Topic: RFE case for lower wages

I was in similar situation. No issues at all. USCIS does not care if you are making less than your previous job. Make sure you are atleast paid the prevailing wage. Try to avoid L1 wage. In the initial filing itself provide all the necessary documentation to avoid specialty occupation RFE (very common these days). You can refer to my case in the tracker. Sorry to hear about your case. There are lot of things that might have caused the denial. In your response did you provide with % breakdown of duties, how a course learnt in BS/MS would be related to job, organization chart, degrees of other individuals etc. Is your employer a consulting company? How big is the firm?

I am not sure about that but have heard some strategies that attorney apply like they would replace every 2 year exp in IT/CS with 1 year of degree. This is what i have heard.

Does anyone of you know if wage level 2 is an ongoing issue currently or have you guys seen good amount of approvals for L2 unlike L1. ANy inputs here would be appreciated.

I have seen very few cases where if its a non IT or CS degree, this issue occurs but that is usually for freshers. I believe once you have more than 5 years of experience, an experienced attorney usually can turn it around even with non IT background.

@ar169: Is your RFE related to only specialty occupation or is there anything related to wage level 2 as well? Kindly let us know as that can help answer questions.

No I have not received a RFE yet. But just wanted to know if there are problems with Level 2 as well. The SOC code is the occupation name on LCA based on the job title. Any inputs on this would be highly appreciated.
