Question to all gurus:
Category: EB1C, I140 approved on Oct 30, I140 filed on Jul 2017, 485 filed on Oct 10, fingerprinting done on 11/17, Did not receive combo EAD card nor no status change on USCIS site, Processed by Texas so far

On the fingerprinting document, i see that only 485-765 mentioned and no sign of 131 anywhere(AP).. is this case for everyone?
On USCIS site, for 131 status says: Case Was Received which is same as 765.

Please let me know.

Topic: Interview for already filed I485 cases

This is partially right. All EB categories are subjected to interviews , but not mandatory. For others I know who has filed even before Mar 2017, have received interviews and people who has filed after Mar have got through without interview.. so it isn't consistent.
Not sure how its picked by USCIS for interviews, may be random OR due to some questions within their cases. All the best everyone.

Hi Gurus.
little Brief on my case: I had a previous approved I140(on EB3) while i was in US , then i went back to India for 5 years and came back after which the company filed for I140(EB1C) which is currently pending from July 2017 in Texas.
I filed for 485, 131 & 765 on Oct 1st 2017, for which my lawyer suggested to get the 140 date ported as well and he proceeded although there was no much requirement to do it, but he proceeded as it will help me if it retros.
Within 485 application, he mentioned A number from I140(EB3) approved petition and also mentioned that I140(EB1C) as pending in supp J.

I received all the receipt notices for 485, 131 and 765 for myself and my wife, but looks like there is an issue with my I485 receipt. It says in Preference Category as "Employment Based -3rd" and the priority Date with 2011 which matches I140(EB3)..
I suppose the the preference category should have been Employment based -1C. Note that EB3 is not even current for Indian nationals.

is this normal for such kind of porting cases?

Topic: H1b extension processing time - Vermont

Checking out this forum today and shocked that people with June receipt are still waiting. Mine is August 3rd.
Gurus : I have a question. Am also in the same sinking boat of Vermont application for extension. This is my 3rd extension w.r.t. I140 within Cognizant and my license is expiring in first week of January.
Please let me know if its worth to go around higher levels within my organization to get the premium processing done? has anyone applied in premium processing at Vermont and got it done within 15 days? I heard that even premium processing takes time and more chances are for RFE's...Any suggestion or advice is good for me at this point in time :)

Yeah. I was under the same impression as you guys. But i re-verified with the lawyer and he says that there is a provision to request to keep the same priority date for I140. I read one more forum about it and seems like whatever my lawyer is saying could be right.

EB1C I140 is pending and I had previous Eb3-I140 approved when i was earlier in this country which is still active. I am on H1-B Visa.
My lawyer is filing I485 and he is suggesting me to go ahead for porting I140 priority date too. My company had not requested to have the same priority date while filing I140 for EB1C, so he is suggesting that its the best thing to do considering the fact that retro could happen at any point in time.
Please suggest if there is any harm to proceed with his suggestion.

For Applying I485 while I140 is pending , the way i understand is the only downside is you might have to do the medical again if it passes 1 yr mark & obviously if 140 is denied then you loose the money invested in applying 485 along with lawyer fees..
But by applying 485 and other associated docs, will only ensure that you are in the queue in receiving EAD and AP, while I140 is still pending.

Experts , please correct me if wrong.

My lawyer was asking me to wait till December for filing 485 as I140 approvals on an average are taking around 10 months, but i am paranoid that some changes would occur for 485 and i might miss my chance... Any suggestions?

My lawyer says that its best to wait for I140 to be approved to proceed for I485 filing, but on other threads people are suggesting there is no harm in applying 485 as its current, the only con is if 140 gets denied i will loose out on fees of the lawyer.
Please suggest whats the best thing to do?

Topic: H4 EAD with H1 receipt

On the same note, My company applied mine and my wife's H1 and H4 extension but not H4-EAD as the company asked me to apply by myself.
My question is :
I have received I129 and I539 receipt notices already. My wife already has H4-EAD valid till Oct 2017.
Does my scenario quality to send the paperwork to Texas(as its a dropbox location) ?
OR
do i need to wait till H1+H4 are approved?
