RAISE act sounds to be merit-based and I support it.
But having no points for taxes paid is not good.
If they add it with right balance all existing EB2 EB3 applicants will at least have a chance against young guy who just completed his PhD.

I would see what happens first before committing to house.
I do not need the space right away so decision is easier.
I feel market can not get any worse so why buy now and risk losing value.

But I can understand if someone buys - better to build equity than to pay lot of rent.

I agree but disagree - no one (with 2009-2011 PD) underestimated the volume of applicants but assumed there will be spillover like all previous years. With dates close, leaving USA would be unnecessary risk so most of them stay put.

Guys from 2013 and new guys had nothing to lose because they knew they were years behind anyways.
So they gambled, went to India/Canada and got ahead into EB1C killing the spillover and hopes and dreams of EB2 and EB3.

What no one predicted is how easy it would be to convince USCIS that they are EB1C.
Also the economy prompted more new applicants coming from India.

I do not blame the people just the system for having stringent labor and salary requirements in EB2/EB3 and having 0 requirements except coming from India + stupid org chart in EB1C.

200k in some places mean no savings but I agree that you can save 40k in most places.
You seem to have done nice job on saving.

Quick question - I am conservative and seem to like 3xGrossIncome rule for homes.
How are people able t afford 600 or 700k homes in smaller towns like Atlanta, Dallas, Denver?
Is it because they are getting paid CA or NY salary or is it because they are applying 4X rule ready to cut down expenses in other areas?
I am asking because I am perplexed by prices and sitting on sidelines.

Topic: EB1C thread taken down

There was this thread where we were discussing EB1C and how this category needs to be used to reward skills and not one year experience in India.
It got taken down for no apparent reason. People were frustrated but the discussion was clean and there was no personal attacking.
Why is that? Can't we have a meaningful discussion on policy in a public forum?

Topic: How to report EB1-C abuse?

What drives folks crazy is that when people mention abuse in EB1C, all EB1C folks feel that it is personal attack against them but they also claim they are "executives". So why are they scared if you have all the credentials?

Abuse itself is an issue but the relaxed criteria being used compared to other EB1 or even EB2 itself is an issue.

Please let us know how you have applied for H4EAD while H4 COS is still under processing.
What did you provide as valid H4 document?
I had not known this and waited few more months waiting for approval.
This is probably unconventional - do you agree?

I am asking because many others have their COS applications stuck.

Guys, my wife and I were in same situation for 8 months and by pure luck her application was approved this month.
I can understand how frustrating it can be. Please hang in there and may look for other options.
Going to India might be faster option especially if you need to apply for H4EAD.


She applied for H4EAD immediately but now that dates have moved I am not sure if I can apply for 485 EAD while H4 EAD is in process.
485 EAD may take upto 180 days and so I am thinkign I will wait until she gets H4ead.
Any suggestions on this?

Are you sure AOS EAD is best option?
May be long term but I am not sure about short term (next few months).
I am my wife are in similar situation.

AOS EAD may take few months but 6 months is the max limit.
H4 EAD may be available to the H4 spouse very soon (1-3 months).

So if there is immediate need to join a job, H4EAD might still be best short term option - if the H1B spouse has no immediate need for EAD.
I know dates may regress but since they separated out the dates, I do not think it will happen.

What does the new ability to apply for EAD+AP do to the H4EAD?

My wife has her H4EAD in processing (applied only this week).

Should she wait for H4EAD because EAD on 485 may take 6 more months compared to 2 months for H4 EAD?

Is it possible to apply for I-485 EAD while H4EAD is in processing?

Should she apply for 485 EAD + AP and not use that as long as she can stay on H4?

What is the best course of action?

I have seen many CSC cases from May 2015.

My wife's case is at VSC - Dec 2014.
After long wait got approved last week.

Cases at CSC or cases applying with H1B extension somehow are getting processed with 2015 dates.

I also think a lot of it is random.
I am with you - they should stop all 2015 cases and other cases and clear all 2014 cases.

I know VSC is backed up on I539.
But I am seeing only EAD applications have some delay too.

Is your application only for EAD or COS+EAD?
It might be COS that is delaying the process.
One option I want to tell you is to use consular process to get new H4 in India and reapply again.
