I kinda agree, maybe that is after all a triggering point for additional reviews, it was completely my complacency on not coming here on L1A, attorneys found an easy way out back then, they also said it is completely legal and non-controversial to file under this category while on H-1B, what baffles me is, just give the damn RFE if you are so much confused / concerned, don't just sit on it forever.

Quick question.

I completely understand what they told you.

But I am eager to know why they need months to adjudicate in case if the file is on their table? If I know correctly, the case gets transferred to them after all kinds of background verification. The officer only adjudicate the case on basis of merit & either he approves/RFE the case.

Why I am telling this is, my last SR response was the file is in Officer's table & you will get to hear in 2 months. As usual nothing happened. My understanding is all responses are cookie cutter which may not have any relation to actual reality. Probably my file never reached up to Officer's table yet.



Ohh man, I am on my 2nd SR, same "60 days" response, this doesn't give me any motivation :) In my mind our files are on officer's table, it's just that they are used as coasters :) Jokes apart, what I got a feeling was, if your case is picked up and passes 100% of the checks and balances at first attempt then you are good to go, if there is something they send for followup then welcome to a black-hole my friend.

This may be wrong - but the factors affecting the processing time for I140 would be:
1. Employer: If the Employer happens to be a predominantly IT Outsourcing company, then it takes a longer time compared to a company like Citibank, Nokia,SalesForce etc.
2. Salary of the Employee: While no official guidelines exist, the higher the salary, the processing tends to be easier
3. Country getting transferred from: There may be a difference in the processing time for someone who is transferred from India vis a vis some one transferred from Sweden or UK
4. Travel history: During the I140 processing, every time the applicant leaves and enters the US, a new I94 will be generated. And this will trigger the background check AGAIN!
5. Employment History: Time spent with the current Employer and the transition between roles with the current Employer.
6. Processing Officer: This is perhaps the most important factor :-)

These may or may not be the factors deciding how soon the I140 is processed. There may be other reasons.




IMO #6 is the major factor, in my case I do not work for IT outsourcing company, my org is well reputed and has 100% records for all immigration matters, salary is above on par as per my role and job location, agree, India is bottom of pile in each EB-category, haven't travelled since applied, 10th year with current employer.

The dates of processing mentioned are 2 months back.! So, by this time they at least should have touched majority of April cases - however, going by the forum and some of my colleagues who filed in April, it seems to be stuck for April filers. Mine is may - so seems that chances my case will be touched in next 2/3 months is slim.



My 2 cents, do not plan anything concrete based on the timelines as it shows in the "processing page" website, the only good those dates are is they allow you to submit a SR, which itself is pretty much of rare use, they just respond you with cookie-cutter responses, my PD is 02/09, awaiting I-140 approval, and in my conversation with L2 officer, when I pointed him about the processing page website, his response was: "those dates indicate, USCIS has STARTED processing cases around that date, and PROCESSING and ADJUDICATING are two different things" it can take anywhere from few hours to few months for them to ADJUDICATE a case, sorry, did not wan't to disappoint you, but I have learnt these things hard way. Just hang tight :)

From what I have learned from the posts here, SRs are two way sword, few lucky have got movement in their cases right after SRs, some say it can be counterproductive, as when you raise SR, your file literally moves from desk of adjudicating officer, to the rep. who is working on the SR and can delay the process, I have a travel coming up soon and medical / EAD+AP expiring too, so got another one raised but was futile.

To who was asking source for this report, I think it is the same people who do web-scraping of USCIS status website (like mycasetracker.org) and couple of other mobile apps, where you can enter your receipt number and configure it to notify you, when cases around you have any movement.

The good news is that the dates are moving forward based on the update to USCIS website today... but not sure if any new updates to cases have emerged.

Only thing the processing time page updates are useful for is that they allow folks to submit a rhetorical Service Request :( I haven't seen any approval, hopefully things will change in Jan. My RD is 02/09, still waiting for I-140 approval, haven't heard anything, SRs & InfoPass have been futile.
