Hi Guys,
Can anybody advice me about how long will it take normally to file a PERM after submitting documents to Attorneys?

I understand that there are few steps that needs to happen before filing for PERM.

All those steps needs to happen in sequence?

Can some of the steps happen in parallel?

If some of the steps can happen is parallel, what would be shortest time possible to file a PERM?

I am also thinking the best option is start from beginning again after reading all the responses and reading the denial letter few times.

Is there a way to the use previous PWD for filing the Perm again? Or does the problem starts from PWD itself?

Fortunately it is still in 6 months. But unfortunately, looks like PERM seems to be the main problem.

So even if I file under EB3, I will probably get same response.

Or I have to start EB3 from the beginning( from prevailing wages step)?

If I start the EB3 from the beginning, is there a way to keep the priority date from this PERM?

I also feel the same. I feel that attorney's messed up with the Perm and wasted money and time.

Do you also think so? Or is just bad luck.

Is there a chance of re filing as EB3 with the same PERM or I have to start from privileging wages again?

Hi guys,

My priority date: Nov 18, 2016
Perm Certified date: Jan 27, 2017
I-140 applied date: April 28, 2017
I-140 denied date: June 30, 2017
I-140 Category: EB2
My Education: 3 year bachelor degree and 1 year Post graduate diploma from India equivalent to US bachelor degree as per education evaluation(Education evaluation was done for H1B). Both in computers.
Experience: 10 years in software engineer before joining my current employer.

Please find the text from denial letter at the bottom.

What options do I have?

Form ETA 9089, Application For Permanent Employment Certification, states in Part H that a master‘s degree and 24 months of experience is required. ln the alternative, Questions 8 through 8.C indicate that a bachelor‘s degree and 5 years of experience would be acceptable. Box 14 of Part H states "Employer will accept a single degree or a combination of degree, diplomas or professional credentials determined to be equivalent by a qualified evaluations service."

The language used in the labor certification indicates the petitioner is willing to accept something other than a formal degree and lessens the minimum requirements of the position; therefore, the labor certification you submitted cannot support the requested immigrant visa qualification.

While it is noted that the beneficiary‘s qualifications may meet the classification, the petition cannot be approved as the labor certification does not support the classification.

Pursuant to Section 29] of the INA, whenever any person makes an application for an immigration benefit, he shall bear the burden of proof to establish eligibility. Accordingly. the petitioner must prove by a preponderance of the evidence, in other words, that it is more likely than not, that the beneficiary is fully qualified for the benefit sought. See Matter of E-M-, 20 l. & N. Dec. 77 (BIA I989). After a careful review and analysis of all evidence in the record, USCIS finds that the petitioner has not established eligibility for the benefit sought.

ln view of the above, the petition is denied.

Application received date is April 28th.
Service center is Nebraska.
Applied in normal processing.

Application was denied without a RFE.

I am still waiting for the denial letter.

Anybody has similar experience of getting denied without RFE with in 2 months after application?

Topic: I-539 : Processing time for H4 to F1

Hi Guys,
I need some suggestions.

I have filed form I-539 for my daughter for extension of stay as H4 dependent.

Here are details of the application.

Processing center: Vermont
Application Received date: Nov 4th, 2016
RFE received: Apr 19th, 2017
RFE responded: Apr 20th, 2017
RFE response received: Apr 25th, 2017.

Since Apr 25th there is no change in status after RFE response.

I have tried to file for Service request before and the system did not allow me because of VSC processing times were still in October 2016.
I see last the processing dates changed to Nov 7, 2016.


Should I file the service request now or should I wait?

As I have received the RFE, will the application still be considered for Service request.

Any advice is much appreciated.

Hi Guys,

Any idea what information about employer is visible to the visa officer?
There were few H1b denials/ H1b stamping denials(Sending to Administrative processing) from my employer.

Can it be due to something wrong with the employer?
Also all the visa officers(embassy's in different countries) see the same information? If one visa officer shares some information, other visa officers in different county see that information or its only visible to the embassy's in that country.
