Can anyone tell how long it is taking to receive H4 EAD ? From the tracker I can see anywhere from 23 days to 92 days.. Also is there a 90 day deadline for USCIS to make a decision? Please let me know..

You should be able to port you priority date even if it is revoked.. only exception is if it is revoked for fraud reasons.. I can tell this for sure because I was in the same situation, my i140 was revoked last 2015 October and when my new company filed i140 in June 2016, they were able to port the Pirority date.

Having said that, you will not be able to do a H1b transfer if you are over 6 years and need i140 for transfer.

i m just curious whether your i140 is revoked or not since , since USCIS may not have revoked your i140 afterall due to the new change since it takes a month for them to revoke..

RFE premium, you get the email same day.. for regular you may receive it in 7 - 10 days, but if you dont receive it with in couple weeks, employer/lawyer may be able to call and ask for the tracking..

can someone tell me who should raise an SR after completion of 210 days of waiting under regular processing? Is it the employer or attorney or individual who's petition is pending?

Attorney or Petitioner (Employer).. Employee is the beneficiary not petitioner.. so you cant raise an SR, either your Attorney or employer..

I have confirmed that it is certified. I was just wanting to know how long it takes for the attorneys to get the information once it is certified.

they say 7-10 days to receive the physical mail , in my case i think it took about 6 days after approval date. you need this to apply for i140..

in my case attorney received the email from DOL one day before it was updated on PERMChecker.. It should say something like it is "certified".. if PERM Checker shows certified, then it certified..

Also if you want to confirm more, goto http://dolstats.com/ and enter your case number.. it will open your case and you can look into the details by clicking on the link..

Yes and most of the times they send RFE to buy some time as well. My employer told me not to worry about the 240 day rule as USCIS acknowledges that they are delaying the approvals and I should be able to continue working even though USCIS does not give the decision before the 240 day period. I do not know how true that is but mine is a reputed employer(Kforce) so I have no choice but to believe him.

As far as your case is concerned, if there is no change in the status then you can ask your attorney to try raising a SR. It sucks when they issue RFE towards the end of the 240 day period. By the way, you can convert it into premium now as well.



I m not sure if thats true or not but one thing I can say is that if thats not true then you will have worked illegally..

No, I didnt check that yet.. they responded to RFE on May 27th, so I should get the decision by at least Jun 13th.. my 240 day period ends Jun 21st!! so close!!

my case was upgraded to premium as I m only less than month left on my 240 day period.. In premium, they sent my lawyer an RFE email on the same day.. So my lawyer was able to respond the next day..

Also does anyone what happens to the rest of 50% of cases in the previous months that were not done by the time next month start? for example, if Feb started already and only 50% Jan cases are done, what happens to the rest of the Jan cases? any insight from Nov, Dec cases?
