Topic: I-90 Replacement of Green card Delays

I have applied ONLINE for replacement card because of middle name error ...

Those correcting mistakes in GC, where you able to successfully file i-90 online WITHOUT paying any fee?

If you applied online, do you get the receipt notice immediately? Can THAT be used to make Info pass appointment for I-551?

How about those who applied via paper - How long does it take to get receipt notice?

Is i-90 receipt notice need befoe making infopass appointment for I-551?

Topic: Wrong Issue date & category on Green card? How to correct?

After interview 2 weeks ago , My wife's (dependent EB3I) GC reached my attorney's office. But, unfortunately 'resident since' date has a mistake. It has year as 2017 and category is also incorrect.

Has anyone experienced mistakes on their GC? What are the options to get it corrected? We had also planned international travel, so wondering...

Thanks

It was Rd. I have read may posts were pd = rd on the 485 aos interview notice. That's because they are using family based notices. Don't worry. PD is what's mentioned in you i485 form you submitted. My attorney confirmed the same. And it's best if primary can attends. What's to fear esp when primary is already approved.

My wife (derivative applicant) got her CPO email / update yesterday one day after her interview. Hopefully we'll get it soon.
Goodluck

My wife had her interview today. Waiting time was more but interview was only about 5-7 mins. I was also allowed with her. The officer had her entire file in front of him.
Since we did not have an attorney to attend, asked her to sign a waiver. Then asked her about last date of entry, date of birth, our sons name, where she works, reviewed her passports. Lastly made her sign on a paper that was the oath. Thats it. No other documents asked.
He mentioned since my primary 485 was already approved she should get her GC in 30 to 45 days. I am hoping it would be sooner.

Thanks for sharing.

Where you not allowed inside with him or you yourself chose not to go?

Also what did they ask about his employment (which is unrelated strictly speaking for dependent 485)?

Those of you who have their GC approved and spouse alone has interview pending...

Are you (as the primary) getting an updated employment verification letter for your dependent spouse's interview?

Hello all.
I saw in other interview posts about form g-325a. What is that? I don't recall seeing that when dependent spouse 485 was filed recently?

Edit: Ok I see I not need if recently updated 485 was used.

Hi BPSSMG,
One more question, was you spouse asked details about *your* employment, your job description etc? I assume the answer is no, it was about her current job only (even though strictly speaking her job has nothing to do with her dependent 485)

Hello BPSSMG,
Thanks for your details!

So to confirm,
1.even though you had approved GC and interview was only for your dependent spouse officer allowed you too in the interview? That's good to know.

2. When you say questions asked were "on work experience, description, last entry, kind of visas, how many entries entries, employment status etc...." - those were for your spouse? (and not your work, status etc). Was your spouse was working and in her own status?

3. If all those questions were directed to your spouse and she didn't remember some detail, were you allowed to answer it?

For question on how many entries, kinds of visas -- Did he ask to show proof? My wifre has been here for about 6 years, she was on H4 then F1 then now H1. She has all those approvals papers to prove continuity of status...

Thanks Much!

I want to go.
Why wouldn't you if they allow? In some ways you dependent 485 is tied to your marriage. And you spouse notice does state that.

When your attorney says 'prepare spouse for eb/140 questions' - do you mean to say that dependent spouse should be aware of all the details of the primary applicant like job description etc ? ( even thought primary has got his GC approved recently). My wife has her interview last week Jan. I hope to be able to go along citing I am the primary.

I assume you are a 2007 eb3i filer who got GC recent and have spouse 485 applied?

I lost track of what the confusion is :).
The interview notice for EB spouse (case where EB primary has already been greened 4 to 5 months ago) has wrong priority date. It simply states their spouses 485 recv. date under priority date. That's a side effect of NBC using family based 'interview notice' format. As my lawyer told me, the forms have not yet been updated to exactly fit EB dependent interview cases. If you see, it will mention I-824 (instead of I-134 which applies to EB). Long story short, EB spouse inherits the PD of the primary so long as the marriage was *before* primary's 485 approval. (Dependent spouse's 485 can very well be filed after the primary's GC approval. There is no mandate that it must be receipted before primary's 485 approval)

My attorney said if the officer allows you go along. If not wait in the waiting area.

As long as you were married before your 485 approval you are fine. Your spouse will file EB based 485. Don't confuse with f2a etc.

Correct. It's a known fact. But these interview notices I see the PD is being put as the RD. it's just that they haven't streamlined these interview notices yet

No, mine got approved as my PD got current in Sept'17. Wife 485 was received by uscis mid September.

As long as the marriage was before primary's 485 approval, derivative's 485 gets the same PD. Reference item#6 on the policy manual here https://www.uscis.gov/policymanual/HTML/PolicyMa...

Thanks. Yes my wife interview notice does have that a line in bold too. So hopefully they would want me (principal) in the interview even though my GC was approved 4 months ago.

Topic: AOS Interview experience for dependent spouse ONLY?

Hello,
Anyone here who got their GC in the July-Sept time without interview but filed their spouse I-485 recently (as their date got current)?

I had filed my 485 in 2007, got married in 2010. I filed my wife's 485 recently in Sept when my PD finally got current. Around the same time I got my GC (without interview).

Now my wife has got an interview notice. The interview is technically her, but I am hoping I'll be allowed to attend since (as my wife) she's the derivative applicant.

Anyone have feed back in a similar case?
