As per RHC number crunching they aim to reduce the wait time for EB2 Eb3 India to 3 years. How do they do that? By requesting addition 236k GC's to be given to EB3 EB2 India every year. This is without country limits. Just give away 236K visas to Indians in EB2 EB3!!!

If we think mathematically that is almost double the total employment visas every year to be given to people from India in EB2 and EB3.

so 236K + 140K = 376K employment based visas every year with 2/3 rd quota just for EB2/EB3 India. It wont happen.

Why would the Lawmakers agree to that?

This is just wishful thinking at the best.

Why will the government change a rule which is working for every country in this world except India.

Please dont waste your money by donating to groups.

If you want to take part in the rally then its is up to you. Maybe seeing the strength of people UCSIS, DHS may get some sympathy and relax some h1b rules or make the dates move faster.

Participating in the rally is free and you can do that.

In this case IV is angry because RHC is hitting their pockets. RHC is organizing this rally so that they get a name (otherwise who is this shalli kumar/manasvi. i never heard of these people before).

IT Serve want to donate to RHC either to kill a bill or to help the bill because at this situation companies are at a loss when they have to file h1b every year. probably it is cheaper if employees can get GC's then they can get those non compete agreements in handy and sue employees if they leave them. BTW this is Sudha murthy's idea in one of IT Serve meeting. And her idea is attorneys will sue employees if they leave and collect a percent of settlement amount from the employee as the fee.

Hr 392 has so many co sponsors and still didnt make it to the floor. Not once but twice. What makes you think it will be brought on to the house the third time or would be added to omnibus bill (or had a chance to be added).

Take your IV BS somewhere else.

FYI even RHC would not succeed in getting HR392+ added to omnibus or bring it to the floor.

IV, RHC are all "pheku" throw 100 stones at an object and expect atleast 1 stone to hit it. Otherwise blame each other for sabotaging their efforts.

Congress is not going to do anything for an issue which affects just 1 country.

Think realistically why would US waste time in fixing an issue where only 1 country is suffering (read suffering as H1b extensions, visa stampings, port of entry issues) whereas remaining all countries have no issues with the legal immigration policies. Illegal immigration is a different story.

This is my prediction. If EB5 investment amounts remain the same, in the next 10 years Indians will follow the Chinese method. Sell/Liquidate everything back in India and get an EB5 visa. This has more probability than US changing its laws for benefit of 1 country.

Technically a GC is sponsored by an employer so that the employee will work with him permanently.
Now most of us want a GC as fast as we can (some people want GC even without completing 6 yrs on H1) so that we can leave the same employer who sponsored us in the first place.
I understand getting a GC fast to avoid aging out kids is a valid reason. BUT wanting a GC so that one can avoid Visa Stamping/Port of Entry/Switch Employer reasons are not valid and dont hold any water. Because these are under our control and no one is stopping anyone from anything.

So we need to be realistic. Laws were loose earlier. Some people were lucky and got greened. Now US is playing by the rules and GC is hard to get by. Things will get murkier. This will cause a great demand in 2 or 3 or 5 years for skilled labor again. Dates will move fast as more and more people get out of the line for GC.

Dont worry about country limits removal, EAD for I-140 etc etc. Trust your hardwork and effort you've put in the last 5-10 years and just move forward. IV or SIIA or RHC or anyone can just make noise to get attention but laws are tough to change.

Just pray aging out kids get some relief and your spouses work permit will not be touched.

Most ROW EB2 are current. So there should be some spillover to EB2 India. But its not happening because EB2 India 7% limit is reached?

I dont know how this works. So i am putting this question.

This is nothing new. My H1b got denied in 2010 during Obama era due to lack of client letter and attorneys unable to prove Employee-Employer relationship.

I think USCIS wants to give heads-up to prospective new H1b filers to keep everything ready when filing season starts April 1st.

Last year when they announced "Software Programmer" and "Level 1 Wage" issue after April 1st there was a lot of backlash from the attorney community.

So this year they are giving a advanced warning that petitions will be considered only with client letter. if not RFE will be issued. Looks like they know Client letters are hard to get and hence gave this notice so that employers can get them ready as soon as possible.

most of the work being outsourced are basic monitoring stuff on legacy systems. american citizens are sitting on the same technology on support roles. no significant work to be done.

companies dont want to pay salary plus benefits to employees if they dont see a value in the resources hence they were let go. Instead offshoring the entire support work to india and they know someone will take care of their legacy systems and help them build new applications at the fraction of a cost of a full time team.

if any work can be handed down to a lower quality labor, then we can understand the importance of applications they are supporting.

that is the reason companies let go of people. if it is a non/not for profit company then these employees would still be employed now. But if it is a for profit company they will always find out methods to lower their cost and start picking jobs which can be accomplished at a lower cost.

Why does any company need anyone for more than 6 years?
What kind of a project would anyone be working on to be needed for 6 years or more.




This is the same reason US companies fired American Citizens because they are doing the same work and not willing to learning the new technologies. Hence they were selected to be replaced by cheap labor from India.

I have no issue with your thinking if jobs really goes to native or US born american citizens. But if the jobs will go to current GC/Citizens who preceded us and got lucky then it is not fair. I know most of immigrant GC and Citizen junta will be very happy and would support rescinding AC21.

It will be a good idea to try the new points system on new h1B applications.
if its working for american companies and citizens then they can implement the same on GC applications.

DHS/USCIS should launch a MERIT app.

Employees/Employers should answer basic questions regarding the type of job, salary, education qualifications, experience etc etc and points will be generated.

If a cut off is reached then they will be ranked and sent approval to apply for a h1b.

USCIS will adjudicate the cases based on answers submitted during registration in MERIT and validate the documents submitted. if valid h1b is granted. if invalid h1b is denied. and employer employee blacklisted for fraud.

no matter family size try to have one kid in US so that you have a safety net 18 yrs down the line. If a citizen kid sponsors parents then direct GC.

I am saying this because many people in this thread are saying RAISE ACT wont pass so the citizen kid sponsoring parents GC will stay put..
