Because functional manager is a valid category for EB1C. Of course whether he fits the bill, he needs to do due diligence and check with his lawyers. Did you see his lawyer response ? Lawyer suggested that its a possibility. If this was not possible , lawyer would have told him straight away.

Personally, I am highly frustrated with my GC situation. And if someone is on the verge of getting qualified, I will always suggest him to try/explore in as many ways as possible. If you have a problem with that, you are a sadist.

If you think this is a genuine case then either you don’t know EB1C rules OR you have circumvented the rules in the past yourself! There is no way that he is qualified what he just mentioned in his posts and I am not going to point out towards that. When I see people like you, I feel Trump should stop the entire EB category asap!



Yes, I don't know the detailed rules, hence asked him to check with lawyer, and qualified my answers with "may/might".

This thread shows that in the past people have ran this scam in EB1C. This is a classical example we should show to people who often says "Eb1C is pure as white". May be send to IV to throw that on their face about the scam.

Question 1: Which fang are you working ? Are you too ashamed to even say the company name?
Question 2: I am having a hard time believing that you work for fang. Meet me, I work for them.. and may be I can believe you.
Question 3: You are just working from HOME!! That doesnt qualify you for EB1C. Since when working from home is a criteria for EB1C. People who are supporting you are scammer themselves.
USCIS should look into this thread to see how people fake themselves.
Question 4: If you genuinely work for FANG then they give you first class lawyers, like BAL, Fragomen, etc.. You asking this shady questions clearly shows that how cheap and pathetic you are.

Guys like fintechguy who is suggesting you to twist your profile by "A minor technicality is that you need to be part of an affiliate organization / subsidiary organization for a year."

This thread is a classical example of Eb1C scam! I am bookmarking it right now!



Looks like a case of sour grapes to me.
Assuming OP does work for Fang, and is in a Senior position, this is a genuine case.

Also, one more thing. Usually FANG will have reputed big attorney such as Fragomen, and they would have done hundreds of such cases. They don't get many RFEs/denials

Not enough, but there were some functional manager applications, right ? Also as you mention, the guideline mentions that functional managers are ok.
I believe its a typical conservative lawyer's response. You should actively explore EB1C!

Is there anyone who was able to get EB1C approval as functional manager?
I would like to hear your experience.

My case:
I work for one of the FANG companies with approved I-140 under EB2I. I have been at a very senior/principal level individual contributor (tech lead for about 8-10 people team) managing one of the core areas of a large product.
Due to personal/family issues, I have been working remotely from India (for the same team/product in US) for about 7 months now. I need to be here in India for at least couple more months.
I am planning to extend my stay (remote working) till I complete one year before I come back to US, only with the assumption that it will make me eligible for EB1C (under functional manager category).

Has anyone taken such route in the recent past? What was the outcome and your experience with the entire process?

Though I don't have first hand experience, I think this should be possible.
An official good job title would help - like Technical Lead / Program Manager etc.
A minor technicality is that you need to be part of an affiliate organization / subsidiary organization for a year. But looks to me that you are still part of the same organization. Are you still on H1b and working from India ? This might lead to impediment, but again I am not sure.
If you are from FANG, why not contact your lawyer directly somehow/ or some other lawyer. That would put speculations to rest.

Any suggestions will be welcome. So far, I have heard of VC, Suzanne Seltzer, David Zitzkat. VC denied to take my case (my understanding is she usually takes phd cases).
Any opinion on Suzanne Seltzer / David Zitzkat ? Both of them indicate a very high historical rate of success
Any other good EB1A/EB1B lawyers you are aware of ?

Though I don't have much actual experience in EB1's , my advice would be to take time and file a good well rounded application definitely with premium processing (unless specifically instructed by lawyers not to do it). Lack of GC is messing up with our lives, and paying 1000 $ for some quick peace of mind (or quick realization of need to build stronger application in case of RFE) is priceless. Not sure why some lawyers insist on non-premium.

We are in very similar boat. I applied EB-1A at Nebraska in June 2016 (rushed to do it before EB-1 stopped being current). Got RFE in Aug 2017. Replied RFE on Oct 26, 2017. Have been waiting since then.

I have built a couple of companies and sold them. Lot of media coverage. Written a book on Entrepreneurship which is a part of a top Exec MBA course. Numerous recommendation.

We applied with 3 criteria. Got accepted on 1 - Evidence of the alien's original scientific, scholarly, or business-related contributions of major significance in the field. RFE on two others.

Have an approved O-1 on the same criteria.

Let's connect and see if we can share tips. This is really frustrating!

I feel bad for you, as yours is definitely a genuine EB1 case. Maybe you received a tough adjudicator (in Nebraska maybe).

I am also a little confused still. Though my knowledge is based on research only, I know that people who have received basic funding get O1 - there are specialized lawyers who deal with these. EB1 is definitely tougher than O1, but on the same lines.
Also, not sure if you had majority stake in the company, and about your role - were you C*O ? Also have suspicions on your lawyer to be frank. Some EB1 specializing attorneys might have been better maybe (Peter Roberts / V Chen etc.). As you pointed, the lesser number of experience years might have been a factor.

In any case, I would like to connect with you, as I want to move on similar lines. but not sure how to do that in Trackitt.
