for I-140:

1. US Employer & Employer's Foreign location relation.
2. Ability to pay.
3. Org charts.
4. Proof of role in foreign location.
5. Proof that you have not been out of status.

Are you here on H-1B or L-1A visa?

Whenever I / Attorney had raised SR, it has been closed in max. 10 days time. Having said that, I have read here few folks here had to open another SR for the original SR or call them and push USCIS to respond. As far as whether it is beneficial or not, you would never know the answer to that question, I personally feel SR had benefited my case, but some here have opinion, it might delay further the process. Sorry, I hope I had a better answer for you, but that is the way it is, USCIS has no transparency in how they handle things.

Sorry, missed your post and could not respond earlier. Unfortunately, it seems like your case was transferred to Nebraska, this is not uncommon at all. I remember, at the time I had applied in Feb 2017, most cases except mine and couple of others were transferred to NSC. Later that year, they started transferring cases from NSC to TSC. As far as wait time is considered, my personal experience with NSC has been better than TSC (for the visa extensions and in the past). Good luck and hope this transfer does not affect the processing times.

Congratulations on I-140!! I am very certain, it would be a huge sigh of relief.

Sure, SRs for I-485 can be done by self online and any time (once your processing time is beyond what they claim in USCIS Processing time page). But my guess is, they will just respond that they do not have any more visa numbers (Green Cards) to give out for this financial year in your category, so reach out to us after 30-60-90 days if you do not hear from us kind of response.

Folks, received my EAD/AP combo card. Was approved a week ago. Had filed for renewal on 2nd week of Feb.
No update on 140. Will be raising SR today.

Anybody from Jan/Feb 2017 who recently raised an SR and got positive response or traction on the case?



I (my attorney) had raised my second I-140 SR in first week of March and they approved my case on 03/19/18. My PD is 02/09/17, details in my profile.



Just curious. Can an attorney raise SR for 140? I ask this because based on multiple posts, I understand that USCIS will not entertain SR stating " not the beneficiary " which means only employer can raise a SR. If so how can attorney raise request on your behalf?

What am I missing?

Hi Arun, it depends, if your attorney at the time of filing I-140 (or at some point later) filed form G-28, Notice of Entry of Appearance as Attorney or Accredited Representative, in that case they can very well submit SR, call USCIS, receive communications etc.

EB1-C does not allow premium processing, the quick turn around was probably due to non-concurrent filing.

Ohh yes, definitely a high possibility, the number of times USCIS misplaces / looses packages is alarmingly high, for my extension last year, they lost the whole damn package, i did not even have a receipt number generated to follow up, I had a FedEx receipt with signature from someone at Nebraska lock box, had to re-do the whole thing again. InfoPass and several calls were in vain, they couldn't locate the damn package and skeptical to admit they lost it.

The way I saw they had all those files and cabinets on L1 officer's desks during my InfoPass visits made me convince even more of such possibilities.

Call 1.800.375.5283 USCIS Customer Service Center, they will let you know exactly which service center is processing your case and when will you be eligible to raise Service Request.
