Abstract:
On February 25, 2015, DHS published a final rule extending eligibility for employment authorization to certain H-4 dependent spouses of H-1B nonimmigrants who are seeking employment-based lawful permanent resident (LPR) status. DHS is publishing this notice of proposed rulemaking to amend that 2015 final rule. DHS is proposing to remove from its regulations certain H-4 spouses of H-1B nonimmigrants as a class of aliens eligible for employment authorization.
This does not say rescind the rule. Removing certain H4 spouses. May be add some restrictions in line with buy American hire American EO |

My PD is EB2I - 2010 October. Is it wise to change the job now or wait for some time to see if i at least get EAD? Is it safe to change the job now provided i have to start my GC process all over again. |

I think if this happens it is a boon for india and countries like that. Companies might look some americans to hire in senior level and bulk of the jobs will be outsourced. Also, it will be a good time for consulting jobs in US. I think whatever happens market will be adjusted to that. |

Everybody is vulnerable here. If their ultimate aim to cut immigration it will even go to EAD and GC. DT even wants to stop birth right citizenship and that is a constitutional guaranty. All these EAD, GC stuff is legislation and it is easier to change than constitution. |

They can do some kind of extreme enforcement in the beginning, but at the end of the day everything should be a balancing act. One can tell anything if they are not in charge, but once they are in charge they are accountable. The common assumption is here that there will be mass exodus for H1B guys. I think people are making stories out of their anxiety and uncertainty. Business need skills and visa to operate and if they can not find it here they will find some way around. |

I believe we will some changes in immigration policy. But with out H1B and immigration US business can not survive. If DT wants to kill the visa programs, that will open new avenues all around the world. we will see a lot of mobility around the world. Also, India is also going to get a lot of skills from here and eventually new innovations happening in india and china.
Guys, this is not end of the world. If we can not control something do not worry much about it rather look other options which you can control. |

I think DT is a good opportunity for china. now there will not be any TPP. so china can easily break the deals with asian countries. One reason for the richness in US is its global reach. we need to wait and see where US will stand in the international stage. |

Kobach is mainly talking about southern giant wall. And most people think that it would cost billions of dollars and it will be a hot political issue. And also i heard in news analyst that if 12 million people out of this country the projected loss for the economy is 2 trillion dollars.
what i would think is that there may be some changes but most of them are compromised things or as good as status quo. |

whenever they refer immigration it is mainly illegal immigration. For legals there may be some restrictions such as H1B prevailing wage increase or cut GC count. But for that they might give EAD to most of the people in GC line. I think EAD is as good as GC in terms of work and travel. At the end of the day it is republican agenda which will be executed and they are in favor of business and legal immigration with in limit probably. |

I wish that is true...I have already waited for 12 yrs what is 3 yrs. For those who managed EB3 to EB2 porting let me know if at time of porting if your PD has retrogressed are you still eligible to file I-485 or you are back on waiting till PD becomes current again.

I think in order to clear 2008 it will take at least 2-3 years. 2009 take another 2-3 years to clear. I guess 5 year is a reasonable time to get EAD for the 2010 folks. |

Guys.. Now application date retro gate 1st july 2009 to 1st april 2009. Why they retrogate and what is the meaning for us. do they accept application. Another question..when date will come to dec 2010.

they should release 1615-AC05 as it is atleast.. people who need to wait another 5-10 years can atleast change jobs without re-filing PERM/140

from my understanding it is highly unlikely this rule will be published unless there is a provision for EAD for approved i140. i think the idea is to scarp this rule now and start from scratch for the next administration. Not sure |

EB2I may not cross 2009 until Comprehensive Immig. Reform is done for undocumented first.

It is merging effect now. Imagine two queues coming and merged to one. EB3 is merging to EB2 now. So EB2 will only cross 2009 once all 2009 EB3 and EB2 are processed. |

Mostly these rules are set by vendors and not by clients. Vendors set this rule when they are not able to find local candidates and send the job requirements to their affiliates , that means there will be more than one layer. |
