Topic: RFE on H1 Level 1 Wage

If extension is denied after i94 expiration you have to leave immediately and not 240 days as the other person said. You only have 240 days in total if you are still waiting for a response. But if i94 expired and 240 days passed and you still have no decision on your case you still have to leave. Note you are out of status from day 1 after i94 expires but you do not accrue illegal stay as per USCIS. This is the only reason why you can stay in the country even after i94 expired. MTR is not a legal status and a decision of denial is already made. So even if you go for MTR its best to leave and wait for USCIS to re-evaluate your application.

I received wage level 1 and specialty occupation RFE has any body received approval on this?

Also my I797 has I94 expiration date of 11/30
But when entering the country I94 online shows expiry date 12/10 (10 days more)

Which is my true I94 date to change employer before?

My friend applied for transfer 7 months after I94 expired with Employer B while case for Employer A was taking long time. He got approval with Employer B's petition before Employer A along with new I94. This was all while being in US and he did not have to have the country.

Hope above info helps. Not sure about how it affects you with no reply on your petition with Employer A's or upgrade to PP or no reply from USCIS to any of the queries rased.

Hi First of all congrats that your new H1B got approved. From what I can tell since your new H1B was applied after i94/h1b expiration you will have to check the approval notice for your new H1B. If your new application was filed with extension of stay you will have new expiry date on I797A. If there is no i94 attached you will have to leave and re-enter the country on new h1b.

This is not a legal advice but just an understanding. Try calling a few law firms. They usually have first 10 mins of free consultation. Make sure to ask preciously about your case.

You information was great and helped me understand the options I could follow.

Since premium processing (PP) has started I was thinking of getting the H1B filing with employer B in PP. RFE with employer A lawyers said they will take at least 2 to 3 weeks for file a reply for the RFE. If I receive an approval in PP for employer B even before employer A responds to the RFE will I still have to go back to my country for stamping immediately?

As you mentioned you are past 240 days so even if you are not in US I can make international calls but if you are then awesome since you might have found out a with immigration.

Good thing for you if both employers are holding their h1b's for you. I am not sure if employer A will entertain me having filed h1b with another employer.

Hi Guys,

My h1b extension was filed by my current employer A and received RFE after my visa/i94 date expired on 10/10/17 (7 days ago). So I am on 240 day rule. Employer A's lawyer is working on replying on RFE. My questions are as below.
1. Can I do h1b transfer to a new employer B now (after i94 expiration)? If not can the employer file for a new non-cap h1b (since I am under 6 years) with extension with employer A still pending on the side?
2. Will h1b with employer B be affected since I have pending extension with employer A awaiting RFE response?

Any knowledge from the this community is highly appreciated.

Hi, So what is your next plan of action? Do you have to leave the country? What do you mean by recapture date? Are these the days your are short of completing 6 years of your H1B?

Can you post on the approach your attorney went with? What supporting documents or arguments did he present to justify the wage level 1 LCA?

In my case my visa/i94 date expired so I cannot apply for a new LCA and a new extension. So replying to RFE is the only option i have, thus asking for people who have successful approval on wage level 1 RFE to share attorney details so I can get a consultation with the attorney.

Yes I get the need for clarification. Another thing I am hearing is that some PP application are getting responses in 2 days. So its worth the shot.

Hi,

In both cases (h1 date or i94 date) you have less then 1 month. Upgrade your file to Premium Processing and get an answer instead of leaving the country and the getting approval/denial on your application.

My employer's attorney had filed mine along with 6 other h1b extension with wage level 1 and all of us got the same RFE so he is now looking for a new attorney. I am sure you may not want to share personal details. But sharing the name of the attorney who successfully replied wage level 1 RFE will help others as well.

I have applied for h1b extension in Nebraska and I fall under wage 1 as per my LCA. But my salary from my employer is much higher then the minimum for wage 1 level. So i have a few questions.

Can the current H1b extension be dropped by the employer itself by my employer (before i94 expires) and apply a new LCA with higher wage level as per my salary and re-file for h1b extension? In my case my salary is high but the wage level is 1.

Also does this need to be done before i94 expiration? Since h1b extension has to be applied before your current h1b expires?

Does any one see any issue with this? I just want to rectify any issue that may be caused even before getting RFE and then crossing the i94 expiration date.

Any information is highly appreciated.
